“ORDINANCE REQUIRING ALL BUSINESS ESTABLISHMENTS OPERATING IN THE


CITY OF ANGELES TO EMPLOY NO LESS THAN SEVENTY PERCENT (60%) OF ITS
WOKFORCE FROM BONAFIDE RESIDENTS OF ANGELES CITY”

WHEREAS, Angeles City aims to eradicate the widespread employment in the city and at the same
time, provide opportunity for the unemployed to have a decent means of livelihood.

WHEREAS, presently, most of the business establishments operating in the City employ non-
residents of Angeles City.

WHEREAS, in accordance to Section 16 of the Local Government Code, every local government
shall exercise appropriate power to aid its constituents in the upliftment of their economic status.
More so, to assist an individual to start his/her own business to be employed and facilitate means
where the constituents can earn, and

WHEREAS, assuring adequate and decent employment for the constituents, especially those who
are in need of such, is also ensuring a better economy for the City and, thus, providing employment,
would resolved/lessen criminality brought about by unemployment or lack of job.

NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the

SANGGUNIANG PANLUNGSOD OF ANGELES CITY, in session duly assembled, that;

SECTION 1. MEANING OF A WORD OR PHRASE.

a) BUSINESS ETABLISHMENTS - refers to corporation, partnership, single proprietorship,


joint venture or any entity that performs an organized production or service that aims to earn
more their capital. The business establishments being referred to this Ordinance shall have 10
or more employees.

b) WORK FORCE- refers to any person employed by a business establishment, including


managerial, supervisory and rank and file employees

SECTION 2. COVERAGE

All Business establishments operating in the City shall employ no less than seventy percent (70%) of
its work force from among the bona-fide residents of Angeles City. The business establishments
covered by the Ordinance are those that have ten (10) or more employees and shall include service
establishments that reader service in Angeles City regardless of the location of its principal office or

branches, such as but not limited to, security agencies, janitorial services and like provided that the
number of employees working in Angeles City is ten (10) employees or more.

SECTION 3. INCENTIVES

Compliance with the provisions of this Ordinance shall entitle a business establishment to the
following discount on business taxes paid to the City of Angeles:

10 to 249 2.5%

250 to 499 5%

500 to 599 7.5%

1000 or more 10%

SECTION 4. SECURITY OR TENURE.

This Ordinance recognizes the right to security of tenure of employees presently working in business
establishments operating in the City and, as such, in determining compliance with the provisions
hereof, this Ordinance shall not cover employees hired prior to effectively hereof. However, existing
business establishments, that hire additional employees or replace vacant or vacated positions shall
hire bona-fide residents of Angeles City until such time that they shall have met the required
percentage of Angeles City residents in their work force.

SECTION 5. PROOF OF RESIDENCY

For the purpose of this Ordinance, bona-fide residents of Angeles City shall be those who present
valid voter’s identification card (ID) and certification of residency from Angeles City Hall Public
Employment Service Office (PESO). In the absence of valid voter’s ID, any of the following may
suffice: passport, Income Tax Return (ITR), postal ID, SSS ID, GSIS ID or sworn statement
indicating that the person is a resident of Angeles City. For the purpose of complying with the
provisions of this Ordinance all business establishments shall require Angeles City residents to
submit the said documents and shall keep them on file and present them to any authorized agent of
the City of Angeles when required.

SECTION 6. IMPLEMENTING AGENCY.

The Business Permit License Division (BPLD) is the agency that will implement this Ordinance in
coordination with the Public Employment Services Office (PESO) and City Administrator Office.

SECTION 7. REPORTIAL REQUIREMENT.

All business establishments, whether new or old, shall submit a quarterly report of the complete list
of its employees to the Business Permit License Division (BPLD), Public Employment Services
Office (PESO) and the Sangguniang Panlungsod through the committee on Trade, Commerce and
the Industry and Labor Conciliation indicating therein the following information.

a. Name and address of establishment


b. Nature of business to which the establishments belongs
c. The list of employees containing the following information

1. Name of employee
2. Age of employee
3. Present address
4. Tenure of business in the company
5. Present position, position(s) held and scope of work

SECTION 8. PROCEDURE ON GRANTING PERMITS AND LICENSES.

The Business Permit License Division (BPLD) shall only renew the business permits and licenses of
any business establishments upon determining that it complied with the requirements of this
Ordinance and the payment of the fine, if any, based on the report submitted pursuant to the
immediately preceding Section, which shall be in addition to those required by applicable laws and
other Ordinances for the issuance of such permits and licenses.

SECTION 9. EXEMPTIONS

Establishments, which may have reasonable grounds to be exempted from the requirement of this
Ordinance may apply for exemption at the Business Permit License Division (BPLD) Office.

SECTION 10. PENALTY

In case of failure to comply with any provisions of this Ordinance, a business establishment shall be
liable to pay a fine of Two Hundred (P200.00) Pesos per month for every non-Angeles City resident
employee occupying a position reserved for bona-fide resident of Angeles as required in this
Ordinance and for each employee who does not have the required documents under Section 5
hereof.

In case of failure to pay the fine required under this Section, the owner(s) and/or officer(s) of a
business establishment responsible for the violation of the provision of this Ordinance shall be
imposed a penalty of imprisonment ranging from a minimum of four (4) months to a maximum of
nine (9) months, upon the sound discretion of the court.

SECTION 11. NON-AVAILABILITY OF QUALIFIED APPLICANT

The employer, may however, fill-up vacant or vacated positions, with non-residents of Angeles, if
the Public Employment Services Office (PESO) fail to provide them with qualified applicants (bona-
fide residents of the City of Angeles), on a minimum of fifteen (15) calendar days from the time of
receipt of the memorandum The Public Employment Services Office (PESO) shall issue the relevant
certification that it has no qualified applicants for the required position, said certification shall be
considered in the imposition of penalty under Section 9.

SECTION 12. SEPARABILITY CLAUSE.

If for any reason any section or provision of this Ordinance is declared illegal or unconstitutional,
other sections or provisions hereof which are not affected hereby shall continue to be in full force-
and effect.

SECTION 13. EMPLOYMENT BOARD.

To be composed of the City Mayor as the Chairman and the Chairman on committee on trade
Commerce and Industry and Labor Conciliation as the Vice Chairman, with the following numbers:
Head of the Business Permit and Licensing Division (BPLD), Head of City Administrator, Head of
Public Employment and Services Office (PESO), and City Treasurer and the City Legal Office. The
board shall implement the rules and regulations and evaluate all the certificates of exemption issued
by the Public Employment and Services Office (PESO) for duties and responsibilities as may be
required by law or this ordinance.

SECTION 14. REPEALING CAUSE

All ordinances, rules and regulations, or parts thereof, whose provisions are in conflict with or
contrary to the provisions of this ordinance, are hereby repealed, amended and modified accordingly;

SECTION 15. EFFECTIVITY

This Ordinance shall take effect immediately upon publication in a newspaper of general circulation
in the City of Angeles.
