AFFIDAVIT

I, ______________, Filipino, 17 years old, and with residence at

____________________, Bohol, after having been duly sworn in

accordance with law, hereby depose and state that:

(a)That on December 1, 2019 at around 8:00 o’clock in the evening

coming from a videoke at the house of _________ (uncle of

___________________ I together with ________________ and

other neighbors and cousins we walked and passed by the house of

respondent (______________________) while we kept on singing;

(b) When we passed by the house of respondents, respondent Ariel

Cabahug shouted at us saying “PIRTI MONG BANHAA, PA

KULATA MO” (you are so noisy, you want me to maul you);

(c) In response to what respondent shouted at us, _____________

replied “NGANONG MASUKO MAN KA NGA KALSADA MAN NI” (why

will you be angry, this is a public road);

(d) Respondent _____________ responded by saying “LITSI KANG

BATAA KA, KINSAY IMUNG GISALIGAN? KANANG IMUNG AMAHANG

BUTA? (maligning word “Litsi”, whom do you depend to? Your father

who is a blind one?);

(e)________________ also told him (BOANG KA, UNSAY LABOT SA

AKONG PAPA?) (You’re foolish, what’s the participation of my

father);

(f) Respondents _____________ and _____________ went out of

their house shouting “(PATYON TA KANG BATAA KA) (I will kill you);

(g) Out of fear, we ran away towards the house of _____________

where we stayed over night;

(h) The following day December 2, 2019 at around 6:00 o’clock in the

morning when ___________ was about to go home and while he

was till at the road side standing waiting for me who was at that

time commanded by my father to get a one whole banana stem to

be utilized as food for the swine, _________ called at us twice but

we did not hid on the call;

(i) When I arrived we walked together in going to their house but we

were saddened when Ariel was running towards us bringing a Scyth

and Bolo saying (“TINIGBASAY TA, PANADTARON TA MO RON) (I

will hack you);

(j) I and _________ arrived at their house very frightened;

(k) At around 11:00 more or less on the same day December 2, 2019,

while ________ was watching television at our house, _________

passed by and we thought he will not do anything but when he

came back he intentionally push his motorcycle to the ground and

pick a big stone going towards our house so I asked

______________ to run away using the back door (kitchen);

(l) When Ariel saw ____________ he throw the stone against Jhonsent

but fortunately ___________ was not hit;

(m) __________ saw the incident and brought _____________ to

the house of ________ in order to settle the conflict;

(n)I am executing this affidavit to attest to the foregoing facts and for

whatever legal purpose this may serve.
