PETITION
Petitioner, through the undersigned counsel unto this Honorable Court,
hereby respectfully state: That -
1. Petitioner is of legal age, married, Filipino and resident of Avida Verti
Tower 1, 9 avenue, corner 34th street, Bonifacio Global City, Taguig City where he can

be served with summons and other processes of this Honorable Court;
2. That petitioner is the testator in the last will and testament of RHEA
MELISSA R. LAT dated October 15, 2018 (photostatic copy only), hereto attached and
marked as Annex “A” and made an integral part of this petition, the original thereof to
be presented to this Honorable Court at the time of the probate;
3. That the aforementioned last will and testament was executed in
accordance with the formalities of the Republic of the Philippine;
4. That the subscribing witnesses to the will are: HERMES FORTUN, of legal
age, single, Filipino and a resident of Century Residences, Makati City; ARTEMIS
GONZALES, of legal age, married, Filipino and a resident of Rockwell Phase 2, Pasig
City; ATLAS BIENVENIDO of legal age, married, Filipino and a resident of 23 Alabang
Village, Muntinlupa.
5. That testator, at the time of execution of said will, was 52 years old, of
sound and disposing mind, and not acting under duress, fraud, or undue influence and
was in every respect capacitated to dispose of his estate by will.
PRAYER
WHEREFORE, premises considered, it is respectfully prayed for that this Court
that judgment be rendered declaring that, upon proper notice, publication and hearing,
the abovementioned will of petitioner RHEA MELISSA R. LAT be approved, allowed and
admitted to probate.
Other reliefs and remedies that are just and equitable are also prayed for.

Verti Tower 1, 9th avenue, corner 34th street, Bonifacio Global City, Taguig City, hereby

2) That I have caused the preparation of the above petition and I have read the
same and understood the contents thereof;
3) That the allegations contained therein are true and correct of my own personal
knowledge and based on authentic records.
4) That I further certify that: I have not theretofore commenced any other action or
proceeding or filed any claim involving the same issues or matter in any court,
tribunal, or quasi-judicial agency and, to the best of my knowledge, no such action
or proceeding is pending therein; if I should thereafter learn that the same or similar
action or proceeding has been filed or is pending before the Supreme Court, the
Court of Appeals, or any other tribunal or quasi-judicial agency, I undertake to report
such fact within five (5) days therefrom to the court or agency wherein the original
pleading and sworn certification contemplated herein have been filed.
