Dear Col. Calulot:

I write in behalf of my client, Mylene C. Cabagtong, of Brgy. Catorse De Agosto,


Gandara, Samar, regarding her request for support or share of the retirement benefits and
all other separation benefits of her husband, Tsg David Crebello Cabagtong.

While my client, on 22 July 2020, is in receipt of your letter dated 21 April 2020 it is
nevertheless hereto attached a copy of her complaint-affidavit and investigation form
both dated 15 July 2020 against her husband filed before the Office of the Provincial
Prosecutor, Catbalogan City, for violation of section 5, par. (e)(2) of Republic Act No.
9262. She is confident that in due time the case will be filed in court and an order for
such relief shall be soonest issued.

In view of the foregoing, social and compassionate justice will be served if the release of
said benefits due to my client’s husband be deferred meantime pending the presentation
of the corresponding court order to your good office, or unless said husband voluntarily
provide my client and her children a reasonable and regular support out of said benefits,
among others.
