CROSS-EXAMINATION

1) Padayao: You said in your direct exam that you were tasked to do patrol in Brgy. Saimsim, Calamba City on the
night the incident happened. Is that correct?

P: Yes

2) Padayao: And you have been assigned to do patrol work for 6 years now?

P: Yes. Ma’am.

3) Padayao: And how long have you been assigned in Brgy. Saimsim?

P: 1 year

4) Padayao Considering that you have been assigned for that long, you know by now that Brgy. Saimsim is quite a
large barangay?

P: Yes

5.) Padayao: Is it correct to say that since Brgy. Saimsim is a large brgy., a different outpost is assigned per purok?

P: Yes

6. ) Padayao: Is it right that the scene of the crime is not within the purok where you were assigned since it is in
Purok 4 and you are in Purok 1?

P: Yes.

7.) Padayao: So you were beyond your jurisdiction?

P: Ahhm. Yes.

8.) Padayao: Moving on, you said in your direct exam that you heard a scream?

P: Yes

9) Padayao: and that scream happened while you were outside the vicinity of the place of the incident
P: Yes

10) Padayao: Could the scream that you heard warrant a regular police officer to proceed to the crime scene?
P: Yes

11) Padayao: And when you proceeded inside you said that the accused approached you, is that right?
P: Yes

12) Padayao: and he surrendered himself to you?


P: Yes

13) Padayao: But you said awhile ago in your direct exam that you arrested him? So which is which? Or is that
contradictory to the fact that he surrendered himself?

Padayao: Your honor with your permission my co-counsel would continue the cross-examination.

14) Colina: So let me just clarify this, he surrendered himself and confessed that he was the one responsible for the
crime as a way of defense of the person of Grandma and Red?
P: Yes

15) Colina: So why did you say in your direct examination that you arrested him?
P: I meant in that statement that after he confessed to the crime, I accompanied him to the police station

16) Colina And where did this happen?

P: Near the house of Red and Grandma

17) Colina Is this confession in writing?


P: No. it was a verbal confession.

18) Colina How far is this house from the crime scene?

P: Around 30-minute walk from the crime scene.

19) Colina Was he informed of his Miranda Rights?

P: Yes.

20) Colina In what language?

P: In English and Tagalog to make sure he understood it.

21) Colina: So the fact still stands that he voluntarily surrendered to you after committing the act?

P: Yes.

22) Colina: After the voluntary surrender, did anything else happen?

P: Yes. In fact, Mr. Kater admitted that he attacked Wolfy but according to him, he did it to save Grandma and
Red because Wolfy was allegedly attacking them at that time.

23) Colina: Who were the persons present at this point?

P: Me, my colleagues, Red, Grandma, and Kater.

24) Colina Where did this confession take place?

P: At the police station.

Colina: Your honor with your permission my co-counsel would continue the cross-examination.

25) Ramos: Ms. Witness, you testified earlier that Mr. Katter said “justice has been served”, correct?

P: Yes

26) Ramos: You consider this a confession?

P: Yes

27) Ramos : This took place after the arrest, correct?


P: Yes, sir after informing him of his Miranda Rights.

28) Ramos: To who was he talking to when he uttered, “justice has been served”?
P: He said it to me, sir.

29) Ramos But was he able to discuss with his lawyer before uttering those words to you?
P: No, sir. There were no available lawyers at that time.

30) Ramos Did he execute an Affidavit his “confession”?

P: No, sir.

31) Ramos Did you spend any time to find a lawyer for him?

P: Yes, sir. We already contacted PAO so that they will find a lawyer to assist Mr. Katter but he decided to find a
lawyer after the investigation.

32) Ramos Okay, given those circumstances, you proceeded with the interrogation?

P: Yes, sir.

33) Ramos: And, again, he told you, “justice has been served”?

P: Yes, sir.

34) Ramos He said this with a complete understanding of the rights you discussed to him, correct?
P: Yes, sir.

35) Ramos On to another point, Ms. Witness, you said you saw the lifeless body of Mr. Lobo on the floor at the
crime scene, yes?
P: Yes.

36) Ramos The corpse of Mr. Lobo had a hack wound on the left side of the neck, as you said, correct?

P: Yes.

37) Ramos What is the size of this hack wound?

P: It was probably the same size as a bladed weapon.

38) Ramos Does your description match the axe and Autopsy Report you previously identified?

P: Yes.

39) Ramos Other than the wound, were there any other marks you found to describe the body?

P: None.

40) Ramos So, there was only one wound?

P: Yes.

41) Ramos: Only on the neck area?

P: Yes.
