AN ACT REQUIRING THE CHIEF OF HOSPITALS OF ALL GOVERNMENT


OWNED AND PRIVATE HOSPITALS TO DEPOSIT ALL THEIR HOSPITAL WASTES
TO THE LA UNION MEDICAL CENTER (LUMC) WASTE COLLECTION
FALICILITY FOR SANITARY PURPOSES AND TO AVOID HAZARDOUS
MICROBIOLOGICAL, BIOLOGICAL AND CHEMICAL AGENTS OF DISEASE IN
THE PROVINCE OF LA UNION.

EXPLANATORY NOTE

Proper waste Disposal through necessary services to treat or handle waste materials is
the hygienic means of promoting health through prevention of human contact with the hazards of
wastes as well as the treatment and proper disposal of sewage or wastewater. Hazards can be
either physical, microbiological, biological or chemical agents of disease.

Hospital wastes are very detrimental to the health and well-being of the people and if it
not disposed properly it may lead to several problems involving health and sanitation and may
greatly affect the physical and mental state of those who might be exposed to such hazardous
waste.

One way of promoting sanitation is through facilitating a system which regulates and
manages the collection of hazardous waste materials for treatment and proper disposal to ensure
that the health and well –being of the general public is protected.

The legal basis for the implementation of this legislative measure is Section 16. General
Welfare Clause of the Local Government Code of 1991 which expressly states that “Every local
government unit shall exercise the powers expressly granted, those necessarily implied
therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective
governance, and those which are essential to the promotion of the general welfare. Within their
respective territorial jurisdictions, local government units shall ensure and support, among other
things, the preservation and enrichment of culture, promote health and safety, enhance the right
of the people to a balanced ecology, encourage and support the development of appropriate and
self-reliant scientific and technological capabilities, improve public morals, enhance economic
prosperity and social justice, promote full employment among their residents, maintain peace and
order, and preserve the comfort and convenience of their inhabitants”. Moreover, Section 468
Paragraph 4(i) (i) Adopt measures and safeguards against pollution and for the preservation of
the natural ecosystem in the province, in consonance with approved standards on human
settlements and environmental sanitation; and

Policy on balancing development and environmental protection particularly to maintain a


quality of air that protects human health and welfare - (DENR Administrative Order No. 2000-
81)

Be it enacted by the Sangguniang Panlalalwigan in session duly assembled:


SECTION 1. TITLE. This ordinance shall be known as AN ACT RESPECTFULLY
REQUESTING THE CHIEF OF HOSPITALS OF ALL GOVERNMENT OWNED AND
PRIVATE HOSPITALS TO DEPOSIT ALL THEIR HOSPITAL WASTES TO THE LA
UNION MEDICAL CENTER (LUMC) WASTE COLLECTION FALCILITY FOR
SANITARY PURPOSES AND TO AVOID HAZARDOUS MICROBIOLOGICAL,
BIOLOGICAL AND CHEMICAL AGENTS OF DISEASE IN THE PROVINCE OF LA
UNION.

SECTION 2. DECLARATION OF POLICY. It is hereby the declared policy of the


Provincial Government to promote and protect the health and well-being of the people of the
Province of La Union.

SECTION 3. SEPARABILITY CLAUSE. If any provision of this ordinance is declared


unconstitutional, the other provisions not affected shall remain in full force and effect.

SECTION 4. REPEALING CLAUSE. Any ordinance, rule and regulation which are
inconsistent with this ordinance are hereby deemed amended, modified or repealed accordingly.

SECTION 5. EFFECTIVITY CLAUSE. This ordinance shall take effect in accordance


with law.
