This Deed of Release is made and executed on 22 nd


July 2013 at Bangalore City by and between:

Here in after called and referred to as Second Party;

Smt. Gowramma [Party No. 1 of the First Party],


Smt. Rajeswari [Party No. 2 of the First Party], Smt.
Nagarathna [Party No. 3 of the First Party], late Smt.
Susheela Bai [ mother of party No. 4 & 5 of the First
Party], late Smt. Shakuntala Bai [ mother of party No. 6
& 7 of the First Party], Sri. S.V. Gopala Krishna [Party
No. 1 of the Second Party] Sri. S. Shivaji [Party No. 2 of
the Second Party], Sri. S.V. Surya Prakash [Party No. 3 of
the Second Party] are sisters and brothers and are the
children of late Sri. S. Vittoba.

That by registered Partition Deed dated 06-10-1952,


registered as No. 2394/1952-53, at page No. 111 to 135,
Vol. 1229, in the Office of the sub-registrar, Bangalore
City, the said S. Vittoba has succeeded the properties

detailed in Item No. 1 to 4 of the SCHEDULE given


hereunder and referred to as Schedule Properties herein
after.

Hence said Sri. S. Vittoba was in possession and


enjoyment of the Ieem No. 1 to 4 of the schedule
properties and he has died on 13-01-1981, leaving his
three sons and five daughters as his legal heirs.

The said Sri. S. Vittoba has performed the marriage


of the Parties No. 1 to 3 of the First Party and also the
mother of Party No. 4 & 5 and 6 & 7 of the First
[Link] during the marriage he has given gifts ie.,
jewels and other valuable articles to them. That after
the death of the said Sri. S. Vittoba his sons i.e., the
Parties of the Second Party] were/are also helping the
Parties of the First Party when ever needs and necessities
arises. Further the financial condition of the parties of
the First Party and their family members is good and
sound.

That, the Parties First Party have decided to


withdraw them self from all the estate of the said Sri.
Late S. Vittoba and to surrender, release and relinquish
unto and in favour of the Second Party all the share and
right, title and interest which they have in the schedule

properties and also all the share, right, title and interest
which they may herein after acquire in the schedule
properties, each by receiving i.e., (1) Smt. Gowramma
[Party No. 1 of the First Party] receiving a sum of Rs.
1,60,000-00 [Rupees one lakh sixty thousand only],(2)
Smt. Rajeswari [Party No. 2 of the First Party] receiving a
sum of Rs. 1,60,000-00 [Rupees one lakh sixty thousand
only], (3) Smt. Nagarathna [Party No. 3 of the First Party]
receiving a sum of Rs. 1,60,000-00 [Rupees one lakh
sixty thousand only], (4) Sri. Sainath and Smt Rukmani
Bai, children of late Smt. Susheela Bai [party No. 4 & 5 of
the First Party] jointly receiving a sum of Rs. 1,60,000-
00 [Rupees one lakh sixty thousand only], and (5) Sri.
Ashok Kumar B.N. and Smt Jamuna Bai, children of late
Smt. Shakuntala Bai [party No. 6 & 7 of the First Party]
jointly receiving a sum of Rs. 1,60,000-00 [Rupees one
lakh sixty thousand only]from the Second Party and the
Second Party has agreed for the same.

Now This Deed of Release Witness as


Follows:

1. That accordingly To-day in presence of the


witnesses the Second Party in cash has paid;

(a) a sum of Rs. 1,60,000-00 [Rupees one lakh sixty


thousand only]to Smt. Gowramma [Party No. 1 of the
First Party],

(b) a sum of Rs. 1,60,000-00 [Rupees one lakh sixty


thousand only]to Smt. Rajeswari [Party No. 2 of the First
Party],

(c) a sum of Rs. 1,60,000-00 [Rupees one lakh sixty


thousand only]to Smt. Nagarathna [Party No. 3 of the
First Party],

(d) a sum of Rs. 1,60,000-00 [Rupees one lakh sixty


thousand only]jointly to Sri. Sainath and Smt Rukmani
Bai, [Party No. 4 & 5 of the First Party],

(e) a sum of Rs. 1,60,000-00 [Rupees one lakh sixty


thousand only]jointly to Sri. Ashok Kumar B.N. and Smt
Jamuna Bai,, [Party No. 6 & 7 of the First Party],

2. And the Parties of First Party do hereby report the


receipt and acknowledge the receipt of amount as
detailed above from the Second Party and in
consideration of the facts and circumstances and in
consideration of the said amount, herein before stated
and for other good reasons and being motivated by pious

wish and desire the Parties First Party with their free will
and accord hereby and hereunder withdraw them self
from all the estate of the said late Sri. S. Vittoba i.e., from
the schedule properties and to surrender, release and
relinquish unto and in favour of the Second Party, all the
their share and right, title and interest which they have
in the schedule properties and also all the share, right,
title and interest which they may herein after acquire in
the schedule properties.

3. Hence for the said facts and reasons the parties of


the First Party do hereby withdraw them self from the
estate i.e., from the schedule properties and do hereby
surrender, release and relinquish unto and in favour of
the Second Party all the share and right, title and interest
which they [Parties of the First Party] have in the
schedule properties.

4. Hence herein after the Parties of the First Party


shall have no share, right, title and interest of any kind
in and over the schedule properties. And further herein
after the Parties of the Second Party and their successors
shall be the absolute owners and shall have all the right,
title and interest in and over the schedule properties.

5. The Parties of the First Party hereby and hereunder


assures and covenant the Second Party that they have
not done, executed, performed or knowingly suffered to
the contrary any acts, deeds and things whereby or by
reason or means whereof or they may be hindered or
prevented from releasing and surrendering the same in
any way, in the manner hereinbefore stated.

6. This Release Deed is made and executed in three


sets i.e., one original and two duplicate. The Party No. 3
of the Second Party shall keep the original and Party No.
1 and Party No. 2 shall each keep a dullicate copy of the
deed.

125, Now bearing No. 633 to 637, situated at Chickpet
Main Road/OTC Road, Chickpet, Bangalore-560053,
measuring 34’. 6” x 45’ together with the construction
thereon and bounded on:

East by: Lane.

West by: Private Property

South by: Chickpet Main road/OTC Road.

Presently the property is with limits of Chickpet Ward No.


28, of BBMP, and the PID No. 28-1-633, 28-1-634, 28-
