AFFIDAVIT OF SELF-ADJUDICATION

         I, JUANA B. DELA CRUZ, of legal age, Filipino, single and a resident of 123
General Luna St., Estaka, Dipolog City, after having been duly sworn to in accordance
with law, depose and state:

1. That I am the only daughter of JUAN A. DELA CRUZ who died without


any last will and testament on July 20, 2020 in Dipolog City as evidenced by his
Death Certificate issued by the City of Dipolog hereto attached
as Annex “A” and made an integral part of this Affidavit; 

2. That at the time his death, my father had no debts, liabilities or obligations to any
persons, agency or institution;

3. That the only property he left is a parcel of land consisting of 100 square meters
located in 123 General Luna St., Estaka, Dipolog City more particularly described
in TCT No. 0011223 hereto attached as Annex “B” and made an integral part of
this Affidavit;

4. That pursuant to Rule 74, Sec. 1 of the Rules of Court, I hereby adjudicate unto
myself the above-described real estate by means of this Affidavit and hereby files
the same with the Register of Deeds of Dipolog City with the request that the said
adjudication be made effective without judicial proceeding as prescribed by the
aforementioned provision of the Rules of Court.

PETITION

Petitoner, to the Register of Deeds, respectfully alleges that:

1. Petitioner is a Filipino, single, of legal age, and with the postal


address at 001 Quezon Avenue, Miputak, Dipolog City, Zamboanga
del Norte;

2. Petitioner is the registered owner of a certain real property covered by


TCT No. 01-56789 of the Register of Deeds of Dipolog City;

3. Annotated on the said title is the three (3)-year lien covered by “Sec.
4, Rule 74 of the Rules of Court” which was annotated on
September 1, 2016;

4. The three (3)-year period provided for under Section 4, Rule 74 for


the filing of claims against the estate of the deceased already lapsed
without any claim having been filed, thus the necessity of cancelling
the said annotation.

PRAYER

WHEREFORE, premises considered, and by virtue of the provisions


of the LRC, petitioner respectfully prays for the cancellation of the

annotation pertaining to Sec. 4, Rule 74 of the Rules of Court on TCT No.
02-22340, without any judicial pronouncement.

I, JAMES A. CORDEN, of legal age,  Filipino, single, and a resident


of 001 Quezon Avenue, Miputak, Dipolog City, Zamboanga del Norte,
under oath, depose and state:

1. That I am the PETITIONER in the above-entitled case and have


caused this Petition of Cancellation of Lien under Rule 74 to be
prepared;
2. That I read and understood its contents which are true and correct of
my own personal knowledge and/or based on true records;
3. That I have not commenced any action or proceeding involving the
same issue or subject matter in any court, tribunal, or agency; that of
my own knowledge, no such action is pending in any court, tribunal or
agnecy; that should I hereafter learn of any such pending action, I
undertake to inform this Honorable Office of such fact within five (5)
days therefrom.

DISCHARGE OF REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

I, JACKSON A. WANG, of legal age, single and with residence and postal
address at No. 001 Miputak, Dipolog City, is the mortgagee in that Deed of Real Estate
Mortgage executed by MARK C. TUAN on May 1, 2019  and noted as Doc. No. 1; Page
No. 1; Book No. IV; Series of 2019, of the Notarial Register of JAMES CORDEN,
Notary Public for and in the City of Dipolog;

That having received the full amount of FIVE HUNDRED THOUSAND PESOS
(P500,000.00), Philippine Currency together with accrued interest from the Mortgagor,
the said  MARK C. TUAN , I do hereby forever RELEASE, DISCHARGE, and
CANCEL the Mortgage mentioned above, covering Lot No. 35 with Transfer Certificate
of Title No. 123456 of the Registry of Deeds of Dipolog City.

CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

         This CONTRACT OF LEASE is made and executed at the City of Dipolog, this
24th day of September, 2020, by and between:

        JACKSON A. WANG, of legal age, single, Filipino, and with residence and postal
address at 001 Miputak, Dipolog City, hereinafter referred to as the LESSOR.

-AND-

        ELENA DE GUZMAN, Filipino and with residence and postal address at 987
Lawaan, Banonong, Dapitan City, hereinafter referred to as the LESSEE.

WITNESSETH; That

WHEREAS, the LESSOR is the owner of THE LEASED PREMISES, a


residential property situated at 002 Miputak, Dipolog City;

WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and


the LESSEE is willing to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the


LESSOR leases unto the LESSEE and the LESSEE hereby accepts from the LESSOR the
LEASED premises, subject to the following:

1. PURPOSES:   That premises hereby leased shall be used exclusively by the LESSEE
for residential purposes only and shall not be diverted to other uses. It is hereby expressly
agreed that if at any time the premises are used for other purposes, the LESSOR shall
have the right to rescind this contract without prejudice to its other rights under the law.

2. TERM:  This term of lease is for ONE (1) YEAR. from October 1, 2020 to October 1,
2021 inclusive. Upon its expiration, this lease may be renewed under such terms and
conditions as my be mutually agreed upon by both parties,  written notice of intention to
renew the lease shall be served to the LESSOR not later than seven (7) days prior to the
expiry date of the period herein agreed upon.

3. RENTAL RATE:   The monthly rental rate for the leased premises shall be TEN
THOUSAND PESOS ONLY (P 10,000.00), Philippine Currency. All rental payments
shall be payable to the LESSOR.

4. DEPOSIT:   That the LESSEE shall deposit to the LESSOR upon signing of this
contract and prior to move-in an amount equivalent to the rent for THREE (3) MONTHS
or the sum of  PESOS: THIRTY THOUSAND (P 30,000.00), Philippine Currency. 
wherein the two (2) months deposit shall be applied as rent for the 11th and 12th months
and the remaining one (1) month deposit shall answer partially for damages and any other
obligations, for utilities such as Water, Electricity, CATV, Telephone, Association Dues
or resulting from violation(s) of any of the provision of this contract.

5. DEFAULT PAYMENT:  In case of default by the LESSEE in the payment of the


rent, such as when the checks are dishonored, the LESSOR at its option may terminate
this contract and eject the LESSEE. The LESSOR has the right to padlock the premises
when the LESSEE is in default of payment for One (1) month and may forfeit whatever
rental deposit or advances have been given by the LESSEE.

6. SUB-LEASE:   The LESSEE shall not directly or indirectly sublet, allow or permit the
leased premises to be occupied in whole or in part by any person, form or corporation,
neither shall the LESSEE assign its rights hereunder to any other person or entity and no
right of interest thereto or therein shall be conferred on or vested in anyone by the
LESSEE without the LESSOR'S written approval.

7. PUBLIC UTILITIES:   The LESSEE shall pay for its telephone, electric, cable TV,
water, Internet, association dues and other public services and utilities during the duration
of the lease.

8. FORCE MAJEURE:   If whole or any part of the leased premises shall be destroyed
or damaged by fire, flood, lightning, typhoon, earthquake, storm, riot or any other
unforeseen disabling cause of acts of God, as to render the leased premises during the
term substantially unfit for use and occupation of the LESSEE, then this lease contract
may be terminated without compensation by the LESSOR or by the LESSEE by notice in
writing to the other.

9. LESSOR'S RIGHT OF ENTRY:   The LESSOR or its authorized agent shall after
giving due notice to the LESSEE shall have the right to enter the premises in the presence
of the LESSEE or its representative at any reasonable hour to examine the same or make
repairs therein or for the operation and maintenance of the building or to exhibit the
leased premises to prospective LESSEE, or for any other lawful purposes which it may
deem necessary.

10. EXPIRATION OF LEASE:   At the expiration of the term of this lease or


cancellation thereof, as herein provided, the LESSEE will promptly deliver to the
LESSOR the leased premises with all corresponding keys and in as good and tenable

condition as the same is now, ordinary wear and tear expected devoid of all occupants,
movable furniture, articles and effects of any kind. Non-compliance with the terms of
this clause by the LESSEE will give the LESSOR the right, at the latter's option, to refuse
to accept the delivery of the premises and compel the LESSEE to pay rent therefrom at
the same rate plus Twenty Five (25) % thereof as penalty until the LESSEE shall have
complied with the terms hereof.  The same penalty shall be imposed in case the LESSEE
fails to leave the premises after the expiration of this Contract of Lease or termination for
any reason whatsoever.

11. JUDICIAL RELIEF:   Should any one of the parties herein be compelled to seek
judicial relief against the other, the losing party shall pay an amount of One Hundred
(100) % of the amount claimed in the complaint as attorney's fees which shall in no case
be less than P50,000.00 pesos in addition to other cost and damages which the said party
may be entitled to under the law.

12. This CONTRACT OF LEASE shall be valid and binding between the parties, their
successors-in-interest and assigns.

This agreement made and executed this 24 th day of September 2020 in Dipolog

Miputak, Dipolog City, hereinafter called as a VENDOR; and

That the VENDOR is the absolute owner of the Bösendorfer Grand Piano located
in the residence of the vendor in 123 Quezon Ave., Miputak, Dipolog City.

That for and in consideration of the sum of Seventy Five Thousand Pesos (P
75,000.00) VENDOR hereby sells the above described property to the VENDEE, under
the following terms and conditions:

a. The sum of Fifteen Thousand Pesos (P 15,000.00) shall be paid in cash


upon the signing and execution of this agreement and the balance of Sixty
Thousand Pesos (P 60,000.00) shall be due and payable in three (3) equal
monthly installments as follows:

P 20,000.00 due and payable on October 24, 2020


P 20,000.00 due and payable on November 24, 2020
P 20,000.00 due and payable on December 24, 2020

b. Any monthly installments due and unpaid shall bear an interest of 10% per
annum, computed from the date of default until paid.

c. Pending the payment of the full purchase price, the aboved described
property located in Miputak, Dipolog City and now in the actual
possession of the VENDEE, is hereby conveyed to the VENDOR by way
of chattel mortgage as security for the payment of the unpaid balance,
under the express understanding that if the said VENDEE, his heirs or
assigns shall well and truly perform the obligation herein above stipulated,
then this mortgage shall become null and void.

Undersigned ENTRUSTEE hereby agrees, undertakes and commits to
hold in trust for the ENTRUSTER the above goods, to dispose of or sell
them for cash and receive the proceeds thereof in trust for the ENTRUSTER,
to turn over and remit the proceeds of the sale of the goods to the
ENTRUSTER on or before the above due date, at the net amount indicated
above, or to return the goods to the ENTRUSTER in the event of non-sale

however, understood that should there be goods remaining unsold on
December 24, 2020, the ENTRUSTER may, at his/her option, extend in
writing the operation of this trust receipt agreement to another date under the
same terms and conditions.

Any court action arising from this agreement, the same shall be
brought in the proper court of Dipolog City to the exclusion of all other
courts.

AFFIDAVIT OF CONSOLIDATION OF OWNERSHIP

         I, JACKSON A. WANG of legal age, Filipino, single and a resident of 001
Miputak, Dipolog City, after having been duly sworn to in accordance with law, depose
and state:

1. That on June 10, 2017, Elena De Guzman, of legal age, Filipino, single, residing at 2222
Estaka, Dipolog City, sold to me a certain parcel of land under pacto de retro, executed
before Notarial Public of James Corden and bearing Not. Reg. No. 2, Page 2, Book II,
Series of 2017 of his Notarial Register (copy of the said  pacto de retro sale is hereto
attached as ANNEX “A”);

2. That pursuant to the deed of sale with pacto de retro, the said vendor, Ms. Elena De
Guzman, should have exercised his right to repurchase the said property within the period
of two (2) years;

3. That the period expired on June 10, 2019 without the said vendor, by himself or by any
other person in his behalf complying with the condition and stipulation required for the
repurchase of the said property;

4. That the said period of repurchase has not been extended, either expressly or impliedly, by
affiant vendee a retro;

5. That by virtue of the said deed of sale with  pacto de retro, and by the failure of the
vendor, Ms. Elena De Guzman, to duly repurchase the property within the
period stipulated, there was consolidated in the affiant, as vendee a retro, the
absolute ownership of the said property. Attached hereto, as ANNEX “B,” is an order of
the Regional Trial Court of  Dipolog City issued on August 11, 2020, approving and
confirming the above consolidation of ownership in the name of affiant.
