OR: 1.045020 Fle Name: Offer: Page: 20130 The victim advised she was driving her car in Geneva with her boyfriend, ‘The victim advised she observed a vehicle tailgating her starting E/B on ‘South St to S/B Western Ave. The victim advised the offender was driving the vehicle and he was so close to her she thought he was going to hither. The victim advised she pulled into the left turn lane S/B Western Ave at Fabyan Pkwy. The offender pullod alongside her vehicle in the throughvright turn lane. The victim advised the offender was yelling something at her out his window but she couldn't hear him because her window was up. The victim advised the offender looked belligerent. She also said she didn't do anything wrong to warrant being yelled at, so she flipped him off with her middle finger. The victim turned left to E/B Fabyan Pkwy from Westem Ave. She noticed that the offender nad also turned left, from the through/right tum lane and was pursuing her. ‘The victim advised she was in the curb lane when the offender pulled alongside her vehicle in the inside lane. The offender then cut off the victim's car by pulling diagonally in front of it near the intorsection of Fabyan Pkwy and Carriage Dr. The victim advised she drove up onto the curb when she was trying to avoid the offender's, vehicle. The victim's whee! rim was scuffed when she drove onto the curb. ‘The victim advised the offender got out of his car and approached her car. He was yelling at her, but she had her window up. The offender went back to his car and retumed to her car with a badge. She rolled down her window and the offender began yelling at the victim and witness about fipping him off. The offender identified himself as the Mayor of Geneva. The victim advised she told the offender to calm down and ‘ot yell at them, at which time the offender poked her in the left shoulder with his finger. The victim advised she was not injured by the poke, it was just insulting to her. The offender never identified himself as a police officer. The offender got back into his, vehicle and left the scene E/B Fabyan Pkwy to S/8 Illinois Route 31. The witness was on the phone with 911 and gave the vehicle's direction of travel and description, a Blue Altima with an “Augie” sticker in the back window. Officers were in the area of Route 31 when the call was dispatched but could not locate the offending vehicle. The witness also said he believed the offender was intoxicated. The witness ‘said he knew the offender to be Geneva Mayor Kevin Bums. The witness informed R/O he is related to the offender's ex-wife. R/O interviewed both the victim and witness separately and their stories were consistent, as described above. R/O told the victim R/O would need to talk to the offender to get his side of the story. R/O asked the victim if she wanted the offender arrested, if R/O determined charges were warranted. The victim advised she wanted the offender to apologize to her, and she wanted him to pay for a new wheel rim, she did not want him arrested, VO contacted the offender and left a message on his voice mail. The offender called RIO back within 10 minutes and agreed to come to BPD to talk to R/O about the incident. R/O met with the offender and asked him what happened, The offender (Case Number: 2010:00017948, ORI: L045020 Fila Name: OiceD: Bralanwang, Nara. Page: 3.0130 advised he had been W/B Kaneville in Geneva and was going to tum left onto Burgess Rd when the victim also decided to turn left, rom the through lane, cutting him off. The victim then continued on Burgess to South Sto Western Ave. The victim was going ‘slow and when she crossed over the railroad tracks on Western Ave, she slowed to almost a stop, causing the vehicle behind his to almost strike his vehicle. The victim continued S/B Westem Ave and the offender was driving behind her. He said he didn't think he was tailgating her. The offender said he saw the passenger (witness Marcheschi) make a gesture out the window, but he didn't know if it was meant for him. The witness denied making any gestures. The offender pulled up next to the victim's vehicle at the stop light at Wester Ave and Fabyan Pkwy. He advised he was flipped off by the victim. When the light turned green, the victim turned left to E/B Fabyan Pkwy. The offender advised he followed the victim's vehicle and blocked its path so he could talk to them about flipping him off. The offender went up to the window but the victim would not roll the window down, The offender retumed to his car to get his Mayor |,D. to identify himself to her. He retumed to the car and the victim rolled the window down. The offender advised he and the victim intially exchanged heated words. The offender advised things calmed down and he told them he didn't appreciate being flipped off. The offender advised he apologized to the victim for losing his temper, she apologized for flipping him off, they shook hands and went on their separate ways. VO then asked the offender to provide a written statement of the evening's events. That statement is attached to this report. R/O contacted the victim and updated her. R/O told the victim that the offender was willing to formally apologize for his actions. ‘The victim and witness responded to BPD and met with R/O and the offender. The offender apologized to the victim. The victim advised she also wanted the offender to replace her wheel rim. The offender advised he would replace the rim, The victim. asked if R/O would handle passing the receipt to the offender once she obtains it, as she doesn't feel comfortable doing It herself. R/O told the victim to get the receipt to R/O and ne would forward it to the offender. The offender would then get a check to R/O and R/O would deliver it to the victim. The witness said he thought the offender was intoxicated because his eyes were bloodshot. The offender indeed had bloodshot eyes, but R/O did not detect any odor of. an alcoholic beverage on his breath, his speech was not slurred, he did not stumble when walking and he did not sway while standing. R/O explained to the witness that some people get bloodshot eyes and it is not enough to determine if someone has been drinking. "R/O further explained that if the offender had been drinking, it would be highly unlikely that he would show up in person at the police department to resolve this matter in a timely manner. R/O verified that the victim was satisfied with the outcome of the case. Rit met with both subjects and related the following in summery. ‘elated that after thinking about the incident she wanted to press charges against Bums because, "he needs to be held accountable for his actions” She ‘continued by relating that Burns is the Mayor of Genova and should have known better. Ril then asked what outcome she would like to see Ryan Marcheschi then began to talk and related that he wanted Burns charged with impersonating a police officer, assault, reckiess driving and battery. Ril asked him if Burns told them he was a police officer. Marcheschi responded by saying that Burs did not and that he knew Bums was the Mayor of Geneva but that Burns showed them a badge. Ril advised him that such a charge was not an option. R/I then asked him to allow to speak. Ril then asked ‘why she changed her mind after dectining to press charges the night of the incident. According to the original police report filed by Ofc B Nallenweg, requested an apology and payment from Burns for her damaged car and was satisfied with that outcome. Burns did apologize and his agree to pay damages. ‘elated that was intimidated the night of the call and was afraid to press charges. Ril asked if she spoke to Of Nallenweg without Burns present and she related yes. She then again related that Burns needed to be held accountable for his actions. Ril then informed her that the investigation would be re-opened. Ri also related that according to the report and were to mail thair statements to Ofc Nallenweg on 10/05/10, Both subjects related that they would e mail them to Ofc Nallenweg when they retumed home afler the meeting with RI Both subjects then left the police department. il then learned that Ofc Nallenweg would not be at work until 10/14/10. R/l contacted Ofc Nallenweg and he related that he would check his e mail and forward the statements to Ril. Ril then met with Deputy Chief Eul and advised him of the situation, Both Ril and D.C. Eul agreed to begin investigation as soon as the statements were received and reviewed. RVI then contacted by phone and requested her to meet with R/l on 10/12/10 at 1100Hrs to discuss the case further. A message was left at that time. On 10/14/10 Ril received a message from advising she could meet with R/l at 41500Hrs on 10/12/10 at B.P.D. On 10/42/10 Ril received a single statement via e mail from both ‘and Marcheschi dated 10/08/10 at 1120Hrs, 3 days after they were advised to write a statement. It was written from Marcheschis e mail by Marcheschi. In summery it advises that gave Bums "the finger" prior to the incident and that Burns cut them off on Fabyan Parkway, exited his vehicle and began to yell at them. He then showed them his Mayor's Badge. Several heated words were exchanged and the 911 was called. (See attached statement) At 1000Hrs RI contacted Asst. States Attorney Jody Gleason to advised her of the case. Due to Burns’ political position RVI Was requested to prepare them for possible charges of Reckless Driving and Disorderly Conduct, ASA Gleason requested that R/l fax hor a copy of the report and the statements. R/I also sont a copy of the 911 call to her. ‘Case Nunbor: 2010-00017946, OR: 1.045020 Fla Name, Ofc: Page 90190 At approx 1100Hrs ASA Gleason related that she had reviewed the case and spoken with States Attorney John Barssanti. They agreed with the charges and requested that, sign them herself. Burns would then be served with a Notice to Appear complaint. At 1510Hrs R/l met with and at the police department. Marcheschi was asked to remain in the upstairs lobby and was escorted to an interview room. Ril informed that charges had been approved but that a statement from her alone would need to be written. Ril then informed her that a statement would also be taken from Marcheschi ance she signed the charging documents. then told Ril that she had thought about the incident over the weekend and now wished to drop the charges. She related that she did not have time for any court dates and just wanted her car fixed. She then produced a bill for repairs in the amount of $530.82 from Ollie's Garage, 709 W. Main St, Batavia IL. Ril asked her if she had been in any way threatened or intimidated to change her mind. Ril additionally advised her that she would be safe in advising Rv if she had. She responded that she had not but just wanted her car fixed. Ril then asked to write a statement advising same. She complied, see attached. il then informed her that Burns would receive the statement that she brought in (see attached) and that he would be requested to make payment to Ril and in tum Rit ‘would forward the payment to her. ‘was content with that arrangement and Prepared to leave. As Ril escorted out the door, . who was waiting in the lobby asked if his statement would be next. R/l informed him that the case was closed per «He then advised R/l that he was a victim as well and demanded to press charges against Burs. R/ informed him that he had been listed as a witness only on the report and also his written statement. He sald that he was a victim and that Kevin Burns has to be held accountable for what he did, He related that he was also in the car that night and was in danger as well At 1845Hrs,RiI then allowed to write a written statement, In summery Marcheschi save the same statement as before with the exception that he added that Bums had no regard for their lives and several other accusations that were Rot in the original very brief statement. He also accused Kevin bums of “fleeing” the ‘scene which is contrary to the original report. (see attached written statement) Ril took his statement and asked why he did not mention to Ofc Nallenweg the night of the report that he felt he was a victim. He related that Ofc Nallenweg never directly asked him, Rl then asked him why no mention was made by him when R/l spoke with ‘him on 10/08/10. Marcheschi responded that RI told him to stay quiet. ( Ril only asked hhim to stay quiet when his questions were directed to When that conversation was compieted Ril asked both subjects if the had any questions, concems or further information. Both replied in the negative) Ril then asked why he made no mention in his e-mailed statement since he wrote it for both him and He responded that he made it clear in that statement. In Ri's opinion i Ril then asked if there were other reasons for him wanting to pursue charges when agreed to drop any charges. responded that he did ‘Case Number: 2010-00017846. Ji then informed him that his statement would be forwarded to the Kane County States Attorney's Office just as their joint statement had been. When a decision was made RI would contact him. When Ril walked Marcheschi out to the lobby, Ri informed 1 who was waiting for Marcheschi, that Marcheschi wanted to pursue charges against Kevin Burns himself. That being said, any payment to her from Burns would not proceed until that case was resolved and went to court. then told that he would "make good” on the payment until Burns" case was done. Both then loft. At approx 1625Hrs, called RVI by phone. He wanted to have Burns’ insurance company pay the bill. R/I informed him that court ordered restitution would now have to be made, At approx 1645Hrs left a voice mail message with Ril. He related that after thinking about the incident he no longer wished to pursue any charges. On 10/13/10 at approx 1100Hrs, R/l spoke to by phone. related that he wanted to drop any charges against Bums and that he was acting "bullheaded" He then agreed to mest with R/l to make a written statement saying that he no longer wanted to pursue the case. At 1315Hrs R/l met with Marcheschi at the police department and he wrote out his statement. R/l asked him if he was doing this of his own free will and he related yes. ‘See attached statement. Ril contacted ASA Jody Gleason and advised her of the chain of events. She requested that all statements be faxed to her for review. Ril complied. After reviewing the documents ASA Gleason advised Ril to close the case with no arrest and to proceed with Bums making the prior agreed payment to On 10/14/10 at approx 1100Hrs, R/ contacted Kevin Burns by phone. R/l asked to meet with him to give him the estimate for repairs to ‘scar, ‘At 1300Hrs, R/i met with Kevin Burns at the Batavia Police Department. Ril informed Mr. Burns of the events and that no charges would be placed. Ril then gave Mr. Bums a copy of the repair bill from ‘and he agreed to have cash to RII by 10/19/10. It appears from your reports that neither victim wants to file charges at this time. In addition, it appears that has changed or embellished his version of events prior to making a decision not to sign a complaint against Mr, Burns.
