When the organization has an accident there is often an injury. The legal reasons for managing workplace health and
safety relates to the framework of laws that govern the conduct of business and organization.

Specifically, article 10 of R164 puts the following obligations on the employer some were breached causing a work-
related injury:

The Employer did not provide safe workplace by existence of the pneumatic wrench in the workplace that poses risk
on the tyre fitter causing him to be tripped. He provided the appropriate training for workers who demonstrate

ISO 45001 can be used by the organization as a proof of a robust OHSMS as the certification based on the PDCA
(plan, do, check, act) management cycle which can help the organization in achieving various goals in OH&S.

As in the scenario the leadership and worker participation was clearly noticed by being aware about that there are
frequent near misses between FLTs and workers, and collisions with products causing damage and spillages also they
stated that There are no written records of any of these but the top management also must be personally involved in
driving and promoting the safe working environment, as in the scenario the top management showed lack of
participation as workers stated that the top management are rarely visit the warehouses also they don’t care about
workers complains as there were no written records of any complaints also the top management showed a huge lack
of leadership by refusing to provide enough money for safety countermeasures and enhancing the working
environment. And by applying ISO 45001 the leadership and participation of the top management can be enhanced.

A miss planning was noticed because in the working sites it requires that an ongoing planning process forms a part of
OHSMS so that hazards, risks, and opportunities for improvement can be achieved as in the scenario the top
management showed a huge lack of responsibility towards opportunities for improvement.

Also, there was a problem in planning the emergency situations because after the accident occurrence no
emergency precautions were done after talking to the workers (ex: first aiders), also a lack of hazard identification
and risk assessment were noticed which is clearly shown by having goods stacked in the aisles and blocking the
designed walkways also stepping in the vehicle routes by workers show hazard of interference between vehicles and
pedestrians. Hazards identification and risk assessment will help avoid such hazards or at least mitigate the severity.

As in the scenario the management showed irresponsibility with the operation clause of ISO 45001 by eliminating
the hazards and reducing the risks by having no safety representative worker also a number of violations were
noticed in sites without any action (ex: storing spare parts in walking aisles).

As a performance evaluation it requires a systematic internal monitoring and reviewing of OHS performance which
will help in return of achieving the concept of continual improvement, but it was clearly not achieved due to lack of
top management commitment towards monitoring and reviewing process.

Also, one of the financial benefits of applying ISO 45001 is to avoid any future claims for compensations as in the
scenario the injured worker issued a claim for financial compensation.

Applying the ISO 45001 will help in detecting the competency of all concerned parties all over the working sites (ex:

causes. In case any future accident might happen, what we shall do.
3. To avoid recurrence, any organisation where any accident/ fatality happens, it means there are
around 50 near mises happening and without any action being taken. So, any organization having

Management is not committed to controlling accident rates because 2 accidents occur, and injuries and near-miss
are occurring very frequently.
Because of the earlier accident, high compensation was claimed by the injured worker but there is no improvement
shown by the management.
Because of the frequent accident, medical costs and subsequent investigations incur greater costs to the company.
The removal company didn’t concern about workers' health and safety so the legal authority gives improvement
notice to the company, if more accident occurs in the future there may be a prohibition and high penalty issue to the
company.
Management didn’t have a proper safety system of work and risk assessment as it was not reviewing for the last
five years.
After the near-miss in the company management did not appoint competent people to do their job because there
are many young and inexperienced porters are present in the company.
