REAL ESTATE MORTGAGE
KNOW ALL MEN BY THESE PRESENTS:
I, xxx, Filipino citizen, of legal age, married to xxx, and with residence at xxxx ,
Davao City, Philippines, for and in consideration of a promissory note attached as
ANNEX “A” in the sum of SIX HUNDRED THOUSAND PESOS (P 600,000.00),
Philippine currency, to me in hand paid by xxx, Filipino Citizen, of legal age, single, and
with residence at xxx, do hereby convey, by way of MORTGAGE unto the said xxx her
heirs and assigns, a parcel of land, together with all the buildings and improvements
thereon, situated in xxx, Davao City, respectively described as follows:
Certificate of Title No. 146-
A parcel of land (Lot 16 Block 6 of the subd. Plan, PSD-11-039904 being a portion of Lot 410-I
(LRC) Psd-190135 situated in the Barangay of Ma-a, City of Davao, Island of Mindanao. Bounded
on the SE., along line 1-2 by Lot 18. Of Block 6 of the subd. Plan; On the SW., along line 2-3 by
Road Lot 3 of the subd. Plan; On the NW., along line 3-4 by Lot 14 ; and on the NE., along line 4-
1 by Lot 17, both of block 6 of the subd. Plan. Beginning at a point marked “1” on plan xxxxxx
containing an area of ONE HUNDRED TWENTY (120) square meters more or less.
Of which real property I am the registered owner evidenced by 9 of the Land Registry of
Davao City;
PROVIDED, HOWEVER, that said R shall pay or cause to be paid to said RO, her heirs
or assigns, the said sum of HUNDRED PESOS (P,000.00), within the period of one (1)
year from and after the execution of this MORTGAGE together with the interest thereon
at the rate of 4 per centum (4%) per month or T PESOS (P0,000.00) per month, this
MORTGAGE shall be discharged and of no effect; OTHERWISE, N hereby agree that
said XXX, mortgagee, may enforce her rights herein without judicial proceeding by
causing the above-describe property to be sold at public auction in the city/ of Davao,
the place where the said property is situated, after giving notice of sale for 20 days
posted in at least three public places of the said city/municipality said sale to take place
on a business day between 9:00 am and 4:00 pm at the city building at said city, under
the discretion of a notary public of said city, the justice or auxiliary justice of the peace
of the city, or the city/provincial sheriff, in accordance with Act No. 3135, as amended by
Act No. 4118.
