Section – 6: PERFORMANCE OF WORK

6.1 EXECUTION OF WORKS:


All the works shall be executed in strict conformity with the provisions of the contract documents, explanatory
detailed drawings, specifications and instructions by the Engineer-in-charge/owner. Whether specifically mentioned
in the contract or not, the Contractor shall be responsible for ensuring that works are executed in the most
substantial, proper and workmanship like manner using quality materials and labour, throughout the duration of the
contract in strict accordance with the specifications and to the entire satisfaction of the Engineer-in-charge/owner.

6.2 CO-ORDINATION AND INSPECTION OF WORKS:


The co-ordination and liaison of day-to-day work under the contract shall be the responsibility of the Engineer-in-
charge/owner. Selection of the contractor and award of contract has been based on the presentation of contractor to
understand and implement drawings and designs of Architect therefore he shall carryout the work as per drawing
and designs of Architect to be ratified by Architect and/or owner at the time of weekly/fortnightly review.

6.3 WORKS IN MONSOON


a) The execution of work may entail working in the monsoon/adverse weather condition also. The Contractor
must maintain a minimum labour force as may be required for the job and plan and execute the Supply and
Erection and erection according to the prescribed schedule. No extra rate shall be considered for such work
in monsoon.
b) During monsoon and other periods, it shall be the responsibility of the Contractor to keep the Supply and
Erection work site free from water at his own cost.

6.4 WORK ON SUNDAYS AND HOLIDAYS:


For carrying out works on Sundays and holidays, the Contractor shall approach the Engineer-in- charge/owner or
his representative at least one day in advance and obtain permission in writing. The Contractor shall observe laws
and other statutory rules and regulations in force. In case of any violation of such laws, rules and regulations,
consequence if any, including the cost thereto shall be exclusively borne by the Contractor. The Owner shall have
no liability whatsoever on this account. If advised by the Engineer- in-charge/owner, the Contractor shall provide all
necessary documents to prove that the labour laws and other statutory rules and regulations are adhered to.

6.5 SUPPLY AND ERECTION WORK:

a) The working time is forty-eight (48) hours per week. Overtime work is permitted in cases of need and the
OWNER will not compensate for the same. Shift working at two (2) or three (3) shifts per day may become
necessary and the CONTRACTOR should take this aspect into consideration for formulating his rates for
quotation. No extra claims will be entertained by the OWNER on this account.
b) The CONTRACTOR must arrange for the placement of workers in such a way that the delayed completion
of the WORK or any part thereof for any reason whatsoever will not affect their proper employment. The
OWNER will not entertain any claim for idle payment whatsoever.
c) The CONRACTOR shall submit to the OWNER reports at regular intervals regarding the state and
progress of WORK. The details and proforma of the report will mutually be agreed.
d) Any setback to progress of works will be made good by increase of resources at no additional cost.

6.5 a. DRAWINGS TO BE SUPPLIED BY THE CONTRACTOR:

a) A set of drawings are attached with Tender. These shall be for the general guidance of the CONTRACTOR
to enable him to visualise the type of WORK contemplated and Scope of Work involved. The
CONTRACTOR will be deemed to have studied the Drawings along with the schedule of items and formed
an idea about the WORK involved.
b) Detailed working Drawings on the basis of which actual execution of WORK is to proceed, will be
furnished by the CONTRACTOR from time to time during the progress of WORK. CONTRACTOR shall
be deemed to have gone through the Tender Drawings and instructions thoroughly and

carefully and in conjunction with all other connected Drawings and include the information in preparation
of working drawings.
c) Copies of all detailed working Drawings/ fabrication Drawing relating to WORK shall be kept at the
CONTRACTOR's office at the SITE and shall be made available to the Engineer at any time during the
CONTRACT. The drawings and other documents issued by the OWNER shall be returned to the OWNER
on completion of the work.
d) Where approval of Drawings for Manufacture / Supply and Erection/Fabrication has been specified, it shall
be CONTRACTOR's responsibility to have these Drawings prepared as per the directions of Engineer and
got approved before proceeding with Manufacture / Supply and Erection / Fabrication as the case may be.
Any changes that may have become necessary in these Drawings during the execution of WORK shall
have to be carried out by the CONTRACTOR to the satisfaction of Engineer at no extra cost.
e) As built drawings, of all drawings prepared by the CONTRACTOR, showing all Corrections, adjustments
etc, shall be furnished by the Contractor (Five Copies in hard and soft) for record Purposes to the OWNER.

6.6 RESPONSIBILITY FOR LEVEL AND ALIGNMENT:


The Contractor shall be entirely and exclusively responsible for the horizontal and vertical alignment, the level and
correctness of every part of the work and shall rectify effectively any errors or imperfections therein. Such
rectification shall be carried out by the Contractor at his own cost, when such defects are noticed by him or when
instructions are issued to that effect by the Engineer-in-charge/owner.

6.7 LIGHTING, WATCH & WARD:


The Contractor shall in connection with works provide and maintain at his own cost all lighting, guards, fencing,
watch and ward and the security of the entire work in progress including all the machinery, materials shall be the
responsibility of the Contractor till taken over by the Owner by way of a written taking over certificate.

6.8 ASSISTANCE TO THE ENGINEER:


The Contractor shall make available to the Engineer-in-charge/OWNER, free of cost, all necessary instructions and
assistance in the checking of any works performed by the Contractor and for taking measurements of work.

6.9 DISCREPANCIES BETWEEN INSTRUCTIONS:


Should any discrepancy arise between the various instructions furnished to the Contractor or his agents or staff or
if any doubts arise on the meaning or implementation of any such instructions or should there be any difference of
opinion on the issue, the Contractor shall refer the matter immediately in writing to the Engineer-in-charge/owner
whose decision therein shall be final and conclusive. No claim on losses alleged to have been caused by such
discrepancies between instructions, doubts or misunderstanding shall in any event be admissible.

6.10 POSSESSION PRIOR TO COMPLETION:


The Engineer-in-charge/owner shall have the right to take possession of or use any area / part of the work
under the contract, prior to the completion dates indicated in the master Supply and Erection schedule. But such use
of the facilities constructed shall not be deemed to be an acceptance of any work completed in accordance with the
contract. Shall such possession or use by the Engineer-in- charge/owner delay the progress of work, equitable
adjustment in the time of completion shall be made and the contract agreement shall be deemed to be modified
accordingly.

6.11 CARE OF WORKS:


From the commencement to completion of the work, the Contractor shall take full responsibility for the care of all
works including all temporary works. In case any damage, loss or injury shall happen to the work or to any part
thereof or to any temporary works from any cause whatsoever, the Contractor at his own cost shall repair and make
good the same so that on completion, the work shall be in good order and in conformity in every respect with the
requirements on the contract and the Engineer-in-charge/owner's instructions.
6.12 DEFECTS PRIOR TO TALKING OVER:

If at any time before the work is taken over, the Engineer-in-charge/OWNER shall: -

a) Decide that any work done or materials used by the Contractor or any of Contractor is defective or not in
accordance with the contract, or that the works of any portion thereof are defective, or do not fulfil the
requirements of contract (all such matters being hereinafter called 'Defects' in this clause) and (b) as soon
as reasonably practicable give to the Contractor notice in writing of the said decision specifying particulars
of the defects claimed to exist or to have occurred, then the Contractor shall at his own expenses and with
all speed, make good the defects so specified.
b) In case Contractor fails to do so, the Owner may take, at the cost & risk of the Contractor, such steps as
may in all circumstances be reasonable to make good such defects. The expenditure so incurred by the
Owner shall be recovered from any amount due to the Contractor. The decision of the
Engineer-in-charge/owner with regard to the amount to be recovered from the Contractor shall be final and
binding on the Contractor. As soon as the works have been completed in accordance with the contract
(except in minor respects that do not affect their use for the purpose for which they are intended) and have
passed the tests on completion, the Engineer-in-charge/owner shall issue a certificate (hereinafter called
“completion certificate”) in which he shall certify the date on which the works have been so completed
and have passed the said tests and the Owner shall be deemed to have taken over the works on the date so
certified. If the works have been divided into various groups in the contract, the Owner shall be entitled to
take over any one group or groups before the other or others.

6.13 DEFECTS AFTER TAKING OVER:


a) In order that the Contractor could obtain a completion certificate he shall make good with all possible
speed, any defect arising from the defective materials supplied by the Contractor or that may have been
noticed or developed, after the works or groups of the works has been taken over, the period allowed for
carrying out such work shall be normally one month. If any defect be not remedied within a reasonable
time, the Owner may proceed to do the work at Contractor's risk and expense and deduct from the final bill
such amount as may be decided by the Owner.
b) If by reason of any default on the part of the Contractor a completion certificate has not been issued in
respect of every portion of the works within one month after the date fixed by the contract for the
completion of the works, the Owner shall be at liberty to use the work or any portion thereof for which a
completion certificate has not been issued, provided that the works or the portion thereof so used as
aforesaid shall be afforded reasonable opportunity for completion of these works for the issue of
completion certificate.

6.14 VARIATIONS:
The Owner may at any time during the progress of the Works under Variations in the form of additions to or
deductions from the Works, changes in specifications, changes in the order, timing or method of the Works or other
changes whatsoever, such orders to be issued in writing to the Contractor by Notice of Revision, and the Contractor
shall proceed with the Variations directed. The provisions of the Contract shall apply to the Variations as they apply
to the Works and the Contractor shall be entitled to payment or the Owner shall be entitled to a price reduction for
Variations in accordance with the provisions of this Condition. The price or price reduction for Variations shall be
determined by the Owner based on itemized quantities in accordance with Methods 1 and 2 set out below or on
Method 3

Method – 1

Items for which a unit rate is contained in the Contract shall be priced at that rate. Method – 2

Items for which there is no unit rate shall be priced where possible by comparison with unit rates contained in the Contract
otherwise a fair and reasonable price shall be computed.

Where the price for Variations cannot be based on Method – 1 or Method – 2 above the price shall be on day work rates
calculated as follows:

a) LABOUR: The total number of hours actually and properly worked at the appropriate day work rate stated
in the Contract.
b) MATERIALS: The materials actually and properly used will only be priced in the manner stated in the
contract.
c) PLANT: The plant and equipment actually used priced in the manner stated in the Contract.

6.15 CLEANING OF WORKS AND SITE:


The Contractor shall at all times keep the Works and the Site clean, tidy and free from rubbish and debris,
Temporary buildings and compounds provided or used by the Contractor shall be kept in safe, clean and tidy state.
On completion of the Works the Contractor shall remove from the Site all temporary buildings, equipment, plant,
goods and materials used in carrying out the Works but not incorporated therein and leave the Works and the Site
clean, tidy, safe and free of rubbish and debris.

Section –7: TAXES AND INSURANCE

7.1 TAXES, DUTIES, OCTROI ETC:

a) The CONTRACTOR shall pay all charges such as rent, toll, local taxes, excise duty, other payments and
compensations, if any, in connection with the procurement and handling of materials, fabrication and
execution of works or any method or process connected with the works or Temporary works.
b) G.S.T or any other tax on materials required for the work, And any other taxes etc. shall be payable by the
Contractor and the Owner shall not entertain any claim whatsoever in this respect. Owner is liable to pay
only G.S.T on work done as per govt norms. All other taxes will be paid by the contractor, so rates shall
include all taxes. A copy of challan for the G.S.T and other taxes etc. deposited shall be submitted to the
owner failing which the G.S.T and other taxes. shall be deducted by the owner from contractor’s bills &
submitted to the concerned authorities as per law.
c) Not with standing anything contained elsewhere in the contract, the Owner shall deduct at source, from the
payments due to the Contractor, any taxes required to be deducted at source by law. The amounts so
deducted shall be deposited by the Owner with the concerned authorities as per law. It is for the Contractor
to deal with the concerned authorities directly in respect of any claim or refund relating to the above
deductions and the Owner shall not be liable or responsible for any claims or payments or reimbursement
in this regard.
d) Rate shall include all taxes, levies, royalties, duties etc. Tendered to quote separately the component of
GST for the overall cost of project. (The component of GST should not be included in the unit rate of the
items)
e) GST on Works contract, Tax deducted at source for Income tax and any other levies shall be deducted as
per rules and regulations in force in accordance with acts prevailing from time to time at the prevailing
rates by the OWNER from the bills of the CONTRACTOR.

7.2 INSURANCE:
a) The Contractor shall provide insurance cover (CAR Policy) on behalf of the owner for the total work and
materials at the site. The expenses related to the insurance policy would be borne by the contractor and
would not be claimed from the owner under any condtions. The Owner shall not be accountable for any
loss of material from site, or any losses arising there from, or in any case, non- payment, rejection of such
claims for losses by the insurance company. The value of the insurance shall be 100% of the cost of
contract + GST.
b) Contractor shall at his own expense carry and maintain insurance with reputed insurance companies to the
satisfaction of the Owner as below:

7.3 EMPLOYEES STATE INSURANCE ACT:


a) The CONTRACTOR agrees to and does hereby accept full and exclusive liability to compliance with all
obligations imposed by the Employees State Insurance Act, 1948, and the Contractor further agrees to
defend, indemnify and hold Owner harmless from any liability or penalty which may be imposed by the
Central, State or Local authority by the reason of any asserted violation by Contractor or Contractor to
Contractor of the Employee's State Insurance Act, 1948 and also from all claims, suits or proceedings that
may be brought against the Owner arising under, growing out of or by reasons of the work provided for by
this contract whether brought by employees of the Contractor, by third parties or by Central or State
Government authority or any political sub-division thereof.
b) The CONTRACTOR agrees to file with the Employees State Insurance Corporation, the Declaration
Forms and all forms which may be required in respect of the Contractor's or Contractor's employees who
are employed in the work, provided for or those covered by ESI from time to time under the Agreement.
The Contractor shall deduct and secure the agreement of the contractor to Contractor to deduct the
employee's contribution as per the schedule of the employee's State Insurance Act from wages and affix the
employee's contribution Cards at wages

payments intervals. The Contractor shall remit and secure the agreement of the agency of Contractor to
remit to the State Bank of India, Employee's State Insurance Corporation Account, and the Employee's
contribution as required by the Act. The Contractor agrees to maintain all cards and records as required
under the Act in respect of employees and payments and the Contractor shall secure the agreement of the
contractor to Contractor to maintain such records. Any expenses incurred for the contributions, making
contributions or maintaining records shall be to the Contractor's or contractor to Contractor's account.
c) The CONTRACTOR shall provide every month the details of the ESI deducted from the workers involved
in the said project & paid to the concerned authorities in compliance of the ESI act.
d) The OWNER shall retain such sum as may be necessary from the total contract value until the Contractor
furnishes satisfactory proof that all contributions as required by the Employees State Insurance Act, 1984
have been paid. This shall be pending on the Contractor when the employee's State Insurance Act is
extended to the place of work.

7.4 WORKMEN COMPENSATION AND OWNER'S LIABILITY INSURANCE:


Insurance shall be affected for all the Contractor's employees engaged in the performance of this contract. If any of
the work is subject, the Contractor shall require the sub-contractor to Contractor to provide workmen compensation
and Owner's liability insurance for the latter's employees, if such employees are not covered under the Contractor
insurance. Proof of Insurance cover in this regard for this particular project shall be submitted by the Contractor
before advance payment.

7.5 ANY OTHER INSURANCE REQUIRED UNDER LAW OR REGULATIONS OR BY OWNER:


Contractor shall also carry and maintain any and all other insurance, which he may be required under any law or
regulation from time to time. He shall also carry and maintain any other insurance, which may be required by the
Owner. However the cost related to such insurance shall be borne by the contractor.

7.6 ACCIDENT OR INJURY TO WORKMEN:


The Owner shall not be liable for or in respect of any damages or compensation payable by law in respect or in
consequence of any accident or injury / death to any workman of other person in the Employment of the Contractor
or any contractor to Contractor and an accident or injury / death resulting from any act or default of the Owner, his
agents or servants and the Contractor shall indemnify and keep indemnified the Owner against all such damages and
compensation (save and except as aforesaid) and against all claims, demands, proceedings, costs, charges and
expenses, whatsoever in respect or in relation thereto. Any claim received by the owner regarding any damages or
compensation which was not settled by the contractor shall be recovered from the contractor’s running bills /
security money, etc. For this recovery no discussions shall be entertained decision of owner shall be final.

7.7 DAMAGE TO PROPERTY OR TO ANY PERSON OR ANY THIRD PARTY AND NON-COMPLIANCE
OF LABOUR LAWS:
a) Contractor shall also be responsible for making good to the satisfaction of the Owner any loss or any
damages to all structures and properties belonging to the Owner or being executed or procured or being
procured by Owner or by other agency within the premises of all the work of Owner, if such loss of
damages is due to fault and or the negligence or wilful act or omission of the Contractor, his employees,
agents, representatives or contractor to Contractor.
b) The Contractor shall indemnify and keeps the Owner harmless of all claims for damages to property arising
under or by reason of this contract if such claims result from the default and or negligence or wilful act or
omission of the Contractor, agents, representative or contractor to Contractor.
c) In case of non-compliance of labour laws pertaining to E.S.I., Provident Fund, Insurance & Labour cess
etc. (Challans have to be submitted in every month), Owner reserves the right to deduct the applicable
amount from the final payment, assuming a minimum of 20 % (Twenty percent) of the contract value, as
the labour input or of the cumulative amount as raised in the final payment, whichever is greater, plus
penalty if any, imposed for such non-compliance and deposit it to the relevant authorities without any
question being asked. The decision of Owner in such case shall be final and binding upon the Contractor.

7.8 COMPLIANCE OF STATUTE:

a) The owner shall not be responsible for any claims from the employees deployed by the contractor. The
Contractor undertakes to remit all statutory payments such as PF, ESI etc with the concerned authorities in
respect of such employees deployed by it and provide necessary certificates to the owner and confirm
compliance in this regard.

The tenderer shall ensure that all its employees are adequately covered with necessary insurance schemes as
required under the laws applicable from time to time considering the nature of work and provide copies of
relevant certificate to the owner in this regard.

Section –8: LABOUR LAWS

8.1 No labour below the age of eighteen (18) years shall be employed on WORK.

8.2 CONTRACTOR shall not pay less than what is provided under law to labourers engaged by him on WORK as per
Government of RAJASTHAN minimum wages act.

8.3 CONTRACTOR shall at his expense comply with all labour laws and keep the OWNER indemnified in respect
thereof.

8.4 In addition to above, rules and regulations as contained in Contract Labour (Regulation and Abolition) Act,
1970 will also be applicable for this CONTRACT. The CONTRACTOR shall be liable for ensuring compliance of
the provisions of the acts, registration obtaining licence etc. of his workmen as well as those of Sub-
CONTRACTORS.

8.5 CONTRACTOR shall secure full safety of the workers / employees engaged by him and shall take at his own cost,
insurances and such other safety regulations for the said purpose.

8.6 CONTRACTOR shall comply with any and all laws, ordinances, regulations and decisions of courts (which shall
be deemed to be a part of this Agreement) concerning the health, sanitary arrangements, wages, welfare, safety and
employment of any and all of his workers upon the Project or any portion thereof and shall exclusively bear the
consequences of failure to comply therewith. Contractor shall indemnify and hold the Engineer-in-charge/owner
harmless from any claims, fines or penalties which may be made against the Engineer-in-charge/owner as a result of
Contractor's failure to fulfil these obligations.

8.7 OBSERVANCE OF LABOUR LAWS:


Without limiting the generality of the foregoing, the CONTRACTOR shall fully comply with any instructions in
this regard from competent authorities. The Contractor shall be fully responsible for observance of all Labour and
other laws applicable in the matter and keep indemnified the Owner against effect of non- observance of any such
laws. The Contractor shall be liable to make payment to all his employees and make compliance with labour laws.
If the Owner is held liable, as Principal Owner, to pay contributions etc. under Employee's State Insurance (ESI)
Act or any other legislation of Government or Court decision, in respect of the employees of the Contractor, then
the Contractor would reimburse the amount of such contributions so paid by the Owner. As per latest amendments
to Provident Fund (PF) Act coverage of employees / workers engaged by Contractor are to be provided from the
very first day of their employment. The Contractor shall be fully responsible for Employee's Provident Fund (EPF) /
Employee's State Insurance (ESI) Apprentices Act or any other statutory requirements by the concerned authorities
and shall submit an Indemnity Bond, indemnifying the Owner in respect of the above. Without limiting the
generality of the foregoing the Contractor shall fully comply with any instructions in this regard from competent
authorities.

8.8 IMPLEMENTATION OF APPRENTICES ACT 1961:


CONTRACTOR shall comply with the provisions of the Apprentices ACT, 1961 and the Rules and orders issued
thereunder from time to time. If he fails to do so, his failure will be a breach of CONTRACT. CONTRACTOR shall
also be liable for any pecuniary liability arising on account of any violation by him of the provision of Act.

8.9 CONTRACTOR TO INDEMNIFY THE OWNER:


CONTRACTOR shall indemnify every member, officer and employee of the OWNER, against all actions,
proceedings, claims, demands, costs and expenses whatsoever arising out of or in connection with the works and all
actions, proceedings, claims, demands, costs and expenses which may be made against the OWNER for or in
respect of or arising out of any failure by CONTRACTOR in the performance of his obligations under the Contract
Document. The OWNER shall not be liable for or in respect of any demand or compensation payable by law in
respect of or in consequence of any accident, death or injury to any workman or other person in the employment of
CONTRACTOR or his Sub-contractors and CONTRACTOR shall indemnify and keep indemnified the OWNER
against all such damages and

compensations and against all claims, damages, proceedings, costs, charges and expenses whatsoever in respect
thereof or in relation thereto.

8.10 PAYMENT OF CLAIMS AND DAMAGES:


a) Should the OWNER have to pay any money in respect of such claims or demands as aforesaid the amount
so paid and the costs incurred by the OWNER shall be charged to and paid by CONTRACTOR and
CONTRACTOR shall not be at liberty to dispute or question the right of the OWNER to make such
payments notwithstanding the same may have been made without his consent or authority or in law or
otherwise to the contrary.
b) In every case in which by virtue of the provisions of Workmen's Compensation Act, or any other Act, the
OWNER is obliged to pay compensation to workmen employed by CONTRACTOR in execution of
WORK, the OWNER will recover from CONTRACTOR the amount of compensation so paid and without
prejudice to the rights of the OWNER under the said Act the OWNER shall be at liberty to recover such
amount or any part thereof by deducting it from the Security Deposit or from any sum due to
CONTRACTOR whether under this CONTRACT or otherwise. The OWNER shall not be bound to contest
any claim made under the said Act, except on written request of CONTRACTOR and upon his giving to
the OWNER full security for all costs for which the OWNER might become liable in consequence of
contesting such claim.

8.10 a HEALTH AND SANITARY ARRANGEMENTS FOR WORKERS:


a) In respect of all labour directly or indirectly employed in WORK for the performance of CONTRACTOR's
part of this CONTRACT, CONTRACTOR shall comply with or cause to be complied with all the rules and
regulations of the local Sanitary and other Authorities and as framed by the OWNER from time to time for
the protection of health and sanitary arrangements for all workers and as required under various welfare
statutes.
b) The CONTRACTOR shall provide rubbish chutes and bins at required places and arrange for periodical
cleaning at his own cost.
c) The CONTRACTOR shall provide washing bay with water jet pumps at the locations shown by the
Engineer for washing cars, tyres, vehicles and for other purposes, and maintain the same till the completion
of work at his own cost.
d) No extra claims on these accounts are admissible.

8.11 SAFETY REGULATIONS:


In respect of all Labour, directly or indirectly employed in WORK for the performance of CONTRACTOR's part of
this Agreement, CONTRACTOR shall at his own expense arrange for all the safety provisions as per safety codes of
C.P.W.D, Indian Standards Institution, The Electricity Act, The Mine Act and such other Acts as applicable. The
CONTRACTOR shall employ a Safety Officer (He should have experience of 5 to 10 years) at the site of works that
shall be responsible for all matters relating to safety and provisions contained herein.
CONTRACTOR shall also observe and abide by all safety regulations of the OWNER as given below:

a) Temporary fixtures like sheds, tents etc. shall be erected in conformity with normal safety
standards. Thatched roof to such fixtures will not be permitted.
b) Temporary piping, hose connections and electrical wiring must be laid in a manner that they may not
cause tripping or pose hazard to other activities.
c) All precautions should be taken to ensure that any temporary electrical wiring used within the site will not
cause sparks.

8.12 Compressed gas cylinders shall be used in upright position. They must be firmly located on the ground on a sturdy
stand and the cylinder should be chained to prevent accidental fall.
8.13 Good housekeeping must be practiced by the CONTRACTOR's personnel at all times while within the site during
and after completion of the work, they are to ensure that their work area is kept clean and tidy. Materials and
equipments should be stored in a safe and orderly manner so that they will not block exit to roads, buildings, aisles,
passages and approach to fire fighting equipment such as fire hydrants, fire

hoses and fire extinguishers or areas where emergency safety showers, electrical switch panels and switch rooms
are located.

8.14 PERSONAL CONDUCT:


a) Entering the site premises while under the influence of alcohol / narcotics is strictly forbidden.
b) Horseplay will not be allowed.
c) Fooling on the work, mock fighting or fighting within the site premises shall be strictly prohibited.
d) Gambling within the site premises is strictly forbidden.
e) Entering site premises while in possession of weapons such as knives etc. is prohibited.
f) CONTRACTOR's personnel shall not pick up quarrel or get into arguments with the OWNER's personnel
or act in any manner subversive of plant discipline. In case of any misunderstanding such problems should
be referred to the Engineer.

8.15 The CONTRACTOR shall ensure that all state traffic rules and regulations are complied with while motor vehicles
are driven inside site premises. In addition, the following points are also outlined for compliance: PARKING:

a) As a general rule, vehicles should not be parked at road bends, in front of fire equipment sheds and fire
fighting equipment thereby blocking access to them.
b) Vehicles driven in the premises should have effective brakes, horns, lights, mufflers etc.
c) Vehicles shall carry only the number of passengers or weight of load they are authorised to carry as per law.
Loads carried in trucks shall be properly secured so that they will not accidentally fall off while vehicle is
in motion.
d) Vehicle drivers shall always check over-head and side clearances while driving vehicles.

8.16 FIRE PROTECTION EQUIPMENTS:


a) CONTRACTOR shall provide fire protection equipment wherever it is required. The CONTRACTOR's
personnel who are working on such jobs will be instructed the operation of such fire protection equipment.
In the event of an accidental fire it is expected of such personnel to make efforts to extinguish the fire with
the equipment made available. If the fire situation cannot be controlled, then the CONTRACTOR's
personnel should immediately get in touch with any of the OWNER's personnel available. In all cases,
accidental fire shall be reported to the OWNER.
b) All efforts should be made by the CONTRACTOR's personnel to prevent occurrence of any unwanted fire.
Gasoline driven engines, trucks, tractors etc. shall not be filled with fuel while the motor is still running.
c) Gasoline or naphtha must not be used as a cleaning agent or solvent.

8.17 REPORT ON ACCIDENTS:


d) All personal injuries sustained by the CONTRACTOR's personnel and damages to vehicle and property, no
matter how slight they are, shall be promptly reported to the Engineer during normal working hours.
e) Medical treatment for injured CONTRACTOR's personnel will be entirely the responsibility of the
CONTRACTOR.
8.18 SAFETY CODE :
a) There shall be maintained in a readily accessible place first aid appliances including adequate supply of
sterilised dressings and cotton wool.
b) An injured person shall be taken to a public hospital without loss of time, in cases where the injury
necessitates hospitalization.
c) The support for the scaffolding, staging, guard lines and temporary stairs required during Supply and
Erection shall be strong, adequate for the particular situation. The temporary access to the various parts of
the Building under Supply and Erection shall be rigid and strong enough to avoid any chance of mishaps.
The arrangement proposed shall be subject to the approval of the OWNER.

d) Suitable and strong scaffolds should be provided for workmen for all works that cannot safely be done
from ground.
e) No portable single ladder shall be over 8 (eight) meters in length. The width between the side rails shall not
be less than 30 cm. (clear) and the distance between two adjacent rungs shall not be more than 30cm.
When a ladder is used an extra labourer shall be engaged for holding the ladder.
f) The excavation material shall not be placed within 1.5 metres of the edge of the trench or half of the
depth of trench whichever is more. All trenches and excavations shall be provided with necessary fencing
and lighting.
g) Every opening in the floor of a building or in a working platform shall be provided with suitable means to
prevent the fall of persons or materials by providing suitable fencing or railing whose minimum height
shall be one metre.
h) No floor, roof or other part of the structure shall be so overloaded with debris or materials as to render it
unsafe.
i) Workers employed on mixing and handling material such as asphalt, cement mortar or concrete and lime
mortar shall be provided with protective footwear and rubber hand-gloves.
j) Those engaged in welding works shall be provided with welder's protective eye-shields and gloves.
k) No paint containing lead or lead products shall be used except in the form of paste or readymade paint.
l) Suitable facemasks should be supplied for use by the workers when the paint is applied in the form of spray
or surface having lead paint dry rubbed and scrapped.
m) Overalls shall be supplied by the CONTRACTOR to the painters and adequate facilities shall be provided
to enable the working painters to wash during the period of work.
n) Hoisting machines and tackle used in the works, including their attachments, anchorage and supports
shall be in perfect condition.
o) The ropes used in hoisting or lowering material or as a means of suspension shall be of durable quality
and adequate strength and free from defects.
p) Safety features like nets, canvas sheets etc. shall be provided while men are working at heights.

8.19 SAFETY RULES TO BE FOLLOWED BY THE CONTRACTOR DURING EXECUTION OF WORK:


a) All the staff working at site will wear helmets.
b) All electrical equipment used by the CONTRACTOR will have double earthing and will be connected
through an ELCB.
c) No temporary electrical connections with loose wire will be permitted. For all electrical connections,
proper sockets and plugs will be used and wiring / cabling clamped.
d) Electrical hand tools like drilling machine will be of 220 volts type provided with an adequate step down
transformer.
e) ELCB's will be used wherever power & electrical connections are taken by the CONTRACTOR.
f) Fire fighting portable extinguishers will be used and located at appropriate locations.
g) All staff working at heights will use safety belts and standard platforms with 42" height railing.
h) All the staff working will as far as possible wear shoes.
i) All electricians will have wiremen's licence.
j) Standard ladders will be used, non standard ladders will not be permitted.
k) Inflammable materials like Petrol, Kerosene, Wax etc., will not be allowed to be stored at site stores.
Special storage space with fire protection arrangements will be provided.
l) Each CONTRACTOR will keep a stocked FIRST AID box with easy accessibility. Respiratory
protective equipment should be available with the CONTRACTOR.
m) Welding mechanics and electricians will wear rubber gloves.
n) Personal protecting equipment like Ear Muffler, Goggles, Gloves, Safety Belt, Safety Helmet, Rubber
Shoes, etc., should be used and be available in CONTRACTOR's stores.
o) Use of asbestos to be prevented.
p) If correct manual handling is not used, it can result in back injuries. Therefore all workers should be
trained in safe manual handling. Special objects require special handling.
q) All scaffolding will be of steel and double stage unless otherwise permitted.

r) CONTRACTORS to ensure that all equipment tools, brought on to the premises will be in a safe condition,
have recently been checked and that all personnel using the equipment and tools have been trained in their
safe use.
s) CONTRACTOR to ensure that whilst on site premises, he will comply with all health and safety legislation
as required by the OWNER.
t) All the platforms, scaffolding and catwalks should have railings of 1 Mt. height and 100 mm toe board. All
the catwalks should be minimum 450 mm wide and of grill type. All ladders should have hand rails.

8.20 TEMPORARY COMBUSTIBLE STRUCTURES:


Temporary combustible structures shall not be built near or around work site.
8.21 EXPLOSIVES:
Explosives shall not be stored or used on the works or on the site by the CONTRACTOR without the permission of
the Engineer-in-charge/owner in writing and then only in the manner and to the extent to which such permission is
given. When explosives are required for the works they shall be stored in a special magazine to be provided at the
cost of the Contractor in accordance with the Explosives Rules. The Contractor shall obtain the necessary licence for
the storage and the use of explosives and all operations for which explosives are employed shall be at sole risk and
responsibility of the Contractor and the Contractor shall indemnify the Owner against any loss or damage resulting
directly or indirectly there from.

8.22 PRESERVATION OF PLACE:


The CONTRACTOR shall take requisite precautions and use his best endeavors to prevent any riotous or unlawful
behavior by or amongst his workmen and other employed on the works and for the preservation of peace and
protection of the inhabitants and security of property in the neighborhood of the work. In the event of the Owner
requiring the maintenance of a special Police force at or in the vicinity of the site during the tenure of works, the
expenses thereof shall be borne by the Contractor and if paid by the Owner shall be recoverable from the
Contractor.

8.23 OUTBREAK OF INFECTIOUS DISEASES:


The CONTRACTOR shall remove from his camp such labour and their families as refuse protective incubation and
vaccination when called upon to do so by the Engineer-in-charge/owner Representative. Shall Cholera, Plague or
other infections diseases break out, Contractor shall follow instructions given by competent authorities or the
OWNER.

8.24 CONTRACTOR'S BARRICADES:


a) CONTRACTOR shall erect and maintain barricades required in connection with his operation to guard or
protect:
b) CONTRACTOR employees and those of his sub-contractors shall become acquainted with Owners
barricading practice and shall respect the provisions thereof.

c) Hoisting Areas.-
a. Areas adjudged hazardous by Contractor's or Owner's Inspectors.
b. Owners existing property subject to damage by Contractor's operation

8.25 FIRST AID AND INDUSTRIAL INJURIES:


d) CONTRACTOR shall maintain first aid facilities for his employees and those of his contractors.
e) All critical injuries shall be reported promptly to Owner and a copy of Contractor's report covering each
personal injury requiring the attention of a physician shall be furnished to the Owner.

8.26 SAFETY:
f) The CONTRACTOR shall be entirely responsible for the safety of the workers and structures during Supply
and Erection. The Contractor shall follow the various Indian Standard Safety Codes during execution of
work. All workers (including female workers), supervisory staff, engineers, visitors into the Supply and
Erection area shall be provided with safety helmets and safety shoes by the Contractor. Any labour found
without wearing the same shall be levied a penalty of Rs. 500.00 per person per day, which shall be paid
by the Contractor. No child labour below the age of 18

(Eighteen) years shall be employed by the Contractor. No children of workers, especially the practice of
women workers bringing their children to site will be permitted. The Contractor shall ensure provision of a
well-maintained creche at a safe place at his own cost. The Contractor shall maintain hygienic conditions in
the labour camp with proper toilet facilities. If at any time during the progress of work it is noticed that the
workers are working on site without safety helmets and / safety shoes a penalty of RS 500/- per day per
person shall be charged from the Contractor, decision in this regard shall be taken by the OWNER and
shall be final and binding on the Contractor.
g) Levy of penalty does not mean that contractor is free from his liability and persistent failure to comply with
above provision shall be consider as breach of contract.
h) The CONTRACTOR shall provide each labour with a badge. The badge shall consist of Name of
Contractor, Name of Labour, Age of labour, and Validity of badge or as a specimen supplied by Owner. If
any labour is found without wearing the badge, the same shall be issued the badge and the Contractor shall
be penalised by Rs. 500.00 per day/person.

8.27 HAND BOOK ON HEALTH AND SAFETY AT WORK:


The CONTRACTORS to do work in the Projects shall follow the guide lines given in the hand book on health
and safety at work appended, during execution.
LAW AND HEADINGS:
a) The Contract and all matters arising from or connected with the Contract including validity thereof shall be
subject to laws of India and the parties irrevocably submit to the jurisdiction of Courts in India.

b) All disputes arising from this Contract shall be deemed to have arisen in Delhi and Delhi Courts shall
have exclusive jurisdiction to try and entertain the same.

c) The headings to these conditions are for convenience only and are not to be taken into account the Supply
and Erection.

9.2 SITE PARTICULARS:


The intending tenderers shall be deemed to have visited the site and familiarized themselves thoroughly with the site
conditions before submitting the tender. Non familiarity with the site conditions will not be considered a reason
either for extra claims or for not carrying out the work in strict conformity with the drawings and specifications.

9.3 TIME SCHEDULE:


a) Time is the essence of this contract and work has to be completed within the stipulated time.
b) The completion time stipulated is inclusive of monsoon period and no extension of time shall be granted on
this account. During inclement weather, the contractor shall suspend welding for such time as Engineer
may direct, shall protect from injury, all the work in course of Supply and Erection. The contractor shall
work on areas in accordance with the priorities assigned by the Engineer and shall complete the same in the
sequence directed by the Engineer.

9.4 PLANNING SHCEDULE:

9.4.1 The CONTRACTOR shall submit a level 3 Planning Schedule in the form of Bar Chart indicating the
following:
a) Activity description
b) Activity duration – Original and Remaining
c) Early start, early finish, late start, late finish dates
d) Total float
e) Critical path

9.4.2 The CONTRACTOR shall submit the list of resources available for the project along with resource loading bar chart
indicating the following:

9.4.3 The CONTRACTOR shall submit progress report every fortnight and shall indicate but not limited to the

9.4.4 The Contractor must follow their planning schedule and must adhere to the targets / programmes by deploying
adequate resources. In the event of overall slippage exceeding permissible limit as decided by the Engineer, then the
Contractor shall submit a report for the slippages and shall revise their planning schedule. The Contractor shall
submit a report explaining course of action taken to overcome such slippages in future and steps taken to meet
revised target dates.

9.4.5 The tenderer shall submit Curriculum Vitae of key personnel.

9.4.6 The Contractor shall depute at the work site a Senior English speaking Supply and Erection manager who shall be
authorized to take decisions locally and receive information from the Engineer, attend weekly
co-ordination/progress meeting with the Engineer etc.

9.5 METHOD STATEMENT:

9.5.1 The tenderer shall provide with his offer details of his intended method of operation in accordance with the
following requirements for Method Statement.

9.5.2 Acceptance of any Method Statement does not relieve the Supplier/Contractor of his legal obligation to carry out the
Works in accordance with all relevant statutory provisions.

9.5.3 Your Method Statement shall:

9.7 DECLARATION: (To be submitted duly stamped and signed by the contractor)

9.7.1 We, the undersigned do hereby tender and undertake to perform, provide, execute and do all the works, materials,
matters and things described or mentioned in the tender notice, special conditions, schedule of quantities,
programme chart, articles of agreement, conditions, preliminaries and specifications which have been produced to
and carefully examined by me/us in strict accordance with and under the same subject to the terms, provisions and
conditions set forth or mentioned in the said tender documents.

9.7.2 We also undertake to do all extra or varied works, which may be ordered as part of this contract upon the terms
provided for in the conditions of contract.

9.7.3 We undertake to complete the whole of the works required in accordance with the programme charts from the date
of receipt by me/us of notice that my/our tender has been accepted.

9.7.4 We hereby undertake and agree to abide by this tender for thirty (30) days from the date of this tender of any
extended date as may be mutually agreed upon.

9.7.5 CONTRACTOR’S PAYMENT REQUESTS:


Each calendar month the Contractor shall submit to the Owner a payment request in the form prescribed by the
Contract setting out in addition to any other particulars required by the Contract the Contract Price, the amount of
any additional costs and prices and price reductions in respect of Variations authorized by the Contract, the sum
representing the proportion of the Contract Price and of the amount of the said additional costs prices and price
reductions corresponding to the proportion of the Works carried out in accordance with the Contract at the end of
the previous calendar month, the equivalent sum appearing in the previous payment request and the difference
between those two sums, such difference being the amount due to the Contractor.

9.7.6 PAYMENTS TO CONTRACTOR:


Payment shall be released to the contractor as per the following:
1. PAYMENT FOR SUPPLY OF MATERIAL:

a) 10% advance with order against Bank Guarantee.


b) 20% on approval of drawings.
c) 60% progressively against delivery at site. Out of this 30% will be released, after inspection prior to
dispatch and balance 30% on receipt at site.
d) 5% against completion of supply.
e) 5% retention, which will also be released against B.G

2. PAYMENT FOR ERECTION:

a) Pro-rata basis with holding 5% retention from each bill. Minimum billing should be submitted by the
contractor 10.0 lac for erection work.

Retention money at the rate of 5% (Five percent) in running bills will be recovered. Retention money will be
released twelve (12) months after Final Bill certification.
The Contractor shall when submitting payment requests including a request for payment to Sub- Contractors to
whom the Contractor has been required to sub-let under Condition 7 include a receipt signed by each such Sub-
Contractor for the full amount of any previous payment due to each such Sub- Contractor. Failure to submit such
receipts shall entitle the Owner to deduct from any payment due or to become due to the Contractor any amount
unpaid to such Sub-Contractor and the Owner may pay such amount direct to the Sub-Contractor.
The Contractor shall keep such books and records as shall readily and in detail disclose the make-up of and
justification for any payment request or any payment made under the Contract and shall make them available upon
request for examination and audit by the Owner or any representative appointed by the Owner at any time upto two
years after the issue of the Certificate of Final Acceptance or after termination of the employment of the
Contractor or abandonment of the Works. If such examination and

audit reveals any payment in excess of the Contractor’s entitlement under the Contract the Contractor shall
forthwith upon demand repay the excess.

3. VALIDITY OF BID
Bid shall remain valid and enforceable for acceptance for 2 (Two) months from the due date of receipt of Bids and during
this period no Bidder shall be allowed to withdraw / modify his Bid during the said period of 2 (Two) months. In the event
of any such withdrawal / modification during the above said period, Owner shall have the full right to recover the full amount
of the Earnest Money Deposit of the Bidder.

Section – 10: SCOPE OF WORK

10.1 GENERAL

10.1.1 The scope of work for Portal type Steel Building System is as defined in the following sections under the contract
which includes Design, Manufacture, Supply and Erection of Structural Steel System, Crane girders, Metal Roof
System, Wall System, Trims, Flashings, loading, transport, unloading at site, stacking, handling at site, hoisting,
erecting in position, testing and handing-over to the Owner, the anchor bolts, anchor bolt templates, safety ladders,
ridge vent, turbo vents roofing & cladding sheeting, transparent sheeting for sky lighting, Roof and wall insulations,
roof gutters, flash gutters and down-take pipes for the above building on “turn-key” basis and guarantee the
performance of the whole system for its intended use for a period of 25 years. Also all accessories as required for
the successful and satisfactory completion of the contract.

10.1.2 The works for RCC framed structure, flooring and masonry work as per TENDER DRAWINGS being executed by
other agency appointed by the Owner. Entire steel columns, roofing and cladding system including roofing
structure, gable frame/gable columns, supplying bolts for anchoring / holding down the roof and gable end structure
against the RCC framed structure, gutters etc. shall be in the scope of the work under this tender. Rainwater down-
take pipes from the gutter and upto the ground level shall also be within the scope of work under this tender.
Overlapping of fascia, gutter boxes, cladding sheets etc with the RCC frame or masonry work below, as indicatively
shown in the drawings and shall be required to ensure water-tightness and weather proofing shall be included in the
scope of works under this tender.

10.1.3 Further tenderer shall submit the desired air changes/ hr for Venilations according to NBC along with GAD to
Architect.

10.1.4 Work at any depth below ground level wherever applicable or any height above ground level and at all levels,
heights & elevation and location.

10.1.5 Supply anchor bolts, templates for positioning of foundation bolts with necessary arrangements to protect the
threads from environmental impacts and check the centerlines, alignment and levels before concreting and after
concreting, be present at the time of concreting by Civil agency/contractor, jointly sign the Pour card and own
responsibility for the correctness of position of foundation bolts. A minimum of 7 nos of MS plate template (or as
required) per building/per foundation type has to be supplied by the PEB contractor along with the anchor bolts.

10.1.6 Provide additional frames / secondary supports as necessary around openings such as Rolling shutters(Frame should
be consider for Gandhi, Rama and Prakash Rolling or Equivalant), Gravent (Continuous Ridge Ventilators & roof
monitors if any), Door and Windows, Fan / Louver openings, Glazings, service openings etc ,and provide trims,
closures & flashing to such openings to ensure water tightness wherever applicable. Canopies with gutter and down
take pipe for Door and Rolling shutter opening should be provided as shown in the drawing. Bidders to consider
wall cladding line to be as shown in the Tender drawings.

10.1.7 Providing pre-punched holes of requisite diameter in Purlins, wherever necessary, for supporting service lines
structures. Providing pre-punched holes of required diameters in Rafters, and Columns where ever necessary this
will be indicated during the submission of shop drawing, for supporting service lines.

10.1.8 Tenderer shall submit the 3D view of each building after approval of GAD before execution to Architect.

10.2 DETAILED ENGINEERING:

10.2.1 The contractor shall design the structures and prepare all the required drawings needed for correct and accurate
Supply and Erection. The design shall be strictly in accordance with the “Design Specifications” given in TENDER.

10.2.2 Providing Preliminary Design calculations with STADD Pro file (2D and 3D Model) latest version with detailed
load data calculations to be provided for structural design validation along with the TENDER is a requirement.

10.2.3 The CONTRACTOR should prepare PEB building’s Detailed Brief Report and submit to OWNER AND
ARCHITECT and get the entire design STAAD model approved by prior to commencing the PEB building drawing
preparation.

10.2.4 The CONTRACTOR shall submit the design basis and General Arrangement (G.A) of the structure along with
required explanatory sketches/drawings and gets the same reviewed by consultants and Owner before starting the
final design and Ready for Fabrication. Ten days time will be required by OWNER/ consultants for approval. The
contractor shall also furnish the foundation loading data for the structure. After taking approvals from architect/
consultant on GAD also have to take final consent from owner for fabrication.

10.2.5 Preparation, submission, revision and resubmission (if directed by the Consultant) of detailed design calculations
and detailed drawing shall be included in the scope of the work of the contractor and quoted price shall be deemed
to include cost for the same. If directed by the consultant the contractor shall submit all further details, clarifications
and attend the meeting for discussions at the office of the Architect/Consultants/Owner’s office site at no extra cost
to the Owner.

10.2.6 Within 10 days of commencement of the contract, the contractor shall submit detailed design calculations and
detailed drawing for proof checking by the Consultant. Fabrication at the contractor’s shop/factory shall be started
only after all above design and drawings are proof checked by the Consultant. The above detailed drawing shall also
include a detailed list of pre-engineered structural elements, materials and roofing/ cladding sheets, accessories,
fasteners etc. to be brought at the site for completion of the entire work. The drawings shall be submitted in 4 sets.
The Consultant will proof check and approve/comment on the design calculations and drawings or ask the
contractor to revise & re-submit the design calculations and / or drawings in case the same are incomplete or
contain any error or omission or insufficient details. If directed by the consultant, the contractor shall revise and
resubmit the design calculations and / or drawings for further scrutiny and proof checking without any extra cost to
the owner. Proof checking of the design and drawings by the consultants shall not relieve the contractor from his
responsibility of ensuring correctness and adequacy of the entire pre-engineered system for its structural stability
and performance for its intended use.

10.2.7 Security against any theft and damage and loss of all materials brought at site by the contractor shall be the
responsibility of the contractor and no claim (whatsoever in nature) in this regard shall be accepted by the Owner.

10.2.8 Supply and Erection of the structure shall not be taken up at site till all the drawings are reviewed by Engineer and
comments/suggestions given by Structural Consultants are incorporated.

10.2.9 Engineer reserves the right to review any/all or none of the designs and drawings. Review by Engineer shall not
relieve the contractor of his responsibility for correct design and execution of the works.

10.2.10 The final design and drawings shall directly adhere to the reviewed design basis and general arrangement and shall
incorporate all the comments / suggestions given by Engineer without any extra cost to the Owner and any
implication on time schedule for completion of work.

10.2.11 After the completion of Supply and Erection, the contractor shall submit to the Owner “As Built” drawings in
requisite number of copies as specified elsewhere.

10.2.12 The scope of this package will include Supply and Erection of all PEB structure described in the drawing including
modification of the existing facility/factory, submission of any necessary calculation for modification of the
termination points and coordination with OWNER/ ARCHITECT team as may be necessary to facilitate the PEB
connection.

10.2.13 Contractor to respect the architectural drawings submitted in this tender package and ensure no infringement of any
opening or clear space shown in the drawings e.g. any bracings that may necessary for structural design should not
obstruct any door/rolling shutters or internal spaces at any level etc.

10.3 SAMPLES :
a) The Contractor shall furnish to the Owner for approval such samples as the Contract requires. The samples
shall be submitted in adequate time for approval before carrying out the part of the Works to which the
samples relate.
b) The samples shall remain the property of the Contractor who may where appropriate incorporate them into
the Works after approval.
10.3.1 Approval by the OWNER shall not relieve the Contractor of any obligation under the Contract apart from this
condition.

10.4 SUPPLY AND ERECTION:

10.4.1 Erection of all structural works roofing, cladding, framed openings etc., including supply of all materials, labour,
supervision, plant, tools and tackles etc., shall be carried out by the Contractor.

10.4.2 All materials of Supply and Erection shall conform to the Material and Painting Specifications given in TENDER.

10.4.3 Erection of the Building shall be done in the presence / guidance of the Manufacturers.

10.4.4 Foundation Bolts shall be cast by the civil contractor duly certified and under the supervision of the Manufacturer’s
engineers.

10.4.5 No welding is permitted at site unless otherwise cleared by the ARCHITECT/OWNER.

10.4.6 Necessary bolts, nuts, washers etc. should be included in the respective works. However these will not be part of
minimum tonnage guarantee.

10.4.7 Fabrication of the structural steel items shall be completed in all respects including all associated costs such as but
not limited to packing in cage-type cases as found necessary, transport to site, unloading at site and stacking the
materials on plain hard level ground over wooden or concrete runners/ sleepers to prevent distortions to the shape of
the steel sections. Stored materials shall not come into physical contact with ground surface, slush, Supply and
Erection debris, waste dumps and any such deleterious materials. The steel sections shall be covered suitably as
directed to prevent rusting. No water, either from rain or any other source, can be allowed to accumulate or
get deposited in any part of structure for which suitable protective cover shall be placed until commencement of
erection. If any water marks or earth marks are found on any part of structure, Clients reserve the right to reject the
material straightaway or order further paint coating as OWNER feels necessary, which shall be carried out by the
Contractor at his own cost and no extra time shall be allowed for such rectification measures.

10.4.8 Making own arrangements for housekeeping, safe storing of materials at site and protecting the work till final
handing over to the owner.

10.5 Making erection sequence in execution and work in close coordination with other agencies at site.

10.5.1 Erection of fabricated items shall be carried out including lifting, placing in position, jointing, aligning and painting
as specified in the Bills of materials.

10.5.2 All welding with electrodes shall be in accordance with IS 814 / AWS E 6013 for thickness up to 20 mm and
AWS E 7018 for thickness above 20 mm and as approved. Welding and cutting is not allowed at site. All operations
namely welding, cutting etc. are to be done at the factory. Machine welding has to be done. Anti-corrosive treatment
to all steel components of structure with specialized painting for all steel works should be carried out at the factory
including preparation of surface confirming to IS specifications, as specified in the bills of materials. Samples and
mock-ups for painting work are required to be planned and submitted to Owner / Architect approval before
commencement of respective layers of work, to

meet the agreed schedule. Testing equipment, calibrated in approved Institution shall be made available at site for
in-situ measurement of coating thicknesses anti-corrosive treatment to all steel components of structure with
specialized painting for all steel works should be carried out including preparation of surface confirming to IS
specifications, as specified in the bills of materials.

10.5.3 Mobilize and use sufficient number of cranes of different capacities for material handling and leading, separate
mobile crawler / wheel mounted crane with telescopic boom etc., as appropriate for erection of steel works at all
levels and various locations. Crane and lifting schedule and holding in safe position of members under erection shall
be got approved by authorized representative prior to commencement of erection. No crane support shall be released
until it is absolutely safe and no part of the structure shall be subjected to any undue forces or stresses other than the
theoretical and anticipated norms. All the crane and lifting arrangements should be approved by relevant authorities
or a chartered engineer, documents to substantiate the same needs to be submitted, as a part of planning to meet the
agreed schedule. No unsafe practices shall be followed and it is the Contractor’s prime responsibility to adhere to all
safe erection procedures. The crane operator needs to have relevant approved authority license. All cranes and
lifting machineries need to be tyre mounted to avoid damage to the sub-base. Any damage to the sub-base needs to
be rectified by the PEB contractor with no extra cost.

10.5.4 All materials supplied shall be free from manufacturing defects and defective workmanship and guaranteed. Any
defects noticed shall be made good, at no extra cost and within stipulated time schedule. All erected members shall
not, under service conditions, deflect, deform or distort more than the allowed tolerances as per IS 12843/ AWS
D1.1 & MBMA for erection of structural steel work and approved design. Maintaining visual accuracy in terms of
alignment, lines and levels are crucial and for this special care shall be taken by the Contractor at all stages of
fabrication, transport, storing and erection. Any objectionable member, not satisfying the above-mentioned
requirement shall be replaced at Contractor’s cost and risk without claim of extra time and cost.

10.5.5 Tests on materials shall conform to IS Specifications and the test shall be carried out as directed at any approved test
laboratory and documented to ensure the quality as well as the workmanship. No additional cost shall be paid on this
account. Apart from the above tests necessary Manufacturers certificate for all the materials to be given.

10.5.6 Workmanship and finish of the fabricated items should be as per approved GA drawings/specifications standards.

10.5.7 Painting shall be provided of approved brand as specified in the technical specifications. Primer should be suitable
to the paint being applied and to be as per the recommendations of Manufacturer of finish paint. Extra coat of
painting shall be given to obtain uniform and good finish and extra putty shall be applied to ensure uniform and
smooth finish, if directed, at no extra cost to the OWNER.

10.5.8 Providing relevant samples, catalogues, schematic drawings and test certificates along with the TENDER.

10.5.9 The successful Tenderer is required to depute to site a qualified Surveyor/Engineer with knowledge in electronic
survey instruments during the time of setting out of bolts centers in the foundation blocks. The Surveyor/Engineer of
the CONTRACTOR shall accurately survey and document the central line of bolts as well as levels and verticality
and shall sign the pour card. The responsibility for checking the accuracy and giving clearance for concreting rests
with the CONTRACTOR. The pour card shall be signed jointly by the Surveyor/Engineer of the CONTRACTOR
and the civil agency.
10.5.10 The entire process of erection shall be supervised on a full-time basis by the CONTRACTOR till the final grouting
is carried out and subsequently until The PEB structure is handed over to the satisfaction of the OWNER.

10.5.11 The CONTRACTOR shall position at site adequate technical site staff. The Organization Chart at head office and
site proposed by the CONTRACTOR shall be submitted along with the Tender. If the OWNER
/ ARCHITECT feels that the strength needs to be augmented in any particular area, the CONTRACTOR shall
depute technical staff of adequate qualification and experience to meet this requirement at no extra cost.

10.5.12 PEB erection progressive photographs with progress report on a fortnightly basis need to be submitted by the PEB
contractor for review by OWNER/ ARCHITECT.

10.5.13 Necessary Staircase with platform and hand railing for roof access shall be provided for erection works &
inspection.

10.5.14 If Bolt & nut is required, all structural element bolt shall have lock nut or double nuts or other equivalent materials.

10.5.15 Tenderers to quote for Gutter and down-take pipe system for rainfall intensity of 150 mm / hour is to be considered.
If any changes desired by Owner in size, location, additional pipe etc., it is to be accommodated within the quoted
rate by Tenderers.

10.5.16 The CONTRACTOR shall submit schedule of all activities and deliverables including designs, fabrication, supply
and erection along with the tender document.

10.5.17 To provide maintenance provision i.e. provision for tying the life line for future maintenance.

10.5.18 To provide maintenance guide lines and giving the demonstration to the maintenance people.

10.6 QUALITY TESTING PLAN:

10.6.1 FACTORY INSPECTION


Factory test certificates shall be furnished for all the lots of material required for the specific project before
shipment from the manufacturer. Independent testing in an client approved laboratory shall be carried out for the
mechanical properties verification by the vendor after procurement of the material, if requested by OWNER/
ARCHITECT.

10.6.2 RAW MATERIAL (STEEL PLATES AND SECTIONS):


The following tests shall be done for both raw material and critical consumables before proceeding with any
fabrication work as per applicable standards.
a) Visual Inspection
b) Dimensional Inspection
c) Universal Strength Test

10.6.3 WELDING PROCEDURE:


a) This shall apply for welding procedure specifications and the qualification of the welders. The vendor shall
take the approval of the welding procedure specifications before proceeding with any fabrication work, in
case it varies from the codal references as stated in the document.
b) All welding with electrodes shall be in accordance with IS 814 / AWS E 6013 for thickness up to 20 mm
and AWS E 7018 for thickness above 20 mm and as approved. Welding and cutting is not allowed at site.
All welding, cutting etc operations to be done at the factory. Machine welding has to be done.
10.6.4 FABRICATION OF BEAMS, RAFTERS:
This shall apply for checking of weld preparation of flange to web prior to full welding and dimensional check of
fit up components and holes marking etc.

10.6.5 NONDESTRUCTIVE TESTING FOR THE WELDING:

10.6.6 This shall apply for the welded joints which shall be minimum of 10% as specified by the OWNER. The reports are
to be furnished to ARCHITECT/ Engineer in charge.

10.6.7 SURFACE PREPARATION AND PAINTING:

10.6.8
a) This shall apply to the inspection of the surfaces before commencement of the priming of the members and
after completion of the painting such as inspection of DFT (Dry Film Thickness). This shall be minimum
10% of the area as specified by the OWNER. Test reports are to be furnished to ARCHITECT.
Painting to all steel components of structure for all steel works should be carried out including preparation
of surface confirming to IS specifications, as specified in the bills of materials. Samples and mock-ups are
required to be planned and submitted to OWNER. Architect approval before commencement of respective
layers of work, to meet the agreed schedule. Testing equipment, calibrated in approved Institution shall be
made available at site for in-situ measurement of coating thicknesses anti-corrosive treatment to all steel
components of structure with specialized painting for all steel works should be carried out including
preparation of surface confirming to IS specifications, as specified in the bills of materials. Low VOC
materials (Paints and Sealants) shall be used at this site.
10.7 INSPECTION SCHEDULE :

Traveling expenses of the OWNER / ARCHITECT/ Engineer in charge shall not be considered. The inspection will
be made after giving 7 (Seven) days prior notice to the vendor.
The vendor shall follow the following inspection schedule for carrying out the work.
a) At the time of testing of the welding
b) At the time of process of the painting
c) Before shipment

Anyhow, OWNER/ ARCHITECT reserves the right to inspect at the various stages of fabrication after giving
due intimation to the vendor.

10.7.1 PACKAGING AND SHIPPING INSPECTION:


This shall apply before commencement of the protective packaging and before shipment to the site.

10.7.2 SITE INSPECTION:


This shall apply to all the materials unloading at site to complete erection and handing over to the
OWNER.
Tests on materials shall conform to IS Specifications and the test shall be carried out as directed either at site
Laboratory or at any approved test laboratory and documented to ensure the quality as well as the workmanship. No
additional cost shall be paid on this account.

DAMAGE DURING TRANSIT:


While opening of the protective packaging, any damaged materials (found either visually or otherwise, during
transit or unloading) shall be replaced by the CONTRACTOR.

10.7.3 DAMAGE DURING ERECTION:


Any damage during erection (found either visually or otherwise) shall be replaced by the CONTRACTOR.

10.7.4 DELIVERIES AND VESTING:


a) The Contractor shall be responsible for the transport, unloading, checking and safe keeping of all materials,
goods, plant and equipment and other things to be incorporated into or used in connection with the Works
and shall place such things only in areas of the Site allocated for that purpose by the Owner.
b) In the absence of the Contractor the Owner may receive deliveries put the Contractor shall remain fully
responsible under the Contract as if received by him and shall reimburse the Owner any costs incurred by
the Owner. Property in all materials, goods, plant and equipment and other things delivered to the Site and
to be incorporated into the Works shall pass to the Owner on delivery and the Contractor shall ensure that
all his sub-contracts permit this. No materials, goods, plant and equipment or other things to be
incorporated into or used in connection with the Works shall be removed from the Site prior to the issue of
the Certificate or Final Acceptance without the written approval of the Owner.

10.7.5 WATER LEAKAGE TEST:


After completion of the execution of the roofing system, water leakage test shall be carried out as per the standards, and if
any leakage is found, same shall be rectified.

10.8 TEST CERTIFICATES:

a) CONTRACTOR is to provide manufacturer’s Test certificate and test certificate from an independent
laboratory guaranteeing bare galvalume of roof and color coating cladding sheets against fading, pitting,
cracking, peel off etc. Minimum 25 years guarantee to be provided by the CONTRACTOR for the color
coating of zincalume/galvalume sheets.
b) CONTRACTOR has to provide 25 years guarantee/warranty for structural stability, water tightness. The
entire structure shall be water tight and weather proof. It is the prime responsibility of the successful
tenderer to design, detail and execute the entire works including all components such as gutters, down take
pipes, flashings, trims etc. for ensuring total water tightness.
c) The tenderer shall also submit third party test certificate from a certified reputed testing institute for all
materials. The vendor shall indicate the name of the testing institute at the time of submitting the tender.
d) If any part of the building is defective, settlement, leakage, naturally damaged or other faults during the
entire guarantee period, the same will be rectified/ replaced at the contractor's own cost. No additional cost
will be paid by the owner for this.

10.8.1 THE WORK COMPLETION CERTIFICATE SHALL BE ISSUED BY THE OWNER WHEN THE WHOLE
OF THE WORKS:
a) Have been substantially passed and final test that may be prescribed by the contract or as directed by the
Consultant and owner.
b) Completed in such a condition so as to be put to its intended use.

c) And/or occupied without any short comings and no major or minor items of works are remaining which in
the opinion of the Owner will cause undue difficulties in satisfactory use/occupation of the works.
d) And the contractor has submitted the stability certificate for the works/system designed, engineered,
fabricated and erected by him.
e) Relevant test certificate as applicable.

10.9 DEFECTS LIABILITY:

Any defect, settlement, leakage or other faults which may appear within the “Defects Liability Period” arising in the
opinion of the Owner, due to design, materials or workmanship shall upon the direction in writing of the Owner, and
within such reasonable time as shall be specified therein, be amended and made good by the contractor without any
delay and at his own cost.

All such works shall be carried out by the Contractor at his own expense if the necessity thereof shall, in the opinion
of the Owner, be due to the fault in design by the Contractor, or due to supply and use of materials by the contractor
or due to workmanship of the contractor, or due to neglect of failure on the part of this contractor comply with any
obligation, expressed or implied, on the contractor’s part under the contract.

Stability of the Structure during erection is also the Contractor’s responsibility.


Even if the erection is done by a Contractor other than the PEB manufacturer, it is the responsibility of PEB
manufacturer to ensure proper erection.
If the contractor shall fail to do any such work as aforesaid required by the Owner, the Owner shall be entitled to
employ and pay other persons to carry out the same and if, in the opinion of the Owner the Contractor was liable to
do such work at his own expense under the Contract, then all expenses consequent thereon or incidental thereto shall
be recoverable from the contractor by the owner or may be deducted by the owner from any monies due or which
may become due to the contractor or from any amount retained by the owner from the contractor in the form of
retention security deposits etc. In the event of monies due to the contractor or which may become due to the
contractor or the amount retained by the owner becomes insufficient for the recovery or deductions as aforesaid, the
same shall be recovered or adjusted by the Owner by revoking the Bank Guarantee submitted by the contractor for
due performance of the contract or against his liability for defects in defects liability period. If such amount of
deduction or recovery exceeds the total sum available under all the above means for recovery or deductions by the
owner, then the contractor shall upon demand, pay to the owner the amount of such excess and it shall be deemed a
“debt due” by the contractor to the owner and shall be recovered accordingly.

In respect of all such recovery or deductions mentioned above, the decision of the Owner or the Consultant
appointed by the Owner shall be final and binding on the Contractor.
In these conditions the expression “Defects Liability Period” shall mean the 12 months calculated from the date
of completion of works certified by the consultant and Owner.

The contractor shall, if required by the Owner in writing, search under the directions of the owner for the cause of
any defect, imperfection or fault appearing during the “Defects Liability Period” or during the progress of the
works. If such defect, imperfection or fault be one for which the contractor is liable as aforesaid, the cost of the
work carried out in searching as aforesaid shall be borne by the contractor and he shall in such case repair, rectify
and make good such defect, imperfection or fault at his own expense.

10.9.1 On certification of virtual completion of the work, the Contractor shall obtain and submit a Bank Guarantee Bond
issued by a Nationalized Bank for an amount equivalent to 10% of the contract sum and valid for the entire defects
liability period against his performance under the above clause of “Defects Liability”. This bank guarantee bond
shall be as per the format approved by the Owner.

10.10 APPROVAL AND ACCEPTANCE:

e) Provisional Acceptance
f) The work shall be deemed to have been provisionally accepted after fulfillment of all of the following by
the contractor.

g) Submitting As-built drawings, Catalogues, Brochures, Data sheets, Manuals in the form as directed by the
Owner/Consultant.
h) Obtaining Certificate of virtual completion from the owner.
i) Certificate of Final Completion

The contract shall not be considered as completed until a Certificate of Final completion shall have been issued by
the Owner stating that the Works have been completed to their satisfaction and remedying / rectification of defects
have been satisfactorily performed.

The certificate for Final completion shall be given by the Consultant/ Owner within “Twenty-eight days after the
expiration of the Defects Liability Period.
And full effect shall be given to this clause notwithstanding any previous entry on the works or the taking
possession, working or using thereof or any part thereof by the Owner or the user.
PEB Supplier shall furnish Structural Stability Certificate for his part of work.

Provided always that the issue of the certificate of Final completion shall be a condition precedent to payment or
return to the contractor the security deposit or Bank Guarantee in accordance with the conditions set out in the
contract.

10.11 CLOSE OUT DOCUMENTATION:

a) As built drawing & design documents. (6 sets of hard copies along with soft copy)
b) Fabrication drawing (3 sets of hard copies along with soft copy)
c) Quality reports (3 sets of hard copies along with soft copy)
d) Inspection Records. (3 sets of hard copies along with soft copy)
e) Maintenance Manual (3 sets of hard copies along with soft copy)

10.12 LOAD DATA:

Structures shall be designed for structural stability and integrity to resist safely and effectively all loads and effects of load
combinations that may reasonably be expected during the lifetime of the structure.
The design loads used for the structures, buildings and foundations shall conform to the requirements of the governing codes
and specifications. As a minimum the design loads shall include dead load, super-imposed dead load, operating loads, live
load, wind load and seismic load. Where applicable, the design loads shall also include thermal load, anchor loads,
impact load, vibration load and surcharge loads.
The units to be used for design and drawings are SI units.

Section – 11B: TECHNICAL SPECIFICATIONS OF MATERIALS

11.1 PREAMBLE TO SPECIFICATIONS:

11.1.1 The conditions of contract and the drawings shall be read in conjunction with the specifications and matters referred
to, shown or described in one are not necessarily repeated in the other. These specifications are comprehensive and
may exceed the requirements of this project. Any ambiguity between the General Specifications, the Bill of
quantities and contract drawings, shall be referred to the Consultant/Supply and Erection Manager for clarification
before the date fixed for delivery of Tenders. Any ambiguity may be referred to the Architect/Supply and Erection
Manager after signing of the contract and Consultant shall give a ruling, which shall prevail. No claim for additional
cost due to above, however, will be entertained.

11.1.2 Notwithstanding the sub-division of the specifications into various headings, every part of it is to be deemed
supplementary to every other part and is to be read with it, so far as it may be practicable so to do, or when the
context so admits.

11.1.3 In this contract, reference is made to the Indian Standards and these references shall be deemed to include the latest
editions or issue of standards, specifications or By-Law including all revisions up to the date of invitation of
Tenders. The contractor shall ensure that all materials and workmanship as they apply to this contract shall comply
in every specifications or any other equivalent or specifications approved by OWNER/ ARCHITECT.

11.1.4 The Contractor shall keep at site, copies of all relevant standards and codes of practice referred in these
specifications throughout the period of contract. These shall be the latest editions and shall include all
revisions/addendums thereof.

11.1.5 List of Approved Manufacturers: Names of approved manufacturers are given in the specifications.

11.1.6 Reference in the specifications to approved manufacturers shall be construed as establishing a standard of quality
and not as limiting competition.

11.1.7 The Contractor shall include in his prices for supplying the item or materials from the approved manufacturers list
enclosed.

11.1.8 All items or materials shall be delivered to the site with the manufacturers brand and name clearly marked on.

11.1.9 All items or materials shall be assembled, mixed, fixed, applied or otherwise incorporated in the works in
accordance with the printed instructions of the manufacturer of the item or materials.

11.1.10 Contractor shall follow the check list for all the items.

11.2 PRIMARY MEMBERS:

11.2.1 Primary members fabricated from plates shall have flanges and webs joined on one side of the web by a continuous
welding process and shall conform to the physical specifications of ASTM A570 (Grade 50) / ASTM A572 or
equivalent IS standard having a minimum yield strength of 345 MPa.

11.2.2 Secondary members for Purlins and Girts shall conform to the physical specifications of ASTM A570 (Grade 50) or
equivalent IS Standards having a minimum yield strength of 345 MPa.

11.2.3 Rod bracing shall conform to the physical specifications of ASTM A36 or IS equivalent and having minimum yield
strength of 250 MPa.

11.2.4 All hot rolled sections shall conform to the physical specifications of ASTM A36 or equivalent IS, having minimum
yield strength of 250 MPa. All other miscellaneous secondary members shall have minimum yield strength of 250
MPa.

11.3 SECONDARY MEMBERS :

Secondary structural framing shall include the purlins & girts (Pregalvanized Z-type or C-type cold formed GI sections of
minimum 345 Mpa yield strength with minimum 275 GSM coating), eave struts, wind bracing, flange bracing, base angles,
clips and other miscellaneous structural parts. Suitable wind bracings sag rods to be reckoned while designing the structure.

11.4 CANOPIES:

The roof for canopy shall be of colour coated galvalume sheet same as the wall cladding sheet.
11.5 ROOF SHEETING:

11.5.1 Single skinned bare galvalume BHP or equivalent corrugated metal sheet for 0.47mm TCT AZ 150 Structural
standing seam roof panels shall be of a true standing seam configuration, requiring no end
closures.
11.5.2 Panel ends shall be sufficiently lapped located at supporting members, and sealed with butyl mastic.

11.5.3 Water test for roof leakage once all penetrations to roof are complete shall be done as pre standard manufacture’s
SOP. Roof Test Certificate for No Leakage and Roof Load Carrying capacity shall be provided.

11.6 WALL PANELS:


Wall panel sheets shall be colour coated profiled Galvalume metal sheet having minimum 0.50MM TCT and
having min. yield strength of 550 Mpa conforming to as per ASTM A792M/ AS1397 & AZ150.

11.7 INSULATION:

11.7.1 Providing 50mm thick Fibre glass wool insulation with 16 Kg/Cum density, supported with GI weld mesh as per
technical specifications (UP Twiga) mean temperature and one side laminated with reinforced aluminium foil
supported over purlins with 75x75x1.6mm GI weld mesh with mechanical fasteners/ GI lacing including necessary
facing/overlap to join rolls and 300 micron thick polythene sheet over the bear insulation to prevent water
condensate etc. Complete.
11.7.2 8/10/12/16 MM bubble Insulation with both side High resistance Aluminium Foils and GI wiremesh shall be
provided for roof and wall.

11.8 FIXING ARRANGEMENT FOR SERVICES:

11.8.1 Necessary fixing of supports from the primary members such as rafters will be indicated during the approval
of the drawings stage.
11.8.2 All purlin to have min. 12mm dia holes at 1.50M C/C
11.8.3 Fixing of the electrical/lightning conductors shall be made as per the drawing at the time of the fixing of the roof
sheet.

11.9 RIDGE VENT:


Ridge vent to be designed for ventilation arrangement by natural means to maintain 6 air changes/ hour. Ridge line
should be covered with a ridge cap.

11.10 FASTENERS:

11.10.1 Standard fasteners shall be metallic polyester coated, heat treated carbon steel conforming to AS 3566 class 3, hex
head, self-drilling screws, assembled with galvanized steel washers bonded with EPDM seals.

11.10.2 The wall fasteners cap shall match the color of the panels.

11.11 CONNECTIONS:

11.11.1 SITE CONNECTIONS:

a) All primary bolted connections shall be provided with galvanized high strength bolts, washers, nuts
conforming to specifications of grade 8.8 of IS 1367 or ASTM A325.
b) All secondary bolted connections shall be furnished with bolts, nuts, washers conforming to the
specifications of grade 4.6 of IS 1367 or ASTM-A307.

11.12 DECKING SHEET:


11.12.1 Galvanized Metal Deck sheet shall be of suitable thickness, in trapezoidal profile of suitable depth. The deck sheet
shall have yield strength of minimum 250 Mpa.

11.13 SEALER:
11.13.1 Sealer for side laps, end laps and windows shall be extruded elastomeric butyl rubber based sealant or equivalent.
The sealer shall be non-asphaltic, non-shrinking, nondrying, and nontoxic and shall have adhesion to metals, plastics
and painted surfaces.

11.14 FLASHING, TRIM AND CLOSURES:

11.14.1 Flashing and/or trim shall be furnished at the rake, corners, and eaves, framed openings, and wherever necessary to
provide weather tightness and finished appearance matching with wall finish or as approved by OWNER/
ARCHITECT/ Engineer in charge.
11.14.2 Color coated sheeting for flashing, metal closure, trim and other miscellaneous uses shall be of the same
specifications as the roof and wall covering material. Min. 100mm flashing is to be considered for the masonry wall
& sheet joint locations for the inside of all buildings with the flashing top matching the profile of the roof sheet.
11.14.3 Foam closures shall be used additionally to match the panel profile made up of polyurethane or similar material.

11.15 EAVE GUTTERS AND DOWN SPOUTS:

11.15.1 Gutters shall be made of min. 0.60 MM Thick GaIvalume sheet which shall be designed based on the rain water and
catchments area calculations and accordingly, the size and thickness shall be calculated by vendor. The outside face
of the gutters shall be supported with galvanized steel clamps suitably designed for fixing to the eave members.

11.16 RIDGE VENT:


Ridge vent to be made out of Colour Coated Galvalume Sheeting with insect mesh and standard fixing arrangement shall be
provided. Design of ventilation by natural means to maintain 6 air changes/hr.

11.17 LOUVERS:
11.17.1 Color coated galvalume sheet material fixed S/Z type louvers are to be provided as per the locations shown in
the drawing.
Design of ventilation by natural means to maintain 6 air changes/hr.

11.19 STAIR CASES:

11.19.1 All Staircases shall be as per drawing with kick plates for all landings and having no gaps in between risers &
treads.
11.19.2 Internal staircases for access to the mezzanine shall be 1500mm clear width and shall have 1150mm high MS
railings on either side. (Ref. dwgs)
11.19.3 External staircases for fire exits from the building floor level (+1.20m) to the adjacent external road levels (+/- 0.00
or lower as the case may be).
11.19.4 All railings shall have kick plates flush with the landing floor/base.

Section – 14: SPECIAL CONDITIONS OF CONTRACT

a. GENERAL

i. Special Conditions of Contract shall be read in conjunction with the General Conditions of
Contract, Specifications of work, drawings and any other documents forming part of this
contract wherever the context so requires.

ii. Notwithstanding the sub divisions of the document into these separate sections and volumes
every part of each shall be deemed to be supplementary to and complementary of every other
part and shall be read with and into the contract so far as it may be practicable to do so.

iii. Where any portion of the Special Conditions of Contract is repugnant to or at variance with
any provisions of the General Conditions of Contract then unless a different intention appears,
the provision of the Special Conditions of Contract shall be deemed to override the provisions
of the General Conditions of Contract only to the extent such repugnance or variations in the
Special Conditions of Contract as are not possible of being reconciled with the provisions of
General Conditions of Contract.

iv. The materials, design and workmanship shall satisfy the applicable standards, specifications
contained herein and Codes referred to. Where the Technical Specifications stipulate
requirements in addition to those contained in the Standard Codes and Specifications, those
additional requirements shall also be satisfied.

Wherever it is mentioned in the specifications that the Contractor shall perform certain work or provide certain
facilities, it is understood that the Contractor shall do so at his own cost and the Contract Price shall be deemed
to have included the cost of such performances and provisions, so mentioned.

b. RESPONSIBILITIES OF CONTRACTOR

i. It shall be the responsibility of the Contractor to obtain the approval for any revision and/or
modifications decided by the Contractor from the Engineer-in-charge/OWNER before
implementation. Also, such revisions and/or modifications if accepted/approved by the
Engineer-in-charge/OWNER and duly certified by the Architect shall be carried out at no
extra cost.

ii. All expenses towards mobilization at site and demobilization including bringing in
equipment, work force, materials, dismantling the equipment, clearing the site etc. shall be
deemed to the included in the prices quoted and no separate payments on account of such
expenses shall be entertained.

iii. The Contractor shall acquaint himself with access availability, facilities such as local labour
etc. to provide suitable allowances in his quotation.

iv. The procurement and supply in sequence and at the appropriate time of all materials and
consumable shall be entirely the Contractor's responsibility and his rates for execution of
work shall be inclusive of supply of all these items.

c. COMMUNICATION FACILITIES: The Contractor shall arrange to provide proper communication


facilities at his site office, including telephone, Internet and fax machine. The Contractor’s project
manager shall further be provided with a cellular phone which shall be kept switched on at all
reasonable hours of the day and at all times while the work is in progress at site.

d. PROTECTION TO THE COMPLETED WORKS: The Contractor shall be solely responsible for
the protection of completed works (either completed by the Contractor himself or by others) from any
damage or stain caused by his work. Any cost incurred for the repair / replacement of works due to
damage caused by the Contractor shall be debited from his payments under the sole discretion of
Engineer-in-charge/owner. Such decision of the Engineer-in-charge/owner shall be final and binding
on the Contractor.
e. PROJECT REVIEW MEETING:

i. Level of Participation: Contractor (or the person who has signed the tender documents on
behalf of the Contractor), Contractor's Site in charge (i.e. Project Manager) and the Site
Engineers (i.e. the persons looking after the day to day works) the Engineer-in-charge/owner
and the ARCHITECT.
ii. At the time of Fortnightly review the Architect or his representative shall inspect all the
work done since last review, shall rectify the work done by the contractor and shall identify
need of correction, repair or rework. The contactor shall be responsible to get the correction,
repair or rework on his own cost with in stipulated time.
iii. MOM of review meeting shall be signed by all participant and a copy be retained by all.

f. PROGRESS REPORTS:
The Contractor shall submit a weekly progress report including the following information:
a) Activities executed/achievements during the week.
b) Scheduled v/s Actual percentage progress and progress curves for sub-ordering, manufacturing / delivery,
sub-contracting, Supply and Erection and overall and quantum wise status of purchase orders against
scheduled.
c) Gap Analysis for the variations / Areas of concern / problem / hold ups, impact and Action plan.
d) Resource deployment status.
e) The Contractor shall submit every day a report containing details of labour and equipment deployed at
the works along with the progress of work done on the previous day in the proforma prescribed by the
Engineer-in-charge/owner.
f) Quality Assurance System Plans / procedures of the Contractor shall be furnished in the form of a QA
manual. This document shall cover details of the personnel responsible for the Quality assurance, plans or
procedures to be followed for quality control in respect of Design, Engineering, Procurement, Supply,
Installation, Testing and Commissioning. The quality assurance system shall indicate organizational
approach for quality control and quality assurance of the Supply and Erection activities, at all stages of
work at site as well as manufacturer's works and dispatch of materials.
g) The Owner or their representative reserve the right to inspect / witness, review any or all stages of work at
shop / site as deemed necessary for quality assurance.

g. FACILITIES TO CONTRACTOR:

i. Owner will give WATER SUPPLY at one point OF SITE.


ii. The Contractor shall provide at his own cost all necessary ferrules, pipes, fittings, couplings
and tanks and temporary works required and he shall maintain all such works in satisfactory
condition. The Contractor has to ensure that there is no wastage of water. On completion of
the work the Contractor shall remove all such works and shall reinstate and make good, any
work disturbed, to the satisfaction of the Engineer-in-charge/owner.
iii. Owner will give power supply at one point as temporary connection given by government
authority rest distribution and bill payment is contractor's responsibility. If any D.G power is
required that also will be arranged by contractor at his own cost. Owner has right to use
reasonable power for erection of plant.
iv. The Owner shall at his discretion and for the duration of the execution of the work may
provide land for Supply and Erection of Contractor's field office, go-downs, workshops and
assembly yard required for the execution of the work under this

contract nearer to the site. The Contractor shall at his own cost construct all temporary
buildings structures and provide suitable water supply and sanitary arrangement as approved
by the Engineer-in-charge/owner, and other inspectorates.
v. 7.9.2 On completion of the works undertaken by the Contractor, he shall remove all
temporary works erected by him and have the site cleared as directed by Engineer- in-
charge/owner. If the Contractor fails to comply with these requirements, the Engineer-in-
charge/owner has the right to remove any structure, such surplus, rubbish materials and
dispose off the same as he deems fit and get the site cleared and the Contractor shall forthwith
pay the amount of all expenses so incurred and shall have no claim in respect of any such
surplus materials disposed as aforesaid.

Note – 1: Basis of Prices & Method of Measurement:

NOTE: The Tenderer has to design the PEBs based on the Technical Specifications
and verify the quantities. A separate priced BOQ with Tenderer’s quantities is to be
submitted with an Optional price for All around Facia (as per drawing) for the
buildings.

i. This is a Unit rate fixed price contract, subject to a ceiling.

ii. Quantity of steel work in primary, secondary, bracings and HD bolts etc. are to be indicated along
with unit rate.

iii. Along with the bills, quantity delivered must be submitted.

Note – 2: Prices should be quoted for the complete scope of work described in drawings, specifications and the
