1. What is this product about?


• The Foreign Workers Compensation Scheme (FWCS) was created to protect the interest and welfare of all foreign workers
in Malaysia. This scheme provides for the payment of compensation benefits to a foreign worker who posesses valid
employment document for injuries sustained due to accident which arises out of or in the course of employment or if the
death results from the accident.
• The Workmen’s Compensation Act 1952 was amended in August 1996 – Section 26(2) of the Amended Act deems it
mandatory for each employer to insure all the foreign workers employed by him in respect of any liability he may incur under
the Workmen’s Compensation Act 1952.
Zurich General Insurance Malaysia Berhad is one of the panel insurance companies appointed and approved by the Ministry
of Human resources to underwrite the Foreign Workers Compensation Scheme (FWCS).

2. What are the covers / benefits provided?

Accidental Death : 1. Up to RM25,000.00 (Workmen’s Compensation up to RM18,000, the


Company shall pay an extra sum of RM7,000) - In the event of death of
the Insured Foreign Worker resulting from personal injury by accident in
the course of employment.
2. RM23,000.00 – In the event of death of the Insured Foreign Worker
resulting from personal injury by accident after working hour.
Permanent Total Disablement : A sum of RM23,000.00 in the event of permanent total disablement occurring
within 12 months of the accident
Permanent Partial Disablement : A sum of money based of the capital sum of RM23,000.00 calculated
in accordance with the First Schedule of the Workmen’s Compensation
(Amendment ) Act 1996.
Temporary Total Disablement : A sum of money calculated in accordance with Section 8 (e) of the Workmen’s
Compensation Act 1952.
Medical Expenses : In accordance to the provisions of Workmen’s Compensation Act 1952

Occupational Disease : As per Second Schedule of the Workmen’s Compensation Act 1952

Repatriation Expenses : The repatriation expenses shall be the actual expenses incurred or RM4,800.00
whichever is the lesser, for the transportation of the Insured Foreign Worker
to his/her country of origin in the event he/she dies or suffers permanent total
disablement.

3. How much premium do I have to pay?


Premium : RM72.00 per worker
The estimated total premium that you have to pay is RM ___________
Minimum Premium : RM35.00 Per policy

4. What are the fees and charges that I have to pay?

5. What are some of the key terms and conditions that I should be aware of?
5.1 The Insured and the Insured Person shall comply with all statutory obligations.
Penalty : Under Section 26(6) WC Act 1952 (Act 273)
Any employer who fails to cover their foreign workers under this scheme will be liable, if found guilty, a fine of an
amount not exceeding RM20,000.00 or imprisonment for a period not exceeding two (2) years OR Both.
Failure to report the employment accident shall render the employer guilty of an offence under Section 13(5) of
the Act and shall be liable to a fine not exceeding RM5,000.00 for the first offence, and a fine not exceeding
RM10,000.00 for any subsequent offence.

5.2 As soon as the workers arrive in Malaysia, they must be covered under this scheme. This scheme is only applicable as long as
the workers are in Malaysia

5.3 As soon as the Employer fills up the proposal form and pays the required premium, the cover will be effected. The policy and
Identity Card for each worker will be given to the Employer within 10 days after the cover takes effect.

5.4 This policy is limited while the workers are in Malaysia only. The policy immediately becomes null and void as soon as the
worker leaves Malaysia.

5.5 Normal diseases are not covered under this policy. However, workers may be allowed to make claims if it is proven that the
disease suffered is connected or resultant from the work that is being performed.

5.6 The FWCS is mandatory even if employers are already in possession of other policies.

5.7 The FWCS only covers legal foreign workers.

This list is non-exhaustive. Please refer to the policy contract for the terms and conditions under this policy.

6. What are the major exclusions under this policy?


• Normal exclusions, i.e. committing suicides, contravening the laws of Malaysia, drunks caused by alcohol or drugs, dangerous
sports, etc.
• Common law liability
This list is non-exhaustive. Please refer to the sample policy contract for the full list of exclusions under this policy.

7. Can I cancel my policy?


• FWCS may be cancelled of specific reason and refund on premium will still have to be subject to minimum premium.
Provided the original document must be returned.
• You may notify us in writing your new contact details via your agent or to our nearest Branch.

8. What do I need to do if there are changes to my contact details?


It is important that you inform us of any change in your contact details to ensure that all correspondences reach you in a timely
manner.

Skim Pampasan Pekerja Asing
LEMBARAN PENDEDAHAN PRODUK

1. Apakah yang ditawarkan oleh produk ini?


• Skim Pampasan Pekerja Asing (SPPA) disediakan untuk melindungi kepentingan dan kebajikan semua pekerja asing di
Malaysia. Skim ini menawarkan manfaat bayaran pampasan kepada pekerja asing yang memiliki dokumen pekerjaan yang
sah bagi kecederaan yang dialami disebabkan kemalangan yang berlaku kerana menjalankan kerja atau pada waktu kerja
atau jika berlaku kematian akibat kemalangan.
• Akta Pampasan Pekerja 1952 telah dipinda pada Ogos 1996 – Seksyen 26(2) Akta Yang Dipinda mewajibkan setiap majikan
menginsuranskan semua pekerja asing yang diambil bekerja oleh mereka bagi sebarang liabiliti yang mungkin berlaku di
bawah Akta Pampasan Pekerja 1952.

Zurich General Insurance Malaysia Berhad adalah salah sebuah syarikat insurans panel yang dilantik dan diluluskan oleh
Sumber Manusia untuk menaja jamin Skim Pampasan Pekerja Asing (SPPA).

2. Apakah perlindungan / manfaat yang diberikan?

Kematian Akibat Kemalangan : 1. Sehingga RM25,000.00 (Pampasan Pekerja sehingga RM18,000,


Syarikat akan membayar jumlah tambahan RM7,000) – Sekiranya
kematian Pekerja Asing Yang Diinsuranskan adalah akibat kecederaan
diri disebabkan oleh kemalangan pada waktu kerja.
2. RM23,000.00 – Sekiranya kematian Pekerja Asing Yang Diinsuranskan
adalah akibat kecederaan diri disebabkan oleh kemalangan selepas
waktu kerja.
Hilang Upaya Keseluruhan Kekal : Sejumlah RM23,000.00 sekiranya berlaku hilang upaya keseluruhan kekal
dalam masa 12 bulan selepas kemalangan
Hilang Upaya Separa Kekal : Sejumlah wang berasaskan jumlah utama RM23,000.00 dikira menurut
Jadual Pertama Akta Pampasan Pekerja (Pindaan) 1996.
Hilang Upaya Keseluruhan Sementara : Sejumlah wang dikira menurut Seksyen 8 (e) Akta Pampasan Pekerja 1952.

Perbelanjaan Perubatan : Menurut peruntukan Akta Pampasan Pekerja 1952

Penyakit Pekerjaan : Seperti dinyatakan dalam Jadual Kedua Akta Pampasan Pekerja 1952

Perbelanjaan Penghantaran Pulang : Perbelanjaan penghantaran pulang adalah perbelanjaan sebenar yang
ditanggung atau RM4,800.00 yang mana lebih rendah, untuk pengangkutan
Pekerja Asing Yang Diinsuranskan ke negara asal sekiranya beliau meninggal
dunia atau mengalami hilang upaya keseluruhan kekal.

3. Berapakah premium yang perlu saya bayar?


Premium : RM72.00 setiap pekerja
Anggaran jumlah premium yang anda perlu bayar ialah RM _________________
Minima Premium: RM35.00 setiap polisi

4. Apakah yuran dan caj yang perlu saya bayar?

5. Apakah antara syarat-syarat dan peraturan penting yang saya patut ketahui?
5.1 Yang Diinsuranskan dan Orang Yang Diinsuranskan hendaklah menunaikan semua kewajipan berkanun.
Denda : Di bawah Seksyen 26(6) Akta Pampasan Pekerja 1952 (Akta 273)
Mana-mana majikan yang gagal melindungi pekerja asing mereka di bawah skim ini boleh didakwa, jika didapati
bersalah, boleh dikenakan denda tidak melebihi RM20,000.00 atau hukuman penjara bagi tempoh tidak melebihi
dua (2) tahun ATAU kedua-duanya.
Kegagalan untuk melaporkan kemalangan pekerjaan boleh menyebabkan majikan didapati bersalah melakukan
kesalahan di bawah Seksyen 13(5) Akta dan boleh dikenakan denda tidak melebihi RM5,000.00 bagi kesalahan
pertama, dan denda tidak melebihi RM10,000.00 bagi sebarang kesalahan seterusnya.

5.2 Sebaik sahaja pekerja tiba di Malaysia, mereka mesti dilindungi di bawah skim ini. Skim ini hanya berkuatkuasa selagi
pekerja berada di Malaysia

5.3 Sebaik sahaja Majikan mengisi borang cadangan dan membayar premium yang dikehendaki, perlindungan akan berkuat
kuasa. Polisi dan Kad Pengenalan untuk setiap pekerja akan diserahkan kepada Majikan dalam masa 10 hari selepas
perlindungan berkuatkuasa.

5.4 Polisi ini terhad kepada tempoh pekerja berada di Malaysia sahaja. Polisi serta-merta terbatal dan tidak sah sebaik sahaja
pekerja meninggalkan Malaysia.

5.5 Penyakit biasa tidak dilindungi di bawah polisi ini. Walaubagaimanapun, pekerja boleh dibenarkan membuat tuntutan jika
dapat dibuktikan bahawa penyakit yang dihidapi adalah berkaitan atau berpunca daripada pekerjaan yang dilakukan.

5.6 SPPA adalah mandatori sekalipun jika majikan sudah mempunyai polisi lain.

5.7 SPPA hanya melindungi pekerja asing yang sah.

6. Apakah pengecualian penting di bawah polisi ini?


• Pengecualian biasa, iaitu membunuh diri, melanggar undang-undang Malaysia, mabuk disebabkan oleh alkohol atau dadah,
sukan berbahaya, dan sebagainya
• Liabiliti undang-undang biasa

7. Bolehkah saya membatalkan polisi ?


• SPPA boleh dibatalkan atas sebab tertentu dan pembayaran balik premium masih tetap tertakluk kepada premium minimum.
Dengan syarat dokumen asal mesti dipulangkan.
• Anda boleh memaklumkan kami secara bertulis mengenai maklumat hubungan baru anda melalui ejen anda atau
Cawangan kami yang berhampiran.

8. Apakah yang perlu saya lakukan jika terdapat pertukaran dalam maklumat hubungan saya?
Adalah penting bagi anda untuk memaklumkan kepada kami tentang sebarang pertukaran dalam maklumat hubungan anda
untuk memastikan semua surat sampai kepada anda tepat pada masanya.
