MOTION TO REVIVE AND SET CASES FOR HEARING

Accused through the undersigned counsel of the Public Attorney’s Office, unto
this Honorable Court, most respectfully states that:

1. For failure of the Accused to appear for arraignment, this Honorable Court issued
an ORDER dated November 5, 2015, issuing a bench warrant against him,
and sending the case to the archives.

2. That the Accused was recently arrested by virtue of such warrant, but is currently
processing posting another bail for his provisional liberty;

3. That according to the wife of accused, he still resides at #344 Gonzales St, Brgy.
San Vicenty, Biñan City, Laguna, where he may be served subpoena.

PRAYER

It is therefore most respectfully prayed that


1. the instant case be removed from the archives and be set for hearing at a
schedule to be determined by the court;
2. that subpoena be sent to the above-stated address so that he may be able to
attend the hearing of this case;
3. Other just and equitable reliefs are also prayed for.
