Question 1
a) On 25 May 2019, Afida offered to sell her diamond ring to Husna and Zohra for RM 45,000.00.
The offer was valid until 3 June 2019 and whoever accepted the offer first would get the ring.
Husna sent a text message to Afida on 29 May 2019 accepting to buy the ring at the price RM
40,000.00. Afida read the text message but did not reply. Zohra phoned Afida on 1 June 2019
and agreed to buy the ring for RM 45,000.00. Afida then sold the ring to Zohra. When Husna
heard about this, she threatened to sue Afida for breach of contract.
Advise Afida.

b) Aima offered to sell her authentic Coach handbag to Sara for RM2,000 via an email. In her reply,
Sara suggested a new sum of RM 1, 500 for the handbag. Aima did not respond to Sara. Five days
later, Sara changed her mind and agreed to the original price. Aima refused to sell the handbag
but Sara claimed a contract had already come into existence.

c) Siti Molek, a 17 year old student, ordered a Honda CT car from DK Bhd for the price of
RM99,000. She agreed to pay a down payment of RM15,000 before delivery but failed to pay it.
DK Bhd wants to take action against Siti Molek.

Question 2
a) Hadi booked a house from Along Holding Sdn Bhd at a price of RM240,000. Two weeks after the
payment of the booking fees, Along Holding Sdn Bhd asked Hadi to pay an extra sum of
RM50,000 which increased the total purchase price of the house to RM290,000. Hadi refused to
pay and Alang Holding Sdn Bhd threatened to cancel his booking for the said house.

b) Haikal promised to take his wife Nazirah to Dubai for their Wedding anniversary. Haikal later
changed his mind and decided to celebrate their wedding anniversary at a hotel in Kuala Lumpur.
Nazirah who was looking forward to the trip, is very disappointed and threatened to sue Haikal
for breaking his promise.
Advice Nazirah on whether she can do so. (10 marks)
c) Lela had lost her son, Amirul. She advertised in the local newspaper that whoever finds Amirul
and return him to Lela, she would give that person RM10,000 as a reward. Three days later,
Amirul was found by Daniel who returned him to Lela. Daniel had read the newspaper and seen
the advertisement.
Advise Daniel whether he is entitled to the reward. (10 marks)
