Legal Writing

•  Any legal document must be concise, clear and engaging

•  Two types of legal writing:

•  The first type requires a balanced analysis of a legal
problem or issue
•  The second type of legal writing is persuasive

In the context of legal writing, a good writing means

writing that promotes the readers’ ability to make the
important decisions legal readers need to make in the
course of their professional duties.
Legal writing
•  Clarity
•  it is only when writing is clear that the reader
can accurately comprehend the writer‘s message
and use that infor mation to facilitate
professional decision-making
•  clarity requires proper (i.e., conventional)
grammar and punctuation
•  Use ordinary words
•  Use simple sentence structures
Legal writing

•  Concise
•  Concise writing is efficient writing
•  Concise writing means conveying the
appropriate level of details
•  Concise writing is writing that is as succinct
as possible without unduly restricting the
amount of information conveyed
Legal writing

•  Engaging
•  No matter how sound your reasoning, if it is presented in a dull and
turgid setting, your hearers—or your readers—will turn aside. They
will not stop to listen. They will flick over the pages. But if it is
presented in a lively and attractive setting, they will sit up and take
notice. They will listen as if spellbound. They will read you with
engrossment

•  readers will not want to keep reading a

document, no matter how clear and concise
it is, if it does not engage their interest
