AFFIDAVIT OF WITNESS
I, Joy E Sumang, 25 years of age, single, resident of Palanginan, Iba, Zambales, after
having sworn in accordance with law, do hereby depose and state:
01. That I was present and personally saw that accused, Marlon G Merto, committed
the crime of rape against the victim Maria Leonora Santos y Cruz;
02. That my house is adjacent where the crime was committed;
03. That I was the one who called the attention of the accused and stopped him from
doing a felonious act against the victim;
04. That I saw him thrusting his hips back and forth against the unconscious victim
and I tried to stop him by only shouting because I fear for my safety;
05. That I shouted to Marlon G Merto, “hoy itigil mo yan” and after I asked for help.
Thereafter, I saw Marlon G Merto ran away with his tricycle and threatened me
by saying “Putang ina mo, babalikan kita.”
I executed this affidavit to attest the truthfulness of the foregoing facts and to support the
filing of Criminal Cases against Marlon G Merto for Violation of Violation of Article 266-A par.
1(A) and (B) of the RPC.
