Promulgated: May 8 x— x Lp as RESOLUTION No. 10538 Chairman Commissioner Commissioner WHEREAS, Section 34 of Republic Act No. 93691, amending Sec. 26 of Republic Act No. 7166, provides that the Commission on Elections (Commission) shall determine the dominant majority party, dominant minority party and ten (10) major national parties which shall each be entitled to one (1) official watcher in every polling place and canvassing center; WHEREAS, the Commission issued Resolution No. 10514 on 25 March 2019 which provides for the rules and regulations for the filing of petition for accreditation of the dominant majority party, dominant minority party, ten (10) major national parties and two (2) major local parties for purposes of the 13 May 2019 National and Local Elections; 1 An Act Amending Republic Act No. 8436, Entitled “An Act Authorizing the Commission on Elections to Use an Automated Election System in the May 11, 1998 National or Local Blections and in Subsequent National and Local Electoral Exercises, to Encourage Tranparency, Credibility, Fairness and Accuracy of Elections, Amending for the Purpose Batasang Pambansa Blg. 881, as ‘Amended, Republic Act No. 7166 and Other Related Election Laws, Providing Funds Therefore and for Other Purposes” 2 An Act Providing for Synchronized National and Local Elections and for Electoral Reforms, ‘Authorizing Appropriations Therefore, and for Other Purposes. & Page 2 of 11 Dominant Majority, Dominant Minority, Ten Major National Parties and Two Major Local Political Parties WHEREAS, pursuant to Republic Act No. 9369, the Commission shall furnish the dominant majority party and dominant minority party with copies of the election returns and certificates of canvass; WHEREAS, pursuant to Resolution No. 10514, nine (9) national political parties timely filed a petition for accreditation as a dominant majority party, dominant minority party or as major national party, namely: 1. AKSYON DEMOKRATIKO 2. Lakas Christian Muslim Democrats (LAKAS-CMD) 3. Laban ng Demokratikong Pilipino (LDP) 4, Liberal Party (LP) 5. Nacionalista Party (NP) 6. National Unity Party (NUP) 7. Partido Demokratiko Pilipino Lakas ng Bayan (PDP LABAN) 8. United Nationalist Alliance (UNA) 9. Workers and Peasants Party (WPP) WHEREAS, eleven (11) local parties filed a petition for accreditation as one (1) of the two (2) major local parties in their respective regions or provinces or cities: 1. Arangkada San Josefio Political Party (ARANGKADA) for the San Jose Del Monte City, Bulacan; .Asenso Manilefio Movement for the City of Manila; . Bileg Party for the Province of Ilocos Sur; Hugpong ng Pagbabago (HINP) for Region XI; . Hugpong sa Tawong Lungsod (HUGPONG) for Davao City; . Malayang Kilusan ng mga Mamamayang Zambalejio (MAKIMAZA) for the Province of Zambales; 7. Partido Abe Kapampangan (PAK) for Angeles City, Pampanga; 8, Partido Navoteno for the Navotas City; 9. Serbisyo Sa Bayan Party (SBP) for Quezon City; 10. Sulong Dignidad for Makati City; and 11.Unang Sigaw (PARTIDO NG PAGBABAGO) for the Province of Nueva Ecija aekeEV WHEREAS, on 29 April 2019, the Nationalist People’s Coalition (NPC) and Kabalikat ng Bayan sa Kaunlaran (KABAKA) filed a petition for accreditation as a major national party and petition for accreditation as one of the two major local parties, respectively. 4 Page 3 of 11 Dominant Majority, Dominant Minority, Ten Major ‘National Parties and Two Major Local Political Parties NOW, THEREFORE, the Commission on Elections, by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, and other pertinent laws, RESOLVED, as it hereby RESOLVES to promulgate the evaluation process for the accreditation of the DOMINANT MAJORITY PARTY, DOMINANT MINORITY PARTY, TEN (10) MAJOR NATIONAL PARTIES AND TWO (2) MAJOR LOCAL PARTIES; Criterion No. 1: “(a) The established record of the parties, coalition, or groups that now compose them, taking into account, among other things, their showing in the past elections” ‘This factor is equated with the history of the political parties or the number of years they have been in existence since 1987, the effectivity of the 1987 Constitution. Using 32 years as the equivalent of 10 points or 100%, the mean was arrived by adding together the number of years of existence of the ten (10) political parties mentioned above. The sum is 248. The sum was divided by ten (10) (the number of political parties under consideration) and the resulting quotient is 27.56 years, the mean or average corresponding, to 50% of 10 points. To determine the points for each political party, the following procedure was adopted: (1) Ifa political party’s existence is less than (or equal to) the mean, the ratio between the number of years of existence and the average (27.56), multiplied by 50% yields the percentage to be credited to the party. The number of points earned will then be this percentage multiplied by 10 points. (2) If the period of existence is more than the mean (or 27.56 years), the difference between the number of years of existence and 27.56 over the difference between 32 and 27.56 multiplied by 50% yield the percentage to be credited to the party for its year of actual existence in excess of 27.56 years. The 50% corresponding to the first 27.56 years of existence are then added to arrive at the total percentage to be credited to the political party. Thus, the Office of the Senators, 5.50 points; Members, House of Representatives, 5.00 points; Governors/Vice-Governors, 4.00 points; Mayors/Vice-Mayors, 3.50 points; and Members, Sangguniang Panlalawigan/Panlungsod/Pambayan, 2.00 points With the above data, the formula used to credit points to a political party, is the ratio between the number of incumbent elected officials claimed or listed by a political party divided by the maximum number of - Page 6 of 11 Dominant Majority, Dominant Minority, Ten Major National Parties and Two Major Local Political Parties positions authorized to be elected nationwicle, multiplied by the maximum points allotted to each category of positions. Letiit be noted that although the total umber of provinces (81) is not included in the total number of local geographical units as divisor, this formula grants the political parties bonus for each provincial chapter, equivalent to a city municipal chapter. This criterion recognizes that the strength and the national reach of a political party is its organization at the city/ municipal level. ‘The formula in arithmetic expression is: ‘Total Number of Municipality / City / Provincial Chapters Number of Points — X points = Earned by a Political Total Number of Party Municipalities and Cities However, after careful scrutiny of the respective records, the Commission finds that these political parties failed to submit a verified/ verifiable data and information needed by the Commission to determine the existence of their respective organized chapters. Hence, in order to determine if a petitioner has an existing organized chapter, considering the urgency in resolving petitions filed under Comelec Resolution No. 10514 and the time constraints in verifying the existence of all of petitioners’ respective organized chapters, the Commission took into consideration the fact that a petitioner was able to field a candidate in a city/ municipality they are claiming to have established organized chapter. nutes 1. It appears that the party that obtained the second highest rating was selected as the Dominant Minority Party. I respectfully submit that the Dominant Minority Party should logically come from the minority, that is, a party that belongs to those that stand opposite the majority. It must be understood in the context of the Dominant Opposition Party described under Section 274 of the Omnibus Election Code, to wit: Section 274, Accreditation of dominant opposition party. ~ xxx the dominant ‘opposition party shall be that political party, group or organization or coalition ‘of major national or regional political parties opposed to the majority party which has the capability to wage a bona fide nationwide campaign as shown by the extent of its organization xxx Obviously, the second most dominant party would not necessarily belong to the minority. The purpose of determining which are the Dominant Majority and Minority Parties is to ensure fairness in treating contending or opposing political groups. This purpose will not be served if the Dominant Minority Party also comes from the majority. Thus, I submit that the process should first involve determining which parties belong to the majority and to the minority.
