I, JUAN DELA CRUZ, of legal age, single and currently residing at #123 Paco, City of Manila, after
having been duly sworn in accordance with law, do hereby depose and state that:
PRELIMINARY STATEMENT
That the person examining me is ATTY. MAK ASANDAL with law office address at #456 Paco, City of
Manila. My JUDICIAL AFFIDAVIT is being taken at the above – mentioned place in the presence of ABC and my
companions.
That I am answering the questions fully conscious and that I do so under oath and may face criminal
liability for false testimony.
QUESTIONS AND ANSWERS
QUESTION 1: Please state your name and other personal circumstances
ANSWER 1: I am JUAN DELA CRUZ, of legal age, single and currently residing at #123 Paco, City of Manila.
QUESTION 2: Why are you executing this Judicial Affidavit?
ANSWER 2: I am executing this Judicial Affidavit to support my defense in the criminal case of Estafa filed against
me.
QUESTION 3: Why were you charged with Estafa?
ANSWER 3: I was charged with because I issued a check in favour of Pedro Pinduko which were dishonoured for
insufficiency of funds.
QUESTION 4: In answer to QUESTION 2, you mentioned that you are executing this Judicial Affidavit to support
your defenses in the criminal case of estafa filed against you. Why do you believed you are not guilty?
ANSWER 4: I am not guilty because of the following reasons:
i. The check was issued only as a form of security;
ii. Even if issued as payment, it was for a pre – existing debt; and
iii. It was only upon the insistence of Pedro Pinduko that I issued the check.
