AFFIDAVIT OF WITNESS OF THE COMPLAINANT
I, Maria Carla Delfin, 22 years old, single, resident of Sitio Bliss,
Brgy Calumpang Naval, Biliran, after having sworn in accordance
with law, do hereby depose that:
1. I was present and personally saw that accused John
Castro, committed the crime murder against the victim, Rogelio
Marquez.
2. On 26th of October 2021, we were on the farm of Uncle
Rogelio together with John Castro because he was invited to come
over the place for Uncle Rogelio’s birthday celebration. John
Castro was having his work, cutting the mango trees but he was
invited by Uncle Rogelio to come over and he joined. They were
talking nicely but hours had passed their voices became louder and
seems like they were shouting at each other. Later on, they
separate ways, uncle Rogelio went to his room and John went
home.
3. Later on, John Castro came again bringing with him his
chainsaw and entered the room of Uncle Rogelio.
4. I heard he turned on his chainsaw and not knowing he cut
the body of uncle Rogelio. He cut the body of uncle Rogelio while
sleeping. I can still remember that I shouted at him and he
immediately ran out of the room with his chainsaw.
5. I was scared and trauma. I quickly called police authorities
to ask for help, I told them the exact location and other details that I
witnessed.
I executed this affidavit to attest the truthfulness of the foregoing
facts and to support the filing of criminal case against John Castro
for violation of Section6, Article 248 of Revised Penal Code,
murder and Section 5e of RA 9175.
IN WITNESS HEREOF, I hereby affixed my signature this 1st day of

AFFIDAVIT OF WITNESS OF THE ACCUSED
I, John Castro, Filipino Citizen, of legal age, married and residing
in Calumpang Bliss Naval Biliran, after having been duly sworn to
accordingly to law, hereby depose and state that:
1. I am the same person who is charged with the crime of
Murder and illegal use of chainsaw pending before the Office of the
Provincial Prosecutor of Biliran, Province.
2. I am the owner of the chainsaw, used it legally and never
used it in illegal, especially in killing a person.
3. On 26th of October 2021, that I was in Rogelio’s farm and
yes we talk, laugh and joke with each other and no other than that.
4. Paragraph 3 is denied. After celebration, I went home
immediately when Rogelio took a sleep and I never came back.
5. Paragraph 4 is denied. Around the time the crime
occurred; I was at home talking with my wife and children, they can
prove it. I do not use my chainsaw after doing my work, I keep it for
safety purposes.
6. I deny all the allegations in the affidavit, all are false and it
is physically impossible for me to commit the crime charged against
me because I was already at home when crime happened.
7. This counter-affidavit is being executed to attest to the
truthfulness of all the foregoing facts and events and to disclaim all
the accusations against me.
