EXECUTIVE ORDER NO. 04


Series of 2017

REGULATING THE MANUFACTURE, SALE, DISTRIBUTION AND USE OF


FIRECRACKERS AND OTHER PYROTECHNIC MATERIALS IN THE MUNICIPALITY
OF ITOGON.

WHEREAS, section 16 0f the Local Government Code empowers Local


Government Units to enact measures for the enhancement of public health, safety and
convenience, maintain peace and order and promote the general prosperity of its
inhabitants;

WHEREAS, despite the advocacy campaign spearheaded by the Department of


Health and the Philippine National Police against the use of firecrackers during Christmas
and New Year celebrations, incidence of firecracker-related injuries including
structural/grass fires continue to occur every year;

WHEREAS, there is a need to protect our inhabitants from the damaging and
harmful effects of firecrackers and other similar pyrotechnic materials through the
adoption of preventive measures;

NOW THEREFORE, by virtue of the powers vested in me as Local Chief


Executive, I, ATTY. VICTORIO T. PALANGDAN, Municipal Mayor of the Municipality of
Itogon, Benguet Province, hereby ORDER as follows, to wit;

Section 1. Coverage. This ORDER shall cover the manufacture, sale, distribution,
possession, use and explosion of firecrackers and pyrotechnic materials within the
municipality of Itogon.

Section 2. Prohibited Acts. Subject to strict compliance with R.A. 7183 and its Revised
IRR, and in accordance with the safety guidelines established under DILG, DOH, DOF
and DTI Joint Memorandum Circular No. 01, series of 2014, the following acts are hereby
prohibited:

2.1. Manufacturing of firecrackers and other pyrotechnic devices without the


necessary Manufacturers Permit;

2.2. Manufacturing of firecrackers and other pyrotechnic materials elsewhere


within the municipality of Itogon unless such area has been designated by law or
local ordinance as a “Manufacturing Zone;”

2.3. Transporting firecrackers and/or pyrotechnic materials within the municipality


without any Permit to Transport;

2.4. Supplying retailers without the necessary Dealers Permit on the part of dealers
and selling firecrackers and pyrotechnic materials to the public without the
necessary Retailers Permit;

2.5. Storing, selling, dispensing and offering for sale any firecracker or pyrotechnic
materials elsewhere unless within an area duly designated through a municipal
ordinance as Firecracker and Pyrotechnic Zone pursuant to section 10.4.6.5 of the
IRR of R.A. 9154;

2.6. Sale, possession and use of firecrackers and pyrotechnic materials which are
specifically prohibited under R.A. 7183 and its revised implementing rules, and
those specifically prohibited as may be identified by the Philippine National Police;

2.7. Selling and offering for sale firecrackers and pyrotechnic materials to minors
below eighteen years of age.

2.8. Manufacturing, selling and using firecrackers and pyrotechnic materials using
sulfur and/or phosphorous mixed with chlorates, also known as “boga.’

Section 3. Exception. The conduct of a community fireworks display may be allowed in


a designated area for the benefit of residents but only during special occasions such as
New Year, Christmas Barangay/community Fiesta, Municipal Foundation Day
Anniversary, social gatherings and the like, subject to the following conditions:

1. That the permit to possess and display fireworks must first be secured from the
Philippine National Police;
2. That fireworks shall be conducted at a distance of one hundred feet (100 ft.)
away from people
3. That all fireworks shall be projected upwards;
4. That a responsible person at least twenty-one (21) years of age with adequate
knowledge of handling fireworks shall be assigned to supervise the fireworks
display;
5. That sufficient approved type of first aid and fire protection equipment shall be
on hand at the site during fireworks exhibitions, and
6. That the nearest fire station shall be notified at least two days earlier prior to
such exhibition.

Section 4. Continuing Advocacy Program. Personnel under the Municipal Health


Office and the Joint Inspection Team, in coordination with the DOH and the PNP shall
spearhead a relentless program on continuing IEC regarding the negative effects related
to the use, exploding or discharging firecrackers against the individual, the community
and the environment. Provided further that Barangay Officials shall help in the advocacy
campaign and shall likewise cause wide dissemination of this Order to their respective
areas of jurisdiction.

Section 5. Repealing Clause. All Executive Orders or parts thereof inconsistent herewith
or parts hereof are deemed repealed and/or modified accordingly.

Section 6. Effectivity. Order shall take effect immediately.
