Peremptory law is a jus cogens and the fact that it is applicable to all irrespective of state
compliance is erga omnes. State’s duty to observe the fundamental principle of humanity do not
rest on reciprocity or on maintanenace of a perfect contractual balance beween rights and duties
bu have acquired he weight of jus cogens peremptory law endowed with special legal force
which is valid for all erga omnes with no exceptions and from which no opting out or derogation
is possible. The result of this development is tha states can longer hide beind sovereignty and
