MOTION TO ALLOW THE ACCUSED TO POST REDUCED BAIL


PURSUANT TO ADMINISTRATIVE CIRCULAR 38-2020

COMES NOW accused AAA, thru the undersigned movant BBB,


father of the accused, and unto this Honorable Court most respectfully
avers that:

1. The above-named accused is charged with the crime of


Violation of Sec. 28 (c) in Relation to Sec. 28 (e) of Republic Act No.
10591;

2. That the accused AAA is presently detained at Brooke’s Point


District Jail in Brooke’s Point, Palawan by reason of the above-entitled
cases;

3. That the above-mention case is bailable; however, the


accused failed to post bail as he cannot produce the amount
recommended for his temporary liberty;

4. That pursuant to Administrative Circular 38-2020 issued by the


Supreme Court; REDUCED BAIL AND RECOGNIZANCE AS MODES
FOR RELEASING INDIGENT PERSON DEPRIVED OF LIBERTY
DURING THIS PUBLIC HEALTH EMERGENCY, PENDING
RESOLUTION OF THEIR CASES; indigent detained person may be
release on reduced bail;

5. That in Number 1 of the above-mention circular, the new


computation for those charge with the crime punishable with maximum
period of 12 years and 1 day to 20 years, the bail shall be computed by
getting the medium period multiplied by Three Thousand Pesos (P3,000)
for every year of imprisonment;

6. That in Number 2 of the same circular, the new computation


for those charge with the crime punishable with maximum period of prision

mayor or 6 years and 1 day to 12 years, the bail shall be computed by
getting the medium period multiplied by Two Thousand Pesos (P2,000) for
every year of imprisonment; and

7. Considering that the offense charged in this case is


punishable by reclusion temporal or for a period of Twelve (12) Years and
One (1) day, as minimum, to Twenty (20) Years, as maximum, the
accused may be released on the reduced amount of bail of Forty Eight
Thousand Pesos (P48,000.00) as equivalent to the medium period of
sixteen (16) years multiplied by Three Thousand Pesos (P3,000.00).

WHEREFORE, premises considered, it is most respectfully prayed


of this Honorable Court to reduce the amount of bail in this case to Forty
Eight Thousand Pesos (P48,000.00) for the provisional liberty of the
accused pending the trial of this case.

Other just and equitable relief are also prayed for.
