COUNTER-AFFIDAVIT
I, BRIAN REGIDOR, 20 years of age, single, Filipino, and
a resident of San Roque, Trento, Agusan del Sur, Philippines, having
been duly sworn to an oath in accordance with law, hereby depose and
say:
1. That on 04 December 2020, at about 9 o’clock in the
evening, while I was at a billiard house of Noinie Vistal, Mark
Mariano and Ronnie Vistal bullied me, together with Golyat
Lanuza. I reprimanded them because I started to become
offended with their insults thrown at me. However, they
continued what they did to me and because I started to
become impatient, I challenged them for a fistfight;
2. That unknowingly, Ronnie Vistal, son of complainant, went
inside their house and got an icepick ready to stab me;
3. That I went home to get a bolo knife and went back to the
billiard house but ‘Runrun’ Vistal hid himself inside their
house;
4. That because of my outburst of anger, I hit the billiard table
and the seat of their motor;
5. That I left the billiard house and just sat drunk Alex Napigkit
suddently shouted, “NGANONG NAGWILD MAN KA DIHA NGA
ANG GAHI NAGTAN-AW LANG NIMO. I just told him that he
was not involved in my conflict with Ronnie Vistal;
6. That on my way home, Alex Napigkit threw stone at me
which hit my head causing me to enter the gate of his house
because it was open at that time and tried to confront him;
7. That my uncle Anselmo M. Regidor, rushed to us in order for
me and Alex Napigkit to be separated since the intercalation
between us has started to become a fistfight;
8. That I respectfully pray to the Honorable Investigating Public
Prosecutor that the instant case be dismissed as there is no
probable cause that I have committed the offense charged;
9. That I execute this affidavit to attest to the truthfulness and
veracity of the forgeoing facts and purposely to dispute the
allegation against me.
IN WITNESS WHEREOF, I have hereunto affixed my

COUNTER-AFFIDAVIT
I, ANSELMO REGIDOR, 45 years of age, single, Filipino,
and a resident of San Roque, Trento, Agusan del Sur, Philippines,
having been duly sworn to an oath in accordance with law, hereby
depose and say:
1. That on 04 December 2020, at about 9 o’clock in the
evening, when I was on my way home with my son, I saw
my nephew, BRIAN REGIDOR being hit by a stone thrown
by ALEX NAPIGKIT at him in front of the latter’s house;
2. That Brian Regidor went inside the gate of Alex Napigkit and
confronted him and when it became a heated argument, they
started to punch each other, and I rushed inside and tried to
separate the two of them;
3. That I was sober at that time and did not participate on the
fistfight between BRIAN REGIDOR and ALEX NAPIGKIT.
4. That I respectfully pray to the Honorable Investigating Public
Prosecutor that the instant case be dismissed as I am totally
innocent of the accusation against me and there is no
probable cause that I have committed the offense charged;
5. That I execute this affidavit to attest to the truthfulness and
veracity of the foregoing facts and purposely to dispute the
allegation against me.
