APARTMENT CONTRACT
I, ____________________, with mailing address / place of business at _______________________________,
whose signature appears below, occupying apartment no. _______________________________________, owned
by Mr. & Mrs. ________________________, shall strictly comply with the following conditions:
1. Pay an advance monthly rental amounting to Nine _________________________________ (PHP _________).
The advance monthly rental shall be paid on the first Saturday of every current month. The lessee shall be
considered on default for failure to pay rental on due date.
2. A prompt payment discount of Five Hundred Pesos (Php 500.00) shall be given if rental for the month is paid
on or before the first Saturday of the current month.
3. A guarantee deposit of Nineteen _________________ (PHP ____________) without interest is required. The
amount is intended to cover any expenses to repair damages to the rented unit and/ or pay for unpaid utilities
should they vacate the rented premises any time in the future. . The whole guarantee deposit shall be forfeited
should the contract be pre-terminated. After the 1 year contract period and the lessee opt to vacate the
premises, the amount equivalent to PHP _____________ shall be allocated for the repairs and repainting of the
unit to bring it to its original state and condition. The balance of the guarantee deposit shall be allocated to
unpaid utility bills and any amount left shall be returned or reimbursed to the lessee. Deposit and advance
rental shall be paid fully to effect any turnover of apartment unit.
4. Vacate the premises after 5 days for failure to pay the rent from due date without the necessity of notice.
5. Return the premises in the same condition that it was originally occupied except for depreciation caused by
ordinary wear & tear.
6. Keep the premises in good order & condition in accordance with Health, Engineering and Police Regulations
and in such manner as not to be objectionable to the owner or to neighbors of the said property.
7. Minor repairs shall be undertaken by the owners but cost shall be for the account of the lessee;
8. Leave all improvements made on the premises for the benefit of the owners;
9. The lessee shall not assign, sub-lease or alter the premises in any way without the written consent of the
owners;
10. Be liable for all: Water, light, telephone and other bills for public services or utilities, as well as the expenses
necessary for the removal or repair of said utilities;
11. Allow the lessor or their agent or inspect the premises during the hours between 8:00AM and 5:00 PM and to
place herein “FOR RENT SIGN” in case the premises is to be vacated, or should the lessee fail to comply
with any of the stipulation herein;
12. Use only gas &/or electricity for cooking. Written consent from the lessor is needed for aircon installation;
13. The lessees are not allowed to assign other occupants other than the real tenants per this contract;
14. That the apartment shall be used EXCLUSIVELY AS RESIDENCE only and shall in no way be used as an
office, bodega, sari-sari store, carenderia, restaurant, billiard hall, internet café, gaming station, boarding house
or a place for any illegal activity;
15. That the lessor has the right to increase the rental at a reasonable rate.
16. That the lessee shall vacate the premises for the use of the OWNER or his immediate family;
17. The maximum allowable occupants shall not be more than five (5) persons
18. That the lessee shall notify the lessor in writing 30 days before vacating the premises and should litigation be
necessary for failure to comply with any of the conditions previously specified, the lessee shall pay the lessor
the amount of PHP 100,000.00 as attorneys fees as well as all cost that may be determined by the courts.
19. The lessor reserves the right to hold on to any or all of the lessee’s properties or belongings whose value shall
at least be enough to cover the unpaid amount of rent, utilities, and all other costs of repairs due as a result of
misuse other than the reasonable wear and tear. Withheld properties / belongings shall be returned only upon
full settlement of accountabilities within the prescribed period of 2 months ( 60 days from the date of
confinement.) In case of default, the lessor shall dispose of all withheld properties to recover lessee’s
accountabilities. All estimates shall be handled by the lessor.
20. Pre-termination of this contract by the lessee shall automatically forfeit rental deposits in favor of the lessor.
21. Contract period shall be from ______________ to __________________ renewable yearly upon mutual
agreement by both parties. Should the contract expires without the corresponding renewal, it is deemed
renewed on a monthly basis and can be terminated by any of the parties anytime.
22. Parking shall be on a first come first served basis. Only 1 car can be parked at any one time and on a first come
first served basis.

This document relates to that Apartment Contract consisting of two (2) pages including
this page in which this acknowledgement is written and sign by the parties and their
instrumental witnesses on each and every page thereof and sealed with my notarial seal.
