commissioning of pump -- complete in all respect as per instructions of

Scope of work also includes complete alignment of pump assembly and

TAXATION
i.,,Vendors are required to clearly read & understand tax clauses
enforced by Govt of Pakistan / Provincial Revenue Board and quote
accordingly. In case of any tax exemption / exception claimed by the
bidder, the bidder has to provide documentary evidence i.e.

workers and shall hold the PSO indemnified and harmless against any
claims that may be made against the PSO. PSO does not take any
responsibility whatsoever regarding taxes under Income Tax laws or any
other applicability of taxes, levies imposed by Federal / Provincial /
Local Govt on the bidder or his staff if it is obligatory under the
provisions of any applicable law. Deduction of Income Tax and all other
taxes as mentioned above at source shall be made by the PSO.
vii. Bids shall be commercially evaluated without applicable taxes
(Provincial Services Sales Tax / GST), whereby corresponding net amount
(exclusive of taxes) quoted for works, goods and services will only be
considered for commercial evaluation purpose and determined for the most
advantageous bidder accordingly. To further clarify Services tax, any
tax that cannot be claimed by PSO being input of the amount of
Provincial / Federal Service tax under relevant section of tax Act shall
be inclusive and chargeable to the bidder account. Therefore while
evaluating bids, amount % of service sales tax will be calculated
including taxes which are non-recoverable to PSO.
viii. Notwithstanding anything contained in any law for the time being
in force, the Contractor/Supplier shall be solely responsible to pay all
taxes, duties, charges, stamp duty, fees and levies whether payable
before or after the execution of this Service Order to Federal,
Provincial, or local Government or any other authority established under
the law for the time being in force.
ix. The successful bidder shall be responsible to pay the stamp duty
before execution of this Service Order as per applicable rates of the
Stamp Act, as amended from time to time.
x. The successful bidder shall collect the Purchase Order (unsigned)
from P&S department PSO within 10 days of the issuance of letter

stamped, the bidder would execute the same and would return the signed
Purchase Order to PSO for execution on its part.
xii. PSO would execute the Service Order and deliver a copy of the same
to the Contractor/supplier.
xiii. The Contractor/Supplier hereby represents that he has paid the
requisite amount of stamp duty to the concerned revenue authority on
this Purchase Order. The Contractor/Supplier shall indemnify and hold
PSO and its officials harmless against any and all claims raised by the
concerned revenue authority or any other authority, established under
the law for the time being in force, in respect of any deficiency or
non-payment of stamp duty or penalty on this Purchase Order.

SPECIAL TERMS AND CONDITIONS:

b),,Quoted rates to be protected by pasting a transparent scotch tape
without blanco, cutting & over writing.
c),, Rates must be quoted against each & every line item mentioned
in RFQ.
d),,The bidder must submit the complete set of duly signed and stamped
tender document , RFQ, Drawing, Compliance Sheet, Vendor Data Form, HSE

However, where necessary bid may be elaborated on the letter head but
the cumulative and consolidated bid amount be quoted on the RFQ with the

f),,Any other terms and conditions given by the bidder will not be
acceptable to PSO and offers consisting separate terms assigned by the
tenderers shall not be considered part of the bid, as only agreeing RFQ
terms & conditions brings the vendors on a competitive bidding
platform for evaluation.

2.,,As the quantities may vary (increase or decrease according to the

job requirements), therefore, payment will be made as per actual
quantity of work done.

3.,,PSO may reduce /increase/modify quantities after bid opening as deem

necessary according to specific requirements or due to budgetary
constraints.

Location Engineer / Incharge.

5.,,Quality is the prime concern of PSO, no compromise shall be made in

Money:
a),,PSO may take action that may include but not limited to restriction
on participation in the procurement process, cancelation of Work
Order/Service Order/Purchase Order or Letter of Intent or forfeiture of
the earnest money/performance guarantee/security against the
bidder/supplier/contractor on the following grounds:

-Unsatisfactory general conduct;

-Misrepresentation of facts in bid documents;
-Refusal to replace defective material.
-Failure to meet delivery schedule without giving any satisfactory
justification resulting in loss to the Company or having adverse effect
on operations of the Company;
-Violating the terms and conditions of the Purchase/service Order;
-Refusal or deny accepting WO/SO/PO/LOI issued by the Company.

to be indulged in corrupt or fraudulent practices or on consistent

19 of the Public Procurement Rules, 2004, such action shall be posted on
PSO's website and also communicated to the Public Procurement Regulatory
Authority. The bidder/supplier/contractor shall not be eligible for
contracts/participating in PSO's procurement proceedings in accordance
with the Order passed in pursuance of the matter.

22.,,PSO reserve the right that at any stage of the procurement

proceedings, having credible reasons for or prima facie evidence of any
defect in supplier's or contractor's capacities, it may require the
suppliers or contractors to provide information concerning their
professional, technical, financial, legal or managerial competence. In
the event the contractor fails to furnish the requisite information, he
shall not be considered further for procurement proceedings.

23.,,PSO shall disqualify a supplier or contractor if it finds, at any

time, that the information submitted by him concerning his qualification
as supplier or contractor was false and materially inaccurate or
incomplete.

24.,,The Contractor at all times should indemnify PSO against all

claims, damages or compensation under the provisions of Payment of
Minimum Wages Announced by the Provincial/Federal Government during the
whole life cycle of the contract ; the Workmen Compensation; Industrial
Disputes, or any modification thereof or any other law relating thereto
and rules made hereunder from time to time. PSO will not own any
responsibility in this regard. Hence all liabilities shall be incurred
by the service provider without affecting the quality and quantity of

contract, the Performance Security Deposit of the Contractor will be
liable to be forfeited by PSO besides annulment of the contract.

EVALUATION OF BIDS
a),,Bids shall be evaluated according to appended criteria (if any) and
contract will be awarded to the most advantageous bids

item wise or on total value of the bid and award of the contract shall
be according to the suitability of the job and its commercial cost.

PAYMENT OF BILLS:
1. Payment against the Job(s) will be made against the vendor invoices
after completion of work and passing quality /quantity of goods /works
and services including all verifications /inspections by the PSO
designated official in-charge within 30 days.
2. Part payment against partial completion of work is allowed after
passing quality /quantity of goods /works and services including all
verifications

PENALTY :
In the event of Contractor's/Supplier failure to deliver the
Services/Goods within the time mention in purchase order/service order,
in that event PSO shall be entitled to deduct from his bills
/outstanding payments or other works done by him for PSO or from any
amount due to him by PSO a sum of Rs.0.1% of Purchase Order/Service
Order value per day as liquidated damages for the period which the said
services/material remains incomplete or fails to pass the quality tests
subject to a maximum 10% of work order amount to be recovered from the
contractor on his default.
Note: Penalty/ liquidity damages may be waived in case of force majeure
situation provided the contractor will be required to furnish
documentary proof.

taxes, this would amount to a total of 10% SD.
2. The above security deposit shall be liable to be forfeited by PSO for
any or all of the reason/s stated below.
a) If during the validity of this contract, the Contractor fails to
honor his commitments.
b) If the Contractor's services are found to be unsatisfactory and if in
spite of a written warning the contractor fails to improve the same.

c) To recover financial loss to PSO due to damage/loss/misappropriation
of Company's property while in Contractor's custody or due to
mishandling by Contractor or his men within Company's premises.
3. Incase, PSO's claim on account of loss / damage/ misappropriation /
mishandling or for whatever reason exceeds the amount of security
deposit, PSO will have a right to recover such amount from contractor's
bills due from the Company in respect of any contract services, or
supplies against which whatever order and for whatever location it may
be.
4. Supplier/ Contractor must apply for the refund of his security
deposit immediately after his final bill is cleared/ warranty period is
expired as the case may be. PSO shall not be responsible for the refund
of security deposit if no application is received within six (06)
months.

Bidding Procedure: Single Stage - One Envelope.

The bid shall comprise a single package containing two separate
envelopes. Each envelope shall contain separately the commercial
proposal and the technical proposal. The envelope shall be marked as
"COMMERCIAL PROPOSAL" and "TECHNICAL PROPOSAL" in bold and legible
letters to avoid confusion.

Each page of the Request for Quotation / price schedule and letter of
bid submission shall be signed & stamped by the bidding party.
