Sub : Rectification of defects under the Contract

Dear Sir,
This has reference to PTC Letter cited above.
PTC’s contention of heavy downpour, water logging on terrace, littering of users etc. are not
contractual remedies for defective works.
There are serious defects/damages to be rectified by PTC at Bridge of DLCC. A comprehensive list
of those defects/damages is attached herewith as Annexure – 1 which needs to be rectified
immediately.
The DLCC Contactor is herewith directed to rectify the defects/damages at the earliest and submit
the compliance report to this office.
Notwithstanding the occupation of premises by the Employer and/or use of the Employer of the
premises, the Contractor shall remain liable for the fulfilment of any obligation incurred under the
provisions of the Contract give prior to the issue of the Completion Certificate which remains
unperformed at the time such Completion Certificate is issued to the PTC and DLCC and/or to be
issued, for the purposes of determining the nature and extent of any such obligation, the Contract
shall be deemed to remain in force between the Parties. The Employer may subsequently, extend
the commencement of defects notification period.
