STATEMENT OF JURISDICTION
The counsel on behalf of Plaintiff, in the matter of “S” vs. “S1” &
“D” have approaches the Hon’ble Family Court and would humbly
contest the grounds invoked under this.
The counsel on behalf of Plaintiff, most respectfully submits that
Hon’ble Family Court has the jurisdiction to hear the said matter

presumedfrom thefactthatonepersonhashabituallyandopenlytreated

thepaternityofachild,i.e.itslegitimatedescentfrom itsfather,cannotbe
provedbyestablishingamarriagebetweenitsparentsatthetimeofits
conception orbirth,such marriage and legitimate descentmay be
establishedbyacknowledgement.

WHEREFORE, IN THE LIGHT OF FACTS STATED, ISSUES RAISED,

RESPONDENT RESPECTFULLY REQUESTS THIS HON’BLE COURT
TO ADJUDGE AND DECLARE THAT:
I. Allowed the appellant appeal.
II. The impugned order of trial court may kindly be quashed and
set aside.
III. Allowed the application under order 9 rule 13 of civil
procedure code.
IV. Any other appropriate order or direction, which this Hon’ble
Court consider just and proper in the facts and circumstances
of this case, may kindly be passed in favour of the respondent.
