MOTION TO REVIVE

Private Complainant, through undersigned counsel, unto the


Honorable Labor Arbiter, respectfully state that:

1. On __________________, previous counsel of the Private


Complainant ___________ received an order from this Honorable
Court dated ___________, provisionally dismissing the instant case
with the express conformity of the accused upon motion by the
counsel for the accused invoking the constitutional right of the
accused for the speedy disposition of the cases filed against her.

2. Said previous counsel failed to appear on the hearing


date scheduled and as such an Order was released by this Honorable
Court provisionally dismissing the instant case.

3. Private Complainant is still very much interested to


prosecute this instant case and as such has engaged the services of
the undersigned counsel.

PRAYER
WHEREFORE, premises considered, it is respectfully prayed that
the Honorable Court that the Order dated _________ be set aside
and that the instant case against the accuse be revived.
