AFFIDAVIT OF LOSS

 I, CHRISTIAN C. HENSON, of legal age, Filipino, (single/married/widow) and


a resident of STA. ISABEL, DIPOLOG CITY, after having been duly sworn to in
accordance with law, depose and state THAT:

1. I am a duly-licensed driver in accordance with pertinent Land


Transportation laws, rules and regulations, and was issued a corresponding
Non-Professional Driver's License with number 123456 which is valid until
3/21/2022;

2. Sometime on SEPTMBER 16, 2020, said driver's license was misplaced


and got lost;

3. Efforts were exerted to locate said driver's license, but in spite of diligent
search, it could not be found and the same is now beyond recovery;

4. Said Driver's License has not been confiscated by the LTO, Police or other
Traffic Enforcers for any traffic violation;

5. As such, I am executing this Affidavit of Loss to attest to the truth of the


foregoing and to support my application for the issuance of a new Non-
Professional Driver's License, in lieu of the one that was lost;

EASEMENT OF RIGHT OF WAY

            This AGREEMENT OF EASEMENT OF RIGHT OF WAY, entered into

owner of the dominant estate, of legal age, single and a resident of STA.
FILOMENA, DIPOLOG CITY and ALMIRA B. RUALES, owner of the servient

located in the city of Dipolog, province of Zamboanga del Norte, and more
particularly described as follows, to wit:

to JUSTIN B. SARIMOS’ property, and more particularly described as
follows, to wit:

“A PARCEL OF LAND (Lot 21 Blk 55 of consolidation subdivision plan (LRC)


Pcs-13265, being a portion of the consolidation of Lots 4751-A and 4751-B
(LRC) Psd-50533,  Lot 3, Psd-100703, Lot 1, Psd-150980, LRC Rec. Nos. Nos.
N-27024, 51768, 89632, N-11772, N-13456, and 21071 situated in the Bo.
of Turno, City of Dipolog,  Province of Zamboanga Del Norte, Is. of

which property is covered by T.C.T. No. 654321 of the Register of Deeds of


the province of ZAMBOANGA DEL NORTE.

            That JUSTIN B. SARIMOS in order to have an access to and from, and
to cultivate the above-mentioned land, and so as to have an outlet to
KAGATAN ROAD, which is the nearest public road and least burdensome to
the servient estate and to third persons, it would be necessary for him to
pass through ALMIRA B. RUALES property, and for this purpose, a path or
passageway of not less than two (2) meters wide through the whole length
of the western side of ALMIRA B. RUALES property is necessary for the use
of JUSTIN B. SARIMOS and for all his needs in cultivating his estate;

            That said path or passageway is particularly described in the


attached plan, “Annex A’,

            WHEREFORE, for and in consideration of the sum of FIFTY


THOUSAND PESOS (P50,000.00) the receipt whereof is hereby
acknowledged by ALMIRA B. RUALES, the latter agrees and permits JUSTIN
B. SARIMOS to have a permanent easement of right of way over the above-
mentioned property of said ALMIRA B. RUALES limited to not more than
two (2) meters wide throughout the whole length of the western side of
said property and as specifically indicated in the attached plan which is
made an integral part of this contract, as “Annex A”.

            It is further agreed that ALMIRA B. RUALES shall deliver unto JUSTIN
B. SARIMOS all the necessary papers, deed, and titles in relation to the
servient estate in order to facilitate the registration of the above-
mentioned right of way, in accordance with.

            This agreement shall be binding between the parties and upon all
their heirs, successors, and assigns.

            IN WITNESS WHEREOF, the parties hereto have signed this


agreement the day and the year first above written, in the city of DIPOLOG,
province of ZAMBOANGA DEL NORTE, Philippines.

DEED OF SALE WITH MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF SALE WITH MORTGAGE, made and executed by and between
CHRISTIAN JADE C. HENSON, Filipino, of legal age, single, with residence
and post-office address at STA. FILOMENA, DIPOLOG CITY, hereinafter
called the VENDOR-MORTGAGEE, and JUAN DELA CRUZ, Filipino, of legal
age, single, with residence and post-office address at STA. ISABEL, DIPOLOG
CITY, hereinafter called the VENDEE-MORTGAGOR, Witnesseth:

That the VENDOR-MORTGAGEE is the owner in fee simple of a certain


parcel of land together with all the buildings and improvements thereon,
situated in STA. ISABEL, DIPOLOG CITRY, his title thereto being evidence by
Transfer Certificate of Title No. 123456 of the Registry of Deeds
of DIPOLOG CITY which land is more particularly described as follows, to
wit:

       “A PARCEL OF LAND (Lot 20 Blk 54 of consolidation subdivision plan


(LRC) Pcs-13265, being a portion of the consolidation of Lots 4751-A and

described real estate together with all the buildings and improvements
thereon, free from all liens and encumbrances whatsoever;

That it is hereby agreed and stipulated that the UNPAID BALANCE of NINE
HUNDRED THOUSAND PESOS (P900,00.00), Philippine currency, shall be

paid by the VENDEE-MORTGAGOR to the VENDOR-MORTGAGEE at the
latter’s residence, as follows, to wit:

“Nine equal payments be made monthly starting on the 15th day of the
following month”

That, in order to guarantee the fulfillment of the above obligations, the


VENDEE-MORTGAGOR does hereby MORTGAGE unto the VENDOR-
MORTGAGEE, his heirs and assigns, the real estate herein above described,
together with all the buildings and improvements thereon, under the
express stipulation that if the said VENDEE-MORTGAGOR shall well and
truly pay or cause to be paid unto the VENDOR-MORTGAGEE the aforesaid
obligations, then this MORTGAGE shall be of no further force and effect;
otherwise, the same shall remain in full force and effect and shall be
enforceable in the manner prescribed by law.

(3%) per annum (by virtue of a Promissory Note attached herewith and

JUAN DELA CRUZ, Filipino, of legal age, single and a resident of Basak,
Dipolog City,hereafter referred to as “CREDITOR”, I the said DEBTOR, in

favor of CREDITOR, the right to receive the fruits of, the above-mentioned
land, with the obligation of applying them to the payment of the interest, if
owing, and thereafter to the principal of his credit; the actual market value
of the fruits obtained or harvested at the time of the application thereof to
the interest and principal shall be the measure of such application. That the
parties hereby agree that I, the DEBTOR cannot not reacquire the
enjoyment of the above-described property, without first having totally
paid what I owe to the CREDITOR. However, in case of default, the
CREDITOR does not acquire ownership of the real estate for non-payment
of the debt, but he may bring an action for specific performance; or petition
for the sale of the real property in a foreclosure of mortgages under rules
68 of the Rules of Court, or extra-judicially foreclose the security, as agreed
upon by the parties (in order to effect the foregoing extra-judicial
foreclosure, a Special Power of Attorney is attached herewith and made an
integral part hereof as Annex “B”).

PRE-NUPTIAL AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This PRE-NUPTIAL AGREEMENT, entered into this 16 th day of SEPTEMBER


2020 in DIPOLOG CITY, by and between JUAN DE LA CRUZ, and MARIA
REYES, both of legal age, and residing at STA. ISABEL, DIPOLOG CITY,
WITNESSETH:

1. THAT the parties hereto are about to enter into a contract of


marriage, tentatively scheduled to take place sometime in
DECEMBER 2020;

2. THAT they hereby mutually agree that all the property, real and
personal, now owned by the future wife, MARIA REYES, shall remain
to be own exclusive and separate property, subject to her
disposition, administration, and enjoyment; while those of the future
husband, JUAN DE LA CRUZ shall likewise remain also to be his own
exclusive and separate property, subject to his absolute disposition
and administration;

3. THAT all properties and earnings acquired after marriage by any


party or jointly by both parties shall constitute conjugal properties or
funds which, among other common purposes, shall defray or take
care of family expenses, including the rearing and education of future
children that may be begotten or that may be adopted during the
marriage;

4. THAT this agreement shall take effect upon the celebration of the
marriage.
