Lumber Supply Contract

This contract is between the PEPAPASI peoples organization and RVJ Lumber for the supply of logs. [1] PEPAPASI will supply over 900 cubic meters of falcata, 840 cubic meters of mahogany, and 511 cubic meters of yemane logs from its community-based forest management area. [2] RVJ Lumber will purchase these logs. [3] The contract is effective for one year and prices will be agreed upon by both parties, who will also ensure compliance with DENR regulations.

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT is made and entered into by and between:

The PEDERASYON SAN PARAG-UMA UG PARUPANGISDA NG SAN


ISIDRO (PEPAPASI), a duly registered Peoples Organization with Department of
Labor and Employment (DOLE), represented by its President, Mr. Pepito F. Mabini, as
authorized by EXECOM’s Board Resolution, principal address at Brgy. Balite, San Isidro,
Northern Samar, hereinafter referred to as the SUPPLIER;

AND
The RVJ Lumber and Manufacturing (RVJLM), a legitimate Wood
Processing Plant (Mini-sawmill) located at Brgy. Maria Clara, Maasin, Southern Leyte
represented by its owner Mr. Roberto Villanueva, Jr. referred to as the BUYER;

WITNESSETH:

WHEREAS, the SUPPLIER is a CBFM holder No. _____ to expire on _______


and is located at Brgy. Balite, San Isidro, Northern Samar.

WHEREAS, the SUPPLIER is willing to supply to the BUYER mixed planted


species of FALCATA, MAHOGANY and YEMANE tree derived from the CBFM area, with
the following volumes: 918.20414994000 m3 of FALCATA; 840.9087 m3 of MAHOGANY;
and 511.30301838000 m3 of YEMANE.

WHEREAS, the BUYER is willing to purchase from such available volume of logs
derived from the SUPPLIER.

WHEREAS, both parties further agree that:


1. The price of the logs/lumbers shall be agreed by both parties concerned.
2. Both parties hereby mutually agree that all lumbers/logs purchased and sold by
the SUPPLIER to the BUYER shall be covered by requisite documents in
accordance with DENR regulations. Any violation against pertinent DENR laws,
rules and regulations committed by either of the contracting parties shall be
sufficient cause for cancellation of this Contract.
3. This Contract shall take effect immediately and shall remain in force for one (1)
year from the date of its effectivity.
4. This Contract may be revised, amended or modified by both parties, only
through a written document or instrument duly executed and signed the parties,
but not later than the end of its validity.

IN WITNESS WHEREOF, the parties hereto, though their duly representatives,


have hereunto signed this Log/Lumber Supply Contract on the _______ day of
