In section 44 of article 7 of the Solid Waste Management Principles
and Practices, it states that the local government should establish a
common waste treatment and disposal facilities in order to
segregate waste. Each city, municipality and barangay should make
the effort to address common solid waste management problems.
Common waste disposal facilities are important in order to
segregate the waste produced by the community.
In Section 49, Fines and Penalties, any person who violates section
48 shall be convicted and be punished and will be fines with an
amount not less than three hundred pesos (300 Php) but not more
that a thousand pesos (1000 Php) if not they shall render
community sevice for one to fifteen days. Anyone who violates
section 48 par 4,5,6, and 7 shall be punished and fined one
thousand to three thousand pesos or shall be imprisoned from 15
days to 6 months. Anyone who violates paragraph 8, 9, 10, and 11
for the first time shall be fines five hundred thousand pesos plus 5%
- 10% of his or her net annual income. Those who violate paragraph
9 and 10 for the second time or subsequently, shallhave an
additional penalty of 1 to 3 years imprisonment. The violators of
paragraph 12 and 13 shall be fined with an amount of ten thousand
pesos (10 000 Php) to two hundred thousand pesos (200 000 Php)
or 30 days to 3 years imprisonment. Anyone who violates paragraph
14, 15, and 16 shall be fined 100 000 Php to 1 000 000 Php or shall
be imprisoned for 1 to 6 years.
In section 50, Those local government officials or those who work in
government agencies who did not not comply with and enfore the
rules and regulations which are related to this act shall be
administratively charged in agreement with RA 7160 and other laws
existing.
