Incident: On Monday, May 15, 2017 at 5:53 p.m., I, Sheriff Green was dispatched to the South Charlotte
Target parking lot, to investigate a report of a young male supposedly using marijuana in his car outside the
store. I met with Mr. Todd Kelly after spotting the suspected car, and asking him to exit the vehicle. He was
possessing under a oz, so a misdemeanor was given along with a ticket and a court date.
Detail of Event:
Kelly told me he was waiting for someone to exit the store, so they could get something to eat. I had a suspicion
this was a false statement from smell of marijuana that was very noticeable as soon as I exited my squad car. I
confronted the man about it and told him I knew that he had possession or just recently used marijuana in his
vehicle and requested to search the vehicle. At that time, Mr. Kelly was very compliant and told me he had about
an 8th of an ounce of marijuana in the center console of the vehicle. I then retrieved the substance, packaged it
and gave Mr. Kelly a ticket for possession of under Oz of marijuana and waited for his wife to come pick him
up because he was slightly under the influence. He then told me he had a problem and would voluntarily attend
substance abuse classes, he also specified he attended the DARE program in the 5th grade.
Actions Taken:
Mr. Kelly had committed a crime and was rightfully deserving a punishment but only ticket for possession was
given which will result in a misdemeanor based on the attitude and overall compliance of Mr. Kelly, he held
absolutely no threat to my safety in my opinion. I then asked Mr. Kelly to call someone to come pick him up from
the parking lot because he seemed slightly under the influence at the time. His wife arrived 15 minutes later, I
thanked Mr. Kelly for his cooperation and sent him on his way.
Summary:
Mr. Kelly was reported using marijuana in his vehicle outside of some outlet stores. I approached the vehicle
and asked him to roll down his window, then to exit the car. Marijuana was obviously present, so I asked him to
search the vehicle based on this premise. He then confirmed there was marijuana in the vehicle and specified
the location. A possession ticket was distributed, and he was picked up by his wife. Just out of curiosity, I asked
Mr. Kelly when his drug abuse had begun and he said it started in middle school, shortly after he finished the
DARE program and progressively got worse throughout his youth into his 20s.
