Demand Letter - Trust Receipt Agreement

The lawyer writes a demand letter to Mrs. __________ regarding trust receipt agreements for several pieces of jewelry entered with client AAA. Under the agreements from August 2018, the jewelry was entrusted to be sold for cash and proceeds given to the client, but to date the client has received neither proceeds nor unsold jewelry despite demands. The letter formally demands that within 5 days, any proceeds from sold jewelry be handed over and any unsold jewelry be returned to the client through the lawyer. DEMAND LETTER - TRUST RECEIPT AGREEMENT

Dear Mrs. ______________:

I am writing you regarding the Trust Receipt Agreements over several pieces of
jewelry which you entered with my client AAA, to wit:

August 1, 2018 Php 150,000.00

Under the Trust Receipt Agreements as aforementioned, the pieces of jewelry


were entrusted to you by my client and you were allowed to sell the same for cash
for my client’s account and you have the obligation to hand to her the portion of
the proceeds from the sale of the jewelry. To this date, my client tells me that you
have not given the proceeds of the sale of the said jewelry to AAA nor have you
returned the unsold jewelry to her despite repeated oral demands on her part.

For this reasons, formal demand is hereby made upon you to hand over
any and all proceeds of the jewelry sold by you and to return to my client
all unsold jewelry covered by the said Trust Receipt Agreements within five
(5) days from receipt hereof.

As this matter has already been endorsed to my law office, any communication in
response to this demand letter should be coursed through to the undersigned
lawyer.

Your failure to hand over the proceeds of the sale of the jewelry and to return any
unsold jewelry within the time given would be construed as an abject refusal on
your part to comply with your legal obligation under the law. If we will not hear
from you within the five day period, we will be constrained to file criminal
complaints for Estafa as well as other appropriate criminal and civil cases
against you to protect and enforce the rights of my client.
