AFFIDAVIT OF ADVERSE CLAIM
I, PRIMITIVO B. MANERA, of legal age, married, Filipino and a resident of
Barangay Sto. Domingo, Piat, Cagayan, after having been duly sworn to in accordance
with law, depose and state:
1. That on April 27, 2017, I have entered into a Deed of Absolute Sale of a Parcel of
Land which was acknowledged on the same date before Notary Public Atty. John
Mark N. Paracad and entered in his Notarial Register as Doc. No. 440, Page 88,
Book XII, Series of 2017. A copy of the said Deed of Absolute Sale of Parcel of
Land is hereto attached as ANNEX “A” and made an integral part of this
Affidavit;
2. That in the said Deed of Absolute Sale of a Parcel of Land, I was the VENDEE of a
certain portion of parcel of land consisting of 5, 229 square meters covered by
Transfer Certificate of Title No. 8559, more particularly described as follows:
“Lot No. 132-B, Psd-af-02-022225 with an area of 1,7215.00 square meters,
located at Sto. Domingo, Piat, Cagayan.”
3. That in the aforestated deed of sale, Norma V. Malana is the previous owner and
vendor pursuant to a prior Deed of Donation with Sale of a Portion of Registered
Land and Affidavit of Consolidation/Subdivision and Conformity executed in her
favor by the original registered co-owner Antonio Verdadero, which was
acknowledged on December 30, 2009 before Notary Public Atty. Lea T. Malana-
Balanon. A copy of the said Deed of Donation with Sale of a Portion of
Registered Land and Affidavit of Consolidation/Subdivision and Conformity
are hereto attached as ANNEX “B” and ANNEX “C”, respectively;
4. That just lately, said Norma V. Malana refused to acknowledged our agreement and
allowed his brother to put up a house within subject lot sold to me. Worst, they are
now in the process of offering for sale the subject lot despite the prior sale made in
my favor;
4. That I wanted to protect my rights over the said property and to give warning to
third persons that the same has already sold in my favor;
5. However, since the said Deed of Absolute Sale of a Parcel of Land per se could not
be annotated on the Title with the Office of the Register of Deeds of Tuguegarao
City, Cagayan, I am therefore executing this Affidavit for the purpose of attesting
to the truthfulness of the foregoing allegations and in support of my request for
the annotation of an adverse claim over the parcel of land covered by the
Transfer Certificate of Title No. 8559.
