In exercise of the powers conferred by clause (0) of sub-section (2) of

section 180 of the Electricity Act, 2003 (Central Act No. 36 of 2003) and sub-
regulation (1) of regulation 29 of the Central Electricity Authority (Measures
relating to Safety and Electric Supply) Regulations, 2010 the State Government;
hereby makes the following rules, namely:-

CHAPTER-I

Preliminary

l. Short title and commencement.- (1) These rules may be called the
Rajasthan Electrical Inspectorate (Formation of Technical Committee and Grant
of Licence, Competency Certificate to work and Permit to work) Rules, 2016.

(2) They shall come into force on such date as the State Government may, by
notification in the Official Gazette, appoint.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) "Act" means the Electricity Act, 2003 (Central Act No. 36 of 2003);
(b) "Certificate" means the certificate of competency granted under these

(c) "Chairperson" means the Chairperson of the Technical Committee;
(d) "Chartered Electrical Safety Engineer" means any person authorize by
the State Government under regulation SA of the Central Electricity
Authority (Measures relating to Safety and Electric Supply)
Regulations, 2010 to assist the owner or supplier;
(e) "Contractor' means Electrical contractor;
(f) "EHT"means the voltage class exceeding 33 KV;

 (g) "Electrical Installation Works" means all electric work on a new
installation or work in any way altering the capacity or character of an
existing installation, for the generation, transmission, storage or
distribution of electrical energy for all purposes in every type of
dwelling house, business premises, public building, factory and its
appurtenance, out houses and places of public entertainment and
gathering, whether supplied from a public electrical supply
undertaking or from power plant owned by Government or from private
plant or any sources of generation whatsoever;
(h) "Form" means form appended to these rules;
(i) "Government" means the Government of Rajasthan;
OJ "HT"means the voltage class above 650 volts and upto 33 kV;
(k) "Licence" means the Licence granted to Electrical Contractor by
Technical committee under these rules;
(1) "Member" means Member of the Technical Committee;
(m)"Permit" means the permit granted to work as Supervisor or Wiremen
or Chartered Electrical Safety Engineer upon meeting the qualifying
criteria as specified under these rules:
(n) "Fees" means the fees specified by the State Government for issue or
renewal etc, for Licence, Certificate and Permit from time to time:
(0) "SCC" means Supervisor Competency Certificate granted under these
ru les to work as Supervisor upon successfully qualifying in the
examination conducted by the Technical Committee or
body/institution appointed by the Government;
(p) "Schedule" means schedule appended to these rules;
(q) "Secretary" means the Secretary of the Technical Committee;
(r) "Supervisor" means an Electrical Supervisor granted with competency
certificate to work or permit to work under these rules;
(s) "Technical Committee" means the Technical Committee constituted
under these rules;
(t) "WCC" means Wiremen Competency Certificate granted under these
rnlps to work as Wiremen upon successfully qualifying in the
examination conducted by the Technical Committee or
body/institution appointed by the Government; and
(u) "Wireman" means an Electrical Workman granted with competency
certificate to work or permit to work under these rules,

(2) Words and expressions used in these rules but not defined in these rules
shall have the same meanings as assigned to them in the Act or Central
~ El.ectriCity Authority (Measures relating to Safety and Electric Supply)
/egulations, 2010,as thecasemaybe.

 CHAPTER-II

Grant of Licences, Competency Certificates to work and Permits to work,

Eligibility and Validity

3. Contractor's licence and eligibility conditions.- (1) There shall be four

classes of Electrical Contractor's licence, as specified in column 2 of Schedule-I.

(2) The licence shall be granted to a person, company or firm that meets the
following requirements:-
(a) It shall have an office in Rajasthan;
(b) It shall fulfils the eligibility as specified in column 2 of Schedule-I;
(c) It shall have staff in its employment, as specified in column 3 of
Schedule-I:
Provided that, owner of the company or firm can work as Supervisor
A class or Supervisor B class or Wireman if owner 1S eligible and possess
the certificate to work or permit to work as per these rules and in that
case the requirement of the staff shall be reduced to that extent only;
(d) It shall have in its possession the instruments as specified in
column 4 of Schedule-I; and
(e) It shall have solvency of the amount as specified in column 5 of
Schedule I. The solvency certificate shall be issued by the Tehsildar
or Nationalized bank mentioning the full name of contractor, firm or
company, with a validity of minimum period of five years,

(3) The scope of electrical installation works that can be undertaken by the
contractor in the State of Rajasthan are given in column 6 of Schedule-I.

4. Supervisor's Certificate of Competency to work and Permit to work as

Supervisor, Eligibility Condition.- There shall be two classes of Supervisors, as
given in column 2 of Schedule-II. Supervisor's certificate of competency (SCC) to
work or permit to work as Supervisor shall be granted to the candidates by the
followingmode:-

(a) Through examination: The candidate who possess the qualification for
appearing in the examination as mentioned in column 3 of Schedule-II and have
passed the examination conducted by the Technical Committee or
bodyjinstitution appointed by the C ::"::?mmentshall be granted a Supervisor's
certificate of competency (SCC)to work; or
(b) Without examination: The candidate who possess the qualification and
experience as mentioned in column 4 of the Schedule-II shall be granted a permit
to work as Supervisor.

»> 5. Wireman's Certificate of Competency to work and Permit to work as

~ Wireman, Eligibility Condition.- Wiremen's Certificate of Competency (WCC)to

, work or Permit to work as Wireman shall be granted to the candidates
following mode:-
by the

(a) Through Examination: The candidate who possess the qualification for
appearing in the examination as mentioned in column 2 of Schedule-III and have
passed the examination of Wiremen, conducted by the Technical Committee or
body / institution appointed by Government shall be granted a Wiremen's
certificate of competency (WCC)to work; or
(b] Without Examination: The candidate who possess the qualification and
experience as mentioned in column .3 of the Schedule-III shall be granted a
permit to work as Wiremen.

6. Permit to work as Chartered Electrical Safety Engineer, Eligibility

and condttfona-- (1) Permit to work as Chartered Electrical Safety Engineer shall
be granted to those who have the following qualification and experience:-

(a) Bachelor of Engineering or Bachelor of Technology in Electrical Engineering;

and
[b) At least five years of experience in operation and maintenance of electrica l
installations:

Provided that he shall not possess any electrical contractor' licence or SCC
to work, or permit to work as supervisor or WCCto work or permit to work as
wireman issued by the office of the Chief/Senior Electrical Inspector (HoD). In
case the candidate is already possessing such licences, certificates or permit,
he shall surrender the same before receiving the permit to work as Chartered
Electrical Safety Engineer.

7. Initial Validity of Electrical Contractor's Licence.- (1) Every licence

granted to Electrical Contractor under these rules shall have initial validity for a
period of,-

(a) five years for Private Limited and r-ubiic Limited companies;
(b) five years for Partnership firm; and
(c) ten years for Individual or Proprietorship firm:

Provided that there is a valid solvency certificate during the period.

(2)For Private Limited or Public Limited company, valid documentation for

change of directorship shall be submitted in the office of the Chief/Senior
*'- Electrical Inspector (HoD)within thirty days of such change during the validity
i~ neriod of licence, otherwise the licence shall become liable for cancellation.

 (3)For Partnership Firm, the validity of licence will ceased to exist in the event of
change in original legal entity to which the licence was issued. Valid
documentation for change of partner shall be submitted in the office of the
Chief /Bcnior Electrical Inspector (HoD) vithin thirty days of such change during
the validity period of licence, otherwise the licence shall become liable for
cancellation.

(4)For Individual or Proprietorship Firm, physical verification in the nearest office

is required once in every year from the date of issuance of the licence, failing
which the licence shall be deemed cancelled.

(5)Every 'C' Class Contractor shall have to apply for a fresh licence of any other
class other than the 'C' Class, after a period of five years from the date of issue of
the original Class 'C' licence.

(f))During the validity period for Class 'C' licence, it is deemed to be converted
into Class 'D' licence in case wireman or supervisor left the job under Class 'C'
contractor. If, the licensee has intimated to the office of the Chief/ Senior
Electrical Inspector (HoD)within seven days of Occurrence of such an event, he
will not be converted into Class 'D' automatically, provided he will employ
Supervisor and Wiremen, within 15 days.

8. Validity of Certificate and Permit of Sup(.rvisor and Wiremen and

Permit of Chartered Electrical Safety Engineer.- (1) Certificate or Permit of
Supervisor or Wiremen to work as S'upervisor or Wiremen, or Permit of Chartered
Electrical Safety Engineer to work as Chartered Electrical Safety Engineer under
these rules shall be valid until the certificate or permit holder, attains the age of
65 years. Provided the certificate or permit holder shall submit a medical
certificate of fitness, in Form-H, initially and thereafter once in every five years to
extend the validity of the certificate or permit.

(2)For Wireman, Supervisor and Chartered Electrical Safety Engineer of age

above CS Years, medical certificate: of llLllC;::';::', ill rorrn-H, from a Doctor of
Government Hospital shall be submitted on an annual basis in the office of Chief
Electrical Inspector/Senior Electrical Inspector (HoD) in order to extend the
validity of the certificate or permit.

CHAPTER - HI

 9. Submission of application.- (1) Application for Licence or Competency
Certificate to work or Permit to work shall be made to the Office of the
Chief/Senior Electrical Inspector (HoD) in Form-A or Form-B as the case may be,
along with required documents and fees specified by the State Government.

(2)Duly filled and completed application form shall be submitted personally or

through registered post to the office of Chief/ Senior Electrical Inspector (HoD)or
through online at the specified website of Government of Rajasthan and must be
accompanied with required documents and fees specified by the State
Government.

10. Documents to be submitted along with application form.- (1)

Application for grant of Licence shall be accompanied with following documents,
namely:-

(a) Specimen signature and three recent passport size coloured photographs (of
proprietor or partners or directors of the firm or company) with white
background showing the complete face of the applicant(s). The photograph on
the application form shall be attested by the Gazetted Officer;
(b) Demand draft in support of payment of fees for application;
(c] Solvency certificate;
(d) Letter of willingness obtained from Supervisor, Wireman with their full
signature with date along with the copy of Permit and SCC;
(e) The calibration certificate from accredited laboratory by the State
Government(s) or Government of India and proof of possession of the tools
and equipment mentioned under column 4 of Schedule-I;
(f) Self-attested copy of,-
[i] PAN card;
(ii) photo identity proof of the applicantis] issued by the State or
Central Government;
(iii) utility bill or bank passbook as a proof of address of business;
(iv) registered partnership deed (for partnership firm) or Memorandum
and Articles of Association issued by the Registrar of Companies
(for registered firms or company) and authorization letter (in
original) issued to the authorized signatory by the partnership firm
or company as the case may be;
(v) appointment letter of Supervisors and Workman signed by the
contractor with date; and
(vi) educational qualification.

 (i) Self-attested copy of work experience, if applicable; and
0J Medical certificate of fitness [see rule 13(3) of these rules]

(2) For grant of Certificate to work and Permit to work,-

(a) Specimen signature and three recent passport size colour photographs with
white background showing the complete face of the applicant. The
photograph on the application form shall be attested by the Gazetted Officer;
(b) Self-attested copy of certificate as a proof of technical qualifications and
experience, prescribed in these rules;
(c) Demand draft in support of payment of the fees specified by the State
Government for application;
(d) Self-attested copy of photo identity proof of the applicant issued by the State
or Central Government; and
(e) Medical certificate of fitness [see rule 8 of these rules].

Note: (a) Candidates are required to produce original certificates as and when
asked for, by the Technical Committee;
(b) Any document, facts mentioned in application or testimonial found to
be incurrect or counterfeit will be dealt accordingly as decided upon by
the Technical Committee.

11. Grant of Licence, Certificate and Permit.- (1) On receipt of complete

application along with requisite document, the Electrical Contractor's licence
shall be granted by the Technical Committee. ",ftpr inspection of tools and
appliances by the Electrical Inspector or any other member of his staff
authorized to do so and also on verification of documents furnished by the
candidate the licence may be granted. But, if inspectIOn is not possible within a
reasonable time, the Chairperson of Technical Committee may on
recommendation of Member Secret8.ry issue a provisional licence, information of
which shall be given to the Technical Committee as soon as possible for final
decision.

(2) Upon passing the examination conducted by the Technical Committee or

body/institution appointed by the Government for the purpose, certificate of
competency to work may be granted by the Technical Committee to Supervisor or
Wiremen, as the case may be.
(3) Upon meeting the qualification criteria and verification of documents
furnished by the candidate the permit to work may be granted to Supervisor,
Wiremen or Chartered Electrical Safety Engineer, as the case may be .

Grant of Duplicate Licence, Certificate and Permit.- (1) Application for
~ grant of duplicate Licence, Certificate or Permit shall be SUbmitted in Form-C.

 (2)A duplicate Licence, Certificate or Permit, as the case may be, granted under
these rules shall be issued on payment of the fee as may be specified by the State
Government.

13. Renewal of Licence, Certificate and Permit.- (1) Application for renewal
of Licence, Certificate or Permit along with proof of payment of fees prescribed by
the State Government, shall be submitted atleast one month before the date of
expiry to the office of Chief/Senior Electrical Inspector (HoD).

(2)Contractor's Licence granted to Private or Public Limited company or

Partnership Firm shall be renewed for a period of five years if there is no change
in legal entity of the company or Firm to whom licence was originally granted.

(3)Contractor's Licence for !ndividual or Proprietor Firm shall be renewed for five
years after the initial validity period. After the age of 65 years the licence is
required to be renewed annually, subjected to the medical fitness certificate
submitted by the applicant, in form-H, while making application.

(4)The Certificate or Permit, granted to Supervisor, Wiremen or Chartered

Eltctrical Safety Engineer as the case may be, shall be renewed as per the rule 8
of these rules.

14. Ca!lcellation or suspension of contractors' licence, Certificate and

permrt.. (1) The sub-committee, consisting of at least two members of the
Technical Ccmmittee out of which at least one member shall be among the
members as specified under clause (c) to (e) of sUb-rule (1) of rule 15, may at its
discretion cancel or suspend a contractor licence at any time,-

(a) if the person (or firm or company) to whom (or which) the licence is granted is
found unfit (Bankrupt or Incompetent) to hold the licence;

(b) if there is any change in the legal entity to which licence was originally
granted:

(e) on failure to submit quarterly return for two consecutive quarters; and

(d) on failure to comply with the condition provided in sub-rule (2) of rule 23.

(2) Permit of Charte-v--t Electrical Safety Engineer shall be liable for cancellation
or suspension by the sub-committee mentioned in sub-rule (1) above, in case of
his engagement in any malpractices or incorrect certification.

(3) If any person holding a certificate or permit grrmted under these rules, to
work as Supervisor or as Wireman, is found negligent of his duties or guilty of
~fringement of these rules or malpractices, the sub-committee mentioned in
. sub-rute (1), may suspend or cancel the certificate or permit.

 (4)No licence, certificate or permit shall be cancelled unless the facts warranting
cancellation are established in an enquiry conducted by an officer not below the
rank of Assistant Electrical Inspector in case of sub-rule (1) and (2) of rule 14,
and not below the rank of Junior Electrical inspLctor in case of sub-rule (3) of
rule 14.

(5)Appeal against the order of cancellation or Suspension of the licence,

certificate or permit done by the sub-committee, shall lie to the Technical
Committee and an appeal against a decision of the Technical Committee shall lie
with the Governmenr.
(6) Every suspension shall be for a maximum period of six months within which
it has to be revoked or the Licence, Certificate or Permit cancelled.

CHAPTER- IV

Formation of Technical Committee

15. Technical committee.- (1) The Technical Committee shall be consist of

the follmving, namely..

(a) ChiefjScni0r Electrical Inspector (HoD)

(b) Electrical Inspector/Assistant Electrical Inspector
- Member
(c) Principal, Industrial Training Institute, Secretary
nominated by the Gm,'ernment

(d) An officer having degree in Electrical

16. The functions of the Technical Committee.- The Technical Committee
shall perform the following functions:-

~ (i)To grant electrical contractor's Licence in form as may be prescribed by the

..Pi State Government;

~ijITO grant electrical supervisor's competency certificate to work and permit to

work as supervisor in form as may be prescribed by the State Government;

 (iii)To grant permit to work as chartered electrical safety engineer in form as
may be prescribed by the State Government:

(iv) To grant etecrricat wireman's competency certificate to work and permit to

work as wireman in form as may be prescribed by the State Government;

(v) To send recommendation to Energy Department, Government of Rajasthan

in the matter of designing and revision of the syllabus, conducting
examinations for electrical supervisors and wiremen and em any other
matter necessary for implementation of lhese rules arid resolving problems
if any;

(vi)To do other such work as the Government may direct from time to time in
connection with the enforcement of regulation of the Central Electricity
Authority (Measures relating to Safety and Electric Supply) Regulation,
2010 in the State; and

(vii) Enquire or to arrange to enquire into violation of any of the provision of

these rules on the part of Electrical Contractors, Chartered Electrical Safety
Engineers, Supervisors and Wiremen and to take appropriate action as
specified under these rules.

17. Meeting of the Technical Committee.- (1) The Technical Committee

shall hold a meeting as often as required but atleast once in three months, in
addition to any other meetings, as its "Technical Committee Review Meeting" to
discharge following functions:-

(a) Discuss and dispose the matter pending before the committee during such
period;
(b) Discuss and decide on the matters as specified under clause (v), (vi) and (vii)
of rule 16 as may be required; and
(e) Any administrative decision for which recommendation needs to be send to

(2)Technical Committee Review Meeting may be called by giving not less than
clear twenty-one days' notice either in writing or through electronic mode in such
manner as prescribed in these rules:

(3)Every notice of a meeting shall specify the place, date, day and the time of the
meeting and shall contain a agenda of the business to be transacted at such
meeting.

 (4)The Member Secretary shall inform the necessary details of the meeting to all
the members of the Technical Committee.

(5)Notwithstanding anything contained above. the first Technical Committee

Review Meeting, shall be held within a period of one months from the date of
formation of the Technical Committee.

18. Powers and functions of the Chairperson.- The Chairperson shall have
the following pO'\Ver and fU11ction,-

(i) to preside at all meetings of the Technical Committee, unless prevented by

reasonable cause.

(ii)to grant temporary contractor work permit as specified in note-l of Schedule-I.

(iii)to issue provisional licence on recommendation of Member Secretary, to the
contractors who are eligible and having request pending due to not holding of
Technical Committee's meeting. However, information of issuance of such
provisional licence shall be given to the Technical Committee as soon as
possible for final decision.

19. Power and Function of the Member Secretary.- The Member Secretary
shall :lave the following power and function

(i) to take all actions as required and considered necessary in connection with
committee's meetings, recording the proceedings of the meetings and all
correspondences in accordance with the decisions of the Committee;

(ii) to scrutinize all applications received for grant of permit to work as

Supervisor, Wireman and Chartered Electrical Safety Engineer and put upto
the committee for their consideration;

(iii\ <;:rn.ltinize all applications received for grant of electrical

licences and put upto the committee for their consideration;

(iv)to grant duplicate or renewed Licence to Electrical Contr-: ~+or. Certificate to

work for Supervisors and Wiremen and Permits to work to Supervisors,
IJVI ~ Wiremen and Chartered Electrical Safety Engineer as the case may be on
~ recommendation of the Committee;

(v)to countersign licences to electrical contractors and certificates to work or

permit to work to supervisors, chartered electrical safety engineers and
wiremen;

 (vi) to notify all electric supply companies, electrical contractors' association and
all other concemed party of all licence issued, suspended and cancelled;

(vii) to maintain the registers of Contractors, Supervisors, Wiremen and Chartered

Electrical Safety Engineer to whom licences, certificates and permits have been
issued by the Technical Committee; and

(viiijto do all other things as directed by the Chairperson or the Committee.

20. Timeframe for grant of licence to Contractor, Permit to Chartered

Electrical Safety Engineer and Certificates or Permit to Supervisors and
Wiremen.- (1) Licence, certificate and permit shall be issued within time
specified below:

(a) "A"Class contractor: Within ten days of receipt of complete application;

(b) "8" Class contractor: Within seven days of receipt of complete application;
(c) "C" Class contractor: Within seven days of receipt uf complete application;
(d) "D" Class contractor: Within seven days of receipt of complete application;
(e) Permit to work for Chartered Electrical Safety Engineer : Within five days
of receipt of complete application;
If) Permit to work for Supervisor: Within five days of receipt of complete
application.
(g) Permit to work as Wireman: Within five days of receipt of complete
application
(h) SCC to work: Within five days of passing the qualifying examination; and
(i) WCC to work: Within five days of passing the qualifying examination.

(2) In case of incomplete application, other than the case of non-submission of

application fees, the office of the Chief/ Senior Electrical Inspector (HoD) shall
inform the applicant regarding the deficiency within three days of receipt of such
application otherwise the application shall deemed as cornple+».

CHAPTER-V
General

~ 21. Provision for E-Governance.- (1) The office of the Chief/Senior Electrical
K"fJ) /llspector (HoD) is responsible for the grant of Licence, Certificate or Permit
/ ~nder this rule shall enable electronic delivery of services in one year from the
date of commencement.

 (2) Notwithstanding the provisions given in Chapter-II, Chapter-III and Chapter-
IV, in order to enable e-services, the office of the Chief/Senior Electrical
Inspector (HoD) may, at any time, by order, require that an application or a
communication, order or certificate or payment or the like rela~_;d to the grant of
Licence, CertificClte or Permit under these rules shall be made or issued in
electronic form.

(3) To facilitate e-governance as above, the office of the Chief/Senior Electrical

Inspector (HoD) may change the provision or procedure given in Chapt~r-II,
Chapter-III and Chapter-IV to such extent that it is inconsistent or incompatible
with electror:ic forms of communication and payment and such change shall not
invalidate any action for the mere reason that it is repugnant to the procedural
provisions of these rules.

22. Responsibilities of Electrical Contractors.- (1) Test certificate in form-F

has to be signed by the supervisor under whose supervision the work has been
carried out, has tested the installation and found the work satisfactory and of
good quality. It shall be countersigned by the licenced contractor who has
employed such supervisor. Without which contractor shal1 not iasu- completion
certificate for any work to the supplier or consumer or owner or occupier.

(2) Electrical contractors shall intimate to the secretary in writing within the
period specified below as to every change of the following for updating the data:-
(a) Address of the place of business within seven days of such change;
(b) Director(s) in case of private limited or public limited company within thirty
da_v;:"and
(c) Mobile or Telephone number within seven days of such change.

(3)Contractors shall be personally responsible for the work carried out by its
employees.

23. Submission of Retums.- (1) The contractor shall submit return on

quarterly basis in form-D.

(2) The contractor shall submit any other information as may be required by the
office of Chief/Senior Electrical Inspector (HoD).

24. Staff of contractor.- (1) Contractor may engage apprentices for training
purposes in which case the total number of apprentices employed by any
contractor at any time shall not exceed 25% of his total wiring staff:

Provided that the contractor shall not permit such apprentices to carry out
any electrical installation work including additions, alterations. repairs and

 adjustments to existing installations covered by sub-regulation (1) of regulation
29 of the Central Electricity Authority (Measures relating to Safety and Electric
Supply) Regulation, 2010 except under the direct supervision of a person holding
a certificate of competency and 'Ander the guidance of at least one certified
wireman on the premises.

(2) Every contractor shall maintain a register of all supervisors, WIremen and
apprentices in Form-E and such register shall be opened for inspection, at any

25. Production of Licenece, Certi:Qcate and Permits.- (1) The holder of a

licenece, certificate or permit shall produce it for inspection on demand by the
Electrical Inspector or his representative or by the consumer or owner for whom
he is working or proposed to work.

26. Non-Transferability of Licence, Certificate and Permit.- (1) Licence,

Certificate and Permit are non-transferable.

27. Repeal and saving.- (1) Save as othenvise provided in these rules, the
Conditions and Rules for the Grant of Certificates of Competencv to Electrical
Supervisors, & Wiremen and Licences to Electrical Contractors in che State of
Rajasthan, 1956 as amended form time to time is hereby repealed.

(2) Not\\iithstanding such repeal, anything Jone or any action taken under the
said Conditions and Rules shall be deemed to have been done or taken under the
corresponding provisions of these rules.
