PLEA AND SENTENCING AGREEMENT

This Plea and Sentencing agreement is entered into between the defendant, CATHERINE
• CAPOZZI, who is represented by Assistant Public Defender Regan Woodbury, and Katherine Fernandez
Rundle, State Attorney for Miami-Dade County Florida, by and through Assistant State Attorney
Jonathan Borst. The State of Florida, by and through the undersigned Assistant State Attorney, and the
defendant, hereby agree to the following:

1. The defendant shall plead guilty to Counts 1-4 of the Information — DUI Manslaughter,
Vehicular Homicide, DUI Causing Serious Bodily Injury, and Reckless Driving Causing Serious
Bodily Injury.

2. The defendant's plea of guilty shall be irrevocable and may not be withdrawn. The defendant
shall enter a plea of guilty because she is in fact guilty of these offenses.

3. The Court shall accept the defendant's guilty plea and enter an adjudication of guilt as to all
counts.

4. The Defendant shall be sentenced as follows:


As to Count 1, DUI Manslaughter, the defendant shall be sentenced to fifteen (15) years
in state prison.
As to Count 3, DUI Causing Serious Bodily Injury, the defendant shall be sentenced to
five (5) years in state prison. This sentence shall run concurrent with the prison sentence in
Count 1.

As to Count 2, Vehicular Homicide, the defendant shall be sentenced to two (2) years of
community control, followed by five (5) years' of reporting probation.
As to Count 4, Reckless Driving Causing Serious Bodily Injury, the defendant shall be
sentenced to two (2) years of community control, followed by three (3) years of reporting
probation.
The community control and probation sentence set forth for Counts 2 and 4 shall run
consecutive to the prison sentence set forth in Counts 1 and 3.

5. The special conditions of the defendant's community control and probation are as follows:
a. The defendant must enroll in and successfully complete a statutorily mandated
DUI school.
b. The defendant must attend a Victim Impact Panel.
c. The defendant shall not drive, operate, or be in actual physical control of a motor vehicle
or vessel.
d. Upon appropriate placement after release from prison, the defendant shall reside at an
inpatient facility to receive substance abuse treatment as recommended.

The defendant's driver's license shall be permanently •revoked as a consequence of her plea.

8. The defendant shall pay a fine of $500 to be collected by the Clerk of Courts.

9. By entering into this Plea and Sentencing Agreement, the defendant affirmatively represents that
she is fully satisfied with the services provided by her attorney. The defendant also affirms that
her attorney discussed the case with her fully and completely, and that she has understood all
communications with her attorney. She acknowledges that no further investigation of this case
will be conducted, including but not limited to taking additional depositions or. seeking
independent tests of the blood samples collected in this case. The defendant also acknowledges
that by entering into this plea agreement, she waives or gives up the right to challenge the
admissibility of any evidence collected in this case, including, but not limited to, the blood
laboratory testing conducted in this case, and the statements made by the defendant in this case.

10. The defendant verifies that all of the agreements between the State and the defendant are
contained within this contract. There are no other agreements between the State and defendant in
this case. The defendant understands that if she violates the probationary terms of this plea
agreement, she may be sentenced to up to twenty (20) additional years in state prison.
