APPLICATION FOR EARLY FIXATION OF THE TITLED CASE FOR ___.03.2014

Respectfully Sheweth:-

1. That the titled petition regarding enforcement of fundamental right of


education – being the most fundamental right guaranteed by the
Constitution of Pakistan – is pending adjudication before this Hon’ble
Court since long;

2. That the petitioner, who had been a bonafide student of the Respondent
University doing MBA, has been relieved from continuing his education on
flimsy grounds, seriously jeopardizing his educational career and future
life as a whole.

3. That this Hon’ble Court enjoys an equitable jurisdiction as also acts as


pater familia of the students and has also come to the rescue of the dis-
heartened students in cases of need, as this one when the petitioner has
been stopped from continuing his degree after few months of his studies at
the University.

4. That article 9 (right to life which includes the right to be educated at


a school of citizens’ choice) is the most sacrosanct of all the
fundamental rights and as the petitioner has no other forum to
protect the same but this approach this August Court.

5. That the matter is a simple one and not likely to consume much of
this Hon’ble Court’s valuable time.

6. That the Applicants most humbly and respectfully craves indulgence


of this Hon’ble Court for fixation of the titled Constitution Petition at
its earliest which has not been fixed for almost two years despite
urgency in the matter involved.

It is, therefore, most humbly prayed that the titled Petition – which has
not been heard for almost two years - may kindly be fixed at its earliest to
protect the petitioner’s valuable right to education (this Hon’ble Court being the
pater familia of the students), in the interest of justice and equity.
