Exercise 2

1. What is the concept of modern penology? What is its importance in the treatment of an
offender?
- the concept of penology is to give change the attitude of the offenders, their way of life by not
giving them punishment instead they will be treated based on the treatment and rehabilitation
program implemented in the prison institution so that when they return to the mainstream in
community, they will now become a useful member of the society.

2. Discuss the difference between Carpeta from Prison Record.


- Carpeta refers to the institutional record of inmates which consists of Mittimus Commitment
order, Prosecutor’s information and the decision of the trial court including the Appellate court.
- Prison Record refers to information concerning an inmate’s personal circumstances, offense
committed, sentenced imposed, criminal case number in the trial, and appellate courts, the date
when the service of their sentenced commenced, the date when the inmate received Mittimus
commitment order for confinement; the place of confinement, the date of expiration of sentence,
the number of previous convictions, and the behavior or conduct while in prison.

3. What is the minimum qualification of the City Jail Warden?


- City Jail Warden/Wardress should have the rank of at least Jail Chief Inspector, should be a
college graduate who must have finished at least second year of Bachelor of Laws or at least
twenty-four units of Master’s Degree program in Management, Public Administration, Public
Safety, Criminology, Penology, Sociology, National Security Administration, Defense Studies or
other related disciplines from recognized institution of learning, should have satisfactorily
completed the mandatory training or career courses for such positions, including the Public
Safety Officer’s Basic Course and Public Safety Officer’s Advanced Course, should have been
previously assigned in a supervisory position in the jail service, and In the case of City Jails with
an inmate population of one thousand (1000) or more, the City Jail Warden should have the rank

2. Who are the Maximum Security risk offenders?


- this includes the highly dangerous or super security risk inmates as determined by the
classification board under the eight (8) categories; those sentenced to death, those whose
minimum sentenced is twenty years’ imprisonment, remand inmates or detainee whose sentence
is twenty years and above, those with pending cases, recidivists, habitual delinquents, and
escapees, those confined at the reception and diagnostic center, those under disciplinary
punishment or safe keeping, and those who are criminally insane or those with severe personality
or emotional disorders; that make them dangerous to fellow inmates or the prison staff.

CHAPTER IV
Exercise 5

1. Who are qualified to be a colonist?

CHAPTER V
Exercise 6

permit, wife or husband(marriage contract), child(birth certificate and the marriage certificate of

inmates), father/mother(birth certificate of the inmates), grand children birth certificate of the
grand child and of the letters of parents who maybe son or daughter of the inmates, and be
allowed by the Superintendent.

which he may have undergone preventive imprisonment and that the inmates refused to abide the
rules imposed upon the convicted inmates.

2. How does the compensation credit be availed by the inmates?

- Six (6) months after being permanently assigned to work in prison, an inmate received credits
at rates to be prescribed by the prison director, provided that inmate must maintain good conduct,
and must shows interest and a definite degree of progress in the particular work assigned to Him.

CHAPTER VII

- refers to the deduction of 1/5 of the period of the sentence of a prisoner who, having evaded the
service of his sentence during the calamity or catastrophe mentioned in Art. 158 of the Revised
Penal Code, gives himself up to the authorities within 48 hours following the issuance of the
proclamation by the President announcing the passing away of the calamity or catastrophe. (Art.
98, RPC)

- Yes. An inmate or detainee who wants to get married shall submit a written request thereof
with the Superintendent. Then the Penal Superintendent shall approve an inmate’s request to
marry except where legal restriction to the marriage exists, or where the propose marriage
present a threat to the security or good order of prison, or to the protection of the public.

CHAPTER IX
Exercise 10

- payment.

2. What is the procedure given to the infant born by the CIW inmate?

- that an infant is allowed to stay with the mother for a period of not exceeding one (1) year.
After the lapse of said period if the mother of the infant fails to place the child in a home of her
own, the Penal Superintendent shall make an arrangement to any authorized caring institution or
to the DSWD for the infant’s care. As far as practicable the CIW shall have a nursery staffed by
qualified personnel.

3. How is the disposition of cadaver of deceased inmate done?

-Unless claimed by his family the body of an inmate who dies in prison may be turned over to an
institution of learning or any scientific research center designated by the Secretary, for the
purpose of study and investigation, provided that such institution shall provide a decent burial of
the remains. Otherwise, the Bureau shall order the burial of the body of the inmate at government
expenses, granting permission to the members of the family and friends of the inmate to be
present thereat. If the body is claimed by the family, all expenses incident to the burial shall be at
the expenses of the family.

CHAPTER X
