CONFIDENTIAL INVESTIGATION REPORT Case No.: 2018008601 In re: Nate Smith I, EXECUTIVE SUMMARY This confidential investigation report addresses possible violations of the Code for the U.S. Olympic and Paralympic Movement (“the Code”)! and is issued pursuant to the U.S. Center for SafeSport’s administrative authority under the bylaws of the United States Olympic Committee, section 8.7(1). A. Scope of Investigation ‘The Center's process is an administrative one and addresses the limited question of whether an individual violated policy, as defined by the Code. Sanctions, if any, are likewise limited to determining the effect of any policy violation on an individual’s opportunity to participate. B. Allegations The initial allegations received by the Center indicated Respondent had “a long pattern of inappropriate relationships with young girls, ages 14-17, and of sexual, emotional and physical abuse.” See App. D, Ex. 1. Throughout the course of this investigation, it was further alleged that Respondent: Invited a minor-athlete (Claimant [EBD (0 his hotel room, unaccompanied, in/around Melbourne, Australia, and therein gave her a back massage and received same, on/about 2013; b. Had intimate and sexual relations, to include sexual intercourse, with Claimant HEE 2 inor athlete, on multiple occasions in Florida, on/about 2013; c. Engaged in inappropriate social media contact with a minor-athlete, Claimant on or about 2010-2012; d. Engaged in physical and emotional abuse directed towards adult-athlete, Claimant = ‘on numerous occasions in 2012 and 2013, which was alleged to have occurred in the States of Georgia and Colorado, as well as the country of Australia; and C. Findings This investigation found, by a preponderance of the evidence, that Respondent did engage in the alleged behavior. » For the purpose of the review of policy, the Code effective at the time of report and/or time of alleged offense is applied. That Code that was effective at the time of report was in effect March 21, 2018 through April 14, 2019. ‘This investigation report is issued under the procedures in effect at the time of issuance. ‘The Code in effect at the time of issuance went into effective April 15,2019.
