Earnest Money Receipt Agreement Form

This document is an earnest money receipt agreement between a buyer and seller for a parcel of land. The buyer provides earnest money that will be applied to the total purchase price and is non-refundable unless the seller cancels without justification. The buyer has exclusive rights to purchase the property until a specified date. Upon full payment, the seller will execute a deed of sale transferring ownership and title to the buyer. EARNEST MONEY RECEIPT AGREEMENT

Received from _________________________, of legal age, Filipino, married to


________________________, and residents of _____________________, the sum of
________________________ PESOS (PHP__________.00), representing EARNEST MONEY for
payment of the parcel of land consisting of __________________ (___) square meters, more or
less, situated at ______________________ and covered by Transfer Certificate of Title No.
_______________________, hereinafter referred to as the SUBJECT PROPERTY.

This EARNEST MONEY shall form part of the total purchase price in the amount of
_______________________ PESOS (Php_________.00), and shall be non-refundable unless the
cause for the cancellation of this agreement is on the account of the SELLER with no justifiable
ground.

The remaining balance and full payment of the purchase price shall be paid on or before
_________________.

The BUYER hereby reserves the exclusive right to purchase the SUBJECT PROPERTY and
the SELLER cannot offer the SUBJECT PROPERTY to any third party until ________________.

Upon full payment, the SELLER shall execute a DEED OF ABSOLUTE SALE in favor of the
BUYER, conveying the subject property with full warranty of a legal and valid title as provided
by law, free and clear from any liens and encumbrances.

In case of voluntary cancellation of this agreement by the BUYER without any cause on
the part of the SELLER or if the BUYER fails to comply with his obligations mentioned, then the
SELLER shall have the right to terminate this agreement in which case the EARNEST MONEY
shall be forfeited in favor of the SELLER as liquidated damages.
