Quick Steps: Startup India
In order to be recognised as a Startup, a person must go through all the legal requirements
attached to it in order to avail the benefits. In India, the Department of Industrial policy and
promotion, take care of all the legal fulfillment and provide a detailed guide as to how to start a
startup and get it recognised by the Government of India to avail the benefits. Before the
process, we need to go through the requirement or eligibility in order to constitute a startup.
Under the vide notification of G.S.R. 127(E) issued by the government (click here), the definition
is provided under Section 1(a), as to what constituted a Startup.
The first criteria is that, a Startup should be incorporated as one of the following:
● private limited company
● partnership firm
● limited liability partnership
Second, the entity shall be considered as Startup Upto a period of ten years from the date of
incorporation/ registration, and turnover restricted to 100 crore for every year.
Thirdly, an entity is working towards innovation, development or improvement of products or
processes or services.
We have to keep in mind that, entity formed by splitting up or reconstruction of an existing
business shall not be considered as Startup.
How to get recognised?
The process of getting your startup recognised by the government department of DPIIT, is laid
down under Section 2.
1. You have to Make an online application to the portal of DPIIT. (Link here). Application
shall carry two things-
● Copy of Certificate of Incorporation or Registration.(Type of business you incorporated).
● Write-up about the nature of business and how it is innovative and unique, how it will
give a chance of employment and its scalability in terms of growth.
The decision then will rest on the authority, as they either accept your application or reject it.
2. After filing the preliminary application, you can choose to avail tax benefit, if the authority
authorises you the same.
3. A Self Assessment in order to clarify what you have entered is true and not forged.
4. After going through all that, you will receive one unique recognition number, and after a
few days, if the application gets accepted by the authorities, you will get your certificate
of recognition.
