AFFIDAVIT

I, ________________, Filipino, 17 years of age, and with

residence at _________________, Bohol, after having been duly sworn in

accordance with law, hereby depose and state that:

(a)That on December 1, 2019 at around 8:00 o’clock in the evening I

(________________, “______________ for brevity”) together with

my schoolmate (_________________) and other neighbors and

cousins we walked and passed by the house of respondent

(_____________and _______________) we kept on singing;

(b) When we passed by the house of respondents, respondent

_____________ shouted at us saying “PIRTI MONG BANHAA, PA

KULATA MO” (you are so noisy, you want me to maul you);

(c) In response to what respondent shouted at me I replied “NGANONG

MASUKO MAN KA NGA KALSADA MAN NI” (why will you be angry,

this is a public road);

(d) Respondent _____________ responded by saying “LITSI KANG

BATAA KA, KINSAY IMUNG GISALIGAN? KANANG IMUNG AMAHANG

BUTA? (maligning word “Litsi”, whom do you depend to? Your father

who is a blind one?);

(e)I also told him (BOANG KA, UNSAY LABOT SA AKONG PAPA?)

(You’re foolish, what’s the participation of my father);

(f) Respondents _____________ and ______________ went out of

their house shouting “(PATYON TA KANG BATAA KA) (I will kill you);

(g) Out of fear, I and my companions ran away towards the house of

___________;

(h) I did not went home at that night but stayed at the house of

____________;

(i) The following day December 2, 2019 at around 6:00 o’clock in the

morning when I was about to go home and while I am still at the

road side standing waiting for my friend __________ who was at

that time commanded by his father to get a one whole banana stem

to be utilized as food for the swine, ____ called me twice but I did

not hid on the call;

(j) When my friend _______ arrived we walked together in going to our

house but we were saddened when __________ was running

towards us bringing a Scyth and Bolo saying (“TINIGBASAY TA,

PANADTARON TA MO RON) (I will hack you);

(k) I and _____ arrived home very frightened;

(l) Our neighbor named “_______________” informed my father of

the incident that I and my companions were chased by

_____________;

(m) I was confronted by my father of the said incident and WE

went to the Police Station to enter the incident in the police blotter

(Annex “A”);

(n) That around 11:00 o’clock on the same day (December 2, 2019)

when I was at the house of (___________) watching television,

respondent ____________ arrived brininging big stones and throw

it towards the house and uttered the following words “UG

MADAKPAN KA NAKONG BATAA KA KARON PATYON KA NAKO” (if I

caught you, I’ll kill you);

(o) Fortunately I was not hit when the stone was thrown and that I

ran towards the house of Barangay Tanod ____________ and

asked him to bring me to the town center where my friends where

there;

(p) Using a motorcycle I was brought to the twon center and just as

we are about to arrive the town center, we stopped over the house

of respondent _________ where Barangay Tanod ____________

asked him (__________) “UNSA NAMAN KA DAKO ANG DAMAGE

SA INYONG BALAY, NGA INYO NAMANG PATYON SI

______________”, (how big is the damage of the house so that

you could alredy afford to kill ______________);

(q) Ariel immediately rushed up towards us (_________________)

and kept on saying “PATYON NAMO NANG BATAA” (we will kill that

child);

(r) _________ answered, “AYAW BAI KAY DILI AWAY AMONG GIANHI,

MIARI MI KAY MO TAN AW SA GUBA SA IMUNG LABAT KAY

AMONG AYUHON” (don’t do that, we are not here to fight against

you but to see the extent of the damage of your fence so we can fix

it);

(s) ___________replied “AH WA NAY AYO2X, KAY BISAN ASA NAMO

NA IKITA AMO NANG PATYON” (no need to fix it, at any place we

can find that child we will kill him);

(t) _________________ also said “PATYON GYUD NAMO NA MA

MERKADO MAN O KALSADA” (we will kill that child wherever we

could find him either at the Market or at the Street);

(u) I left the place without asking permission from ___________ and I

even left my sleepers because ________ kept on attacking me and

Nelson defended me at that time tried to block ______ to cause

harm at me;

(v) The incident was recorded in the police blotter (Annex “B”)

(w) At around 5:00 o’clock in the afternoon (December 2, 2019)

my also made a blotter in the police station informing the police

that I did not went home since the incident at 11:00 o’clock (Annex

“C”)

 (x) The incident at 11:00 o’clock in the morning on December 2, 2019

was also recorded in the Barangay Blotter by me together with my

father (Annex “D”)

(y) It was already past 10:00 o’clock in the evening on December 2,

2019 when I went home after my father fetched me at the house of

Barangay Kagawad “Boy Jumao-as” where I hid myself from the

time of the incident at 11:00 o’clock;

(z) I am executing this affidavit to attest to the foregoing facts and for

whatever legal purpose this may serve.
