SENTENCING MEMO
COMES NOW Benjamin W. Allen, III, pursuant to M,R.C.C.C.P, Rule 11.01, and files
this Sentencing Memorandum and for good cause would request the Court fo enter a sentence
and judgement of probation.
INTRODUCTION
1. A description of the offense and the circumstances surrounding if, not limited to
ispects developed for the record as part of the determination of guilt;
Mr, Allen was indicted for eight (8) counts of embezzlement. ‘The indictment charged
that Mr, Allen embezzled property belonging to Downtown Jackson Partners, Inc, He was also
indioted for one (1) count of making a false statement to a government entity for a “fraudulent
business incubator.” The tenth (10") count alleged Mr, Allen contributed in excess of $1,000.00
to a political campaign or party, The Jury found Mr, Allen not guilty of nine (9) counts and
guilty of one (1) count (Count 4) involving his wife’s cell phone line, which the Board of
Directors of Downtown Jackson Pariners, Ine, allowed on their cell phone plan, Mr. Allen had
reimbursed Downtown Jackson Partners for all charges connected with his wife’s phone, but the
jury nevertheless returned this guilty verdict. The Court is well acquainted with the facts and
other issues in this case so they will not be recited.2. Any prior criminal convietions of the defendant, or juvenile adjudications of
delinquency:
Mr, Allen has no prior criminal record of any kind,
3. The defendant's financial condition;
Mr, Allen received a salary from Downtown Jackson Partners, Inc., in approximately
$150, 000.00 per year. He is not indigent,
4, The defendant’s educational background;
5, A description of the employment background of the offender, ineluding any military
record and including present employment status and capabilities;
6 ‘The social history of the defendant, ineluding family relationships, marital status
and residence history:
Mr, Allen was born on Decomber 16, 1950 at the Vicksburg Hospital in Vicksburg
Mississippi. His mother, Ann Lois (Menger) Allen, was a native of Vicksburg, Mississippi, and
his father, Benjamin Wade Allen, Jr, was a native of Hamburg, Arkansas, moving to Vicksburg
to begin employment with the U.S. Army Corps of Engineers shortly after the end of World War
II, where he served in the Army as a Captain stationed in the Philippine Islands.
Mr, Alllen was the second of four (4) children, with an older sister Ginger (2 years), a
younger brother Hogan (3 years) and a younger sister Kim (10 years). He attended public schools
in Vicksburg his entire childhood and graduated from H.V Cooper High School in 1968. Mr.
Allen was active in high school activities and enjoyed many extracurricular organizations, such
as the Boy Scouts, where he attained the rank of Eagle Scout at age 14, and earned the "God and
Country Award". During the time he lived in Vicksburg, Mr. Allen was involved in his
church, First Baptist Church of Vicksburg, Mississippi, and was baptized, accepting Jesus Christ
as his Lord and savior, at the age of nine. At First Baptist Church, Mr. Allen also participated in
the church youth choir, and was a leader in the youth leadership group, Summers were filled withLittle League baseball, Boy Scouts, and church camps and ell things "normal" for a boy growing
up in the late 1950's and early 1960's. In 1964, he attended the Boy Scout National Jamboree in
Valley Forge, Pennsylvania,
Mr. Allen had a good home life, with some of his fondest memories of his childhood
were learning to fly fish with his father, impromptu campouts, lnunting behind his home, and
sports of all kinds. As he grew up in Vieksburg Mr. Allen attended Carr Junior High School,
where he was active in many activities; he was the starting wide receiver in football and involved
in student government, After graduation from junior high, he attended H.V, Cooper High School,
involved in a host of activities
‘was captain of the track team, played varsity football, and was
including a role in the senior play “Oliver”, the Fellowship of Christian Athletes, the Glee Club,
and a long list of many others.
Graduating in 1968, he attended Mississippi State University, where he graduated in 1973
with a double major in Business Marketing and Political Science. While a student at MSU, Mr.
Allen was a member and leader of Pi Kappa Alpha fratemity, a varsity cheerleader, and worked
summers as an inspector for the US Army Corps of Engineers, Mr. Allen met his current wife,
Susie Moore of Starkville, in college and they have been married for 41 years. They have been
blessed with two (2) dedicated sons, Matthew Wade Allen, a partner and attorney with the law
firm Brunini, Grantham, Grower and Hewes (in their Jackson office), and Clayton Allen, a
medical doetor at the Vanderbilt Medical Center, Matt and his wife Megan West Allen have a
daughter, Hartley (17 months).Clayton, and his wife Christine, have a son Joseph (2 4).
After he graduated from MSU in 1973, Mr, Allen was commissioned a Second
Lieutenant in the US Army and was stationed at Aberdeen Proving Ground, Maryland. He was
honorably discharged after his 8 years of service, either active or reserve, as a First Lieutenant.He then entered the employment world as a marketing specialist for Shell Oil Company in
Birmingham, Alabama,
Mr, Allen’s love for Jackson and Mississippi called him back home in 1975, He accepted
a sales position with Campus Supply Company, a regional manufacturing representative
company in its Jackson, Mississippi office. This company represented many school supply firms
such as the L.G, Balfour Company, Taylor Publishing Company, RM Hendrick Graduate Supply
Company, and others. In 1986, Ben was promoted as its sales manager.
After the premature death of the owner at that time and some management changes, in
1988 Ben purchased these franchises. He worked hard creating a successful organization
(Scholastic Products and Awards, Inc) with seven (7) sales representatives, 3 offices statewide
(and in Memphis) and many support staff employees. Mr. Allen ultimately sold all his interests
in his company to his employees. Today those employees have all been very suecessful and have
carried on the tradition of hard work, premier quality, and first elass customer service in all that
they or their employees do.
After he sold the majority of his businesses in 1997, Ben ran successfully for the Ward 1
representative to the City Council of Jackson, and was overwhelming re-elected two more terms,
He served as its City Council President in 2006-2007. In 2007, the Board of Directors for
Downtown Jackson Partners (DIP) hired Mr. Allen to serve as its President, DIP is a 501(c)(4)
(non-profit social welfare) Business Improvement District corporation focusing on the
betterment of our capital city in general and the downtown in particular, DJP exists to make
Jackson a better place to live,
While Mr. Allen's children were growing up in Jackson, he was involved in the
community, serving as a deacon at First Baptist Church, a member of the church choir, a seniorhigh Sunday school teacher, and for five (5) years was the Scoutmaster of Troop 8, which was
the largest Boy Scout troop in the state, Troop 8 has over 150 scouts and is the longest
continually chartered scout troop in the nation, Both of his sons attained the rank of Eagle Seout,
and eamed the “God and Country” award while he served as their scoutmaster. He also coached
their soccer and baseball teams continually during their childhood and adolescence and was a
member of their high school Booster Club Board of Directors.
Mr, Allen has been involved in scores of boards and commissions through the years. This
included the Mississippi Symphony, The Central Mississippi Planning and Development District,
pi Advisory Committee for the US Commission
the Mississippi Municipal League, the Mis
of Civil Rights, the Jackson State University Presidential Search Committee, The Rotary Club of
Jackson (where he also served as its President), Hospice Ministries, the FBI Citizens Academy,
and a long list of others.
Mr, Allen is proud of the many accomplishments of DIP and its Board of Direetors,
including the Block-by-Block Ambassador program, the Capitol Street Renaissance project, the
$1 Billion in redevelopment and capital improvements downtown, ‘These are projects that DJP
helped promote and facilitate, including King Edward, Standard Life, Federal Courthouse,
Walthall, The Piaza, Tombigbee Lofts, 308 Electric Building, Gartin Supreme Court Building,
the Muscum of Mississippi History, the National Civil Rights Museum of Mississippi, The South
Warchouse, the Smith Park renovation, and more,
Mr, Ben Allen and his wife Susie live in Jackson, Mississippi and reside at 2517
Meadowbrook Road. They are faithful members of Christ United Methodist Church, where Susie
has been a long time academic tutor to inner city children and is co-chair of the community
outreach “Meals on Wheels” efforts delivering hot food to the less fortunate weekly.7. Information about environments to which the offender might return or to which the
offender could be sent should probation be granted;
Mr. Allen has a strong family and community environment. Attached are copies of
Seventy-Six (76) letters from friends, family members, and others in the community who
support Mr, Allen, More letters may be offered later. With probation, Mr, Allen would continue
10 live his life and serve in his community.

‘Not applicable, since Mr. Allen has no drug or alcohol substance abuse problem.
9. A physical and mental examination of the defendant if the Court orders it,
None ordered.
CONCLUSION
Mr, Allen’s attorneys believe there are errors, which will require this ease to be reversed
for a new trial or, more likely, that Mr, Allen’s charges case will be “reversed and rendered”.
‘The appeal process may take two (2) years to complete. Mr, Allen is a proper candidate for
probation. He has no prior criminal record, He has a diverse group of community supporters who
do not believe incarceration is in the “best interests of justice.” Mr. Allen has been a valuable
member of the Jackson Community for most of his life, and the offense amount is low.
Therefore, counsel for Mr. Allen moves the Court not to impose any sentence of incarceration.

| am writing this letter on behalf of my friend and colleague Ben Allen, president of Downtown
Jackson Partners and one of our community's true public servants.
‘As the longest tenured resident of Downtown Jackson and president of Jackson’s Downtown
Neighborhood Association, | have had the opportunity and privilege of working clesely with Ben
as we've striven to improve Jackson’s central business district forall of the citizens of our state,
In that time, | have come to know Ben as a man of character, integrity and honesty. And | do
not use these words lightly.
| was raised to believe that a man’s true heart is found in the good works he leaves behind for
others to follow and to use in their own quests for success. Ben's heart is found in each of the
projects that he’s spearheaded to bring forth the renaissance that Downtown Jackson is now
enjoying. From the rebirth of historic Smith Park to the two-way reconstruction of Capitol
Street, Ben has served as a shepherd to see these endeavors to completion.
Because of his efforts ~ and the dedication, honesty and character they demand I can say,
without hesitation, that Ben is a man to be applauded rather than convicted of a charge to
which even the most jaded among us can see he is not guilty.
I hope you will take my heartfelt testament into consideration as Ben comes before the court
for sentencing and restore this good man to our community where he’s needed most.

Ben for ten years and have always been impressed with his unwavering support and
enthusiasm for the city of Jackson,
In his role as city councilman, he was always a voice of reason, a person who could look at all
sides of a problem and work with other councilmen for the betterment of the city.
‘As President of Downtown Jackson Partners, he worked tirelessly to promote our capital city
and to reinvigorate it by bringing more businesses into our downtown. | have found him to be
a forthright, honest and sincere individual who throws himself into whatever job or task he is
involved. | do not, for one moment, believe that he could, or would, embezzle money from an
organization that he was so proud of,
These past many months have been a nightmare for Ben and his family as he hashad to endure
charges that were subsequently proved to be groundless. The final charge is groundless as well.

| am Ben's brother in law, married to Susie's oldest sister. | am a retired vice president
for Mississippi Power Company and recently completed eleven years as a trustee on
the board of trustees of the Institutions of Higher Learning. | have been a witness in a
Federal grand jury in Atlanta and so have some understanding of how the system
works. Marilyn and | live in Gulfport and have been married for 64 years today as | sit
here and tried to put my thoughts together. We knew Ben when he was dating Susie.
We can't imagine what Ben, Susie, Matt, and Clayton have had to endure all these
many years since there charges were brought. It breaks our hearts as we have
observed the toll on each of them as they go through this travesty. It never should have
happened. We know that Ben has documentation showing that Susie's cell phone
expenses were fully reimbursed as they were incurred. We implore you to dismiss this
one charge and bring this to a merciful end.
Susie and Marilyn come from a very close knit family of six siblings, children of a dairy
farmer in Starkville. It is family that frequently gets together to share life's experiences
and a family that supports each other. Therefore, we have had many opportunities and
occasions to witness the love Ben and Susie have for each other and for their two fine
sons. We have enjoyed listening to Ben, Matt, and Clayton recount stories about
scouting, school-especially sports, church, hunting and camping, family trips, and many
other activities. We know that Ben was actively involved in these activities as a coach,
scout leader and in other leadership roles. We know that Ben served three terms on the
Jackson city council. | grew up in that environment as my father was the public works
commissioner for the city of Gulfport for 24 years and therefore understand first-hand
the pressure public life can put on a family. We have enjoyed listening to Ben tell us
with pride and excitement the accomplishments of the Downtown Jackson
Partners, We know he has worked extremely hard to keep downtown Jackson vibrant. |
value Ben's judgement. | often sought his advice relative to higher education matters in
the greater Jackson area

Through my work as a business owner, social entrepreneur, college professor and community
developer, | have been associated with Mr. Ben Allen for over twenty-five years. The Ben Allen
I know is above reproach. The Ben Allen, | know has:
* Worked with me in forming the Jackson Chamber of Commerce}
© Served asa lecturer to the West Jackson Leadership Academy, a group I developed to
grow young business and community leaders in West Jackson;
© Physically supported the Penguin Restaurant and Koinonia Coffee Shop by patronizing
both places and directing other patrons there;
* Supported many of my social causes; and,
© Helped me research the feasibility of securing an athletic arena for downtown Jackson.
In short, I can think of no one who has been a greater cheerleader for Jackson and its diverse
communities than Ben Allen.
Judge Kidd, | understand that Mr. Allen isto be sentenced shortly. And, I have no first-hand
knowledge of the events that precipitated the finding of guilt and his sentencing hearing.
However, | am keenly aware of the value Ben has contributed to Jackson, specifically. Thus, |
appeal to you to grant him the lowest possible sentence that the law allows.

Since I moved back to Mississippi in 2010, after being born, raised and educated in Mississippi, I have
had the opportunity to work with Ben Allen and Downtown Jackson Partners on many projects related to
engineering and inftastructure in the downtown area. I have enjoyed getting to know Ben and have
‘worked closely with him on many projects in the downtown area. In my experience with Ben, he has
demonstrated that he is a leader and a champion of the revitalization of downtown Jackson. My opi
is that Ben is an honest person, with integrity and commitment to helping the community. Ben works
elessly to promote and defend Jackson and to find ways to improve the community. Ihave watched
him work with city council, public citizens and property owners to improve Jackson.
Thate to see Ben have embezzlement charges against him for something that was proven not to be a
crime, Ihope that you will see that Ben has not committed a erime, and let him go without punishment.
We need people like Ben working in our community to make it a better place. I consider Ben a friend of

Judge Kidd:
As a board member and the former executive director of TeamJXN, | am writing today to
speak to the character of Ben Allen and the positive influence he has had on me personally,
‘as well as on the City of Jackson.
TeamJXN is a 504(c)(3) organization that showcases growth and positive momentum rising
up in Jackson. Mr. Allen, who spearheaded the organization from its early days and served
as chairman of the board, saw the need for a passionate group of cheerleaders in Jackson
‘whose purpose was to support and lead efforts to ensure good things (events, programs,
etc.) happen in the city. The organization encourages business owners, developers and
entrepreneurs to work, play and live in Jackson.

the position myself, | have had the privilege of seeing his leadership firsthand within the

ability to “preach” an inspiring message of hope for our city in large group settings, Ihave

My relationship with Ben Allen began around 35 or more years ago when we lived close to one another
in the Heatherwood area of Jackson and had children about the same age attending schoo! together.
‘Our paths crossed on many occasions. Ben was the Scoutmaster of Boy Scout Troop 8 at our church and
‘my son was a participant in that troop with one of Ben's son, ultimately receiving his Eagle rank. For a
while Ben and his family also went to the same church as our family.
Ben was the City Council representative for many years for the area where my family still ive in Jackson.
| remember the difficulty of serving in that position at that time and how well he dealt with the serlous
issues of that time. If he wanted to be corrupt, there was plenty of opportunity for that to ozeur asit did
with some of his fellow council members during that time. Yet the FBI found him totally clean and
above board, My path has continued to cross with Ben's as he has led the Downtown Jackson group
now for a number of years. | have been in many meetings with him while serving on various committees
for the Greater Jackson Chamber Partnership as he would represent the Downtown Jackson Partners.
When we opened our location on Larson Street in 2008, | asked Ben to come and share his thoughts
about Jackson to our guests and factory representatives. He did an excellent job of communicating and
promoting our community.
| mention all of these relationships over the years to give some evidence that | have known, observed
and been around Ben Allen and his family in many different settings for over three decades. The actions
and behavior of Ben Allen today is no different to me than it was when | first met him. Everything | have
‘observed is that he has lived a consistent life built along biblical values and that truth, honor, and doing
the correct thing is real and important to him. He is someone that cares greatly about Jackson. He is,
someone that cares greatly about our youth. He is someone whose word is his bond. It is extremely
hard for me to raconelle how a jury could return a verdict on even one count against him over an
integrity issue. That isnot the Ben Allen | know.

Most people who have lived in the city of Jackson over the past 40 years have moved away to Madison County or Rankin
County. But not Ben Allen — because he eares what happens to Jackson.
Many people who still live in northeast Jackson have all but abandoned gi
complain or stay at home and try to build walls to bunker themselves in the
ought to be. But not Ben Allen — because he eares what happens to Jackson,
any concem about Jackson's future. They

Ben gives back when he doesn’t have to do it. After building a successful business in Jackson, Ben decided to give back
serving on the city council. Ben’s fellow councilmen could see the tireless effort he put in to council business. No one
would have guessed that an African-American majority of the Jackson City Council would elect « white, northeast
Jacksonian as council president. But they did because Ben Allen showed he eared about what happens to Jackson.
‘One of the “charges” made against Ben centered on the Downtown Jackson Partners’ efforts to create an atmosphere of
helping small business in the form of an incubator. I brought the idea of an incubator to Ben and he immediately jumped
con the idea. After conferring with his board, Ben leapt at the chance to give budding entrepreneurs and small business
‘owners the skill sets they needed to sueceed.
This was not a part of DJP’s original mission but when Ben saw how successful incubators had been across the country,
he could immediately imagine how one could work for Jackson. Ben put countless hours into the formation of the
community board (chaired by former US Secretary of Agriculture Mike Espy) and to help raise the funds necessary to get
the incubator started. Why? Because Ben eares what happens to Jackson,
‘When Parkway Properties pulled out of Mississippi and out of downtown, the incubator lost is primary funder and our
location and we had no cheice but to fold it. Attimes fundraising was very difficult and Ben wanted to be sure he did
everything possible to see itsueceed, So much so, that he personally wrote a $13,000 check to pay bills. Why? Ben
Alllen cares about Jackson.
Ben understands public trust and public scrutiny and public accountability, He understands he is accountable to a board
and what his role is: make downtown Jackson al it can be as Mississippi capital city, I've seen him do that in his role as
President of Downtown Jackson Partners.

| have known Ben since approximately 1977 when he entered my classroom in Mount Olive as an enthusiastic,
‘earnest, and fresh-faced yearbook representative. Asa young man, Ben was memorable in that he was so intent on
treating his clients with respect, and he recognized and accommodated the urgency that comes with that particular
type of publishing. There was never a call or request that he didn’t personally attend to, We always cheered up when
Ben visited; his infectious laugh and genuine likeability were truly encouraging to all he touched, And, | knew his word.

government, always smiling and moving. | was just someone who “knew him when.”
‘That changed when we showed up at the same Leadership Jackson orientation in 1998, There he was again —
happy, kind, a breath of wholesome fresh air. That program has a way of creating siblings of the classmates, and that’s
‘what happened to our class. We learned from and about each other. We learned to depend on each other, and, we
learned a whole lot about life in Jackson. | believe it changed Ben's outlook on how he could be the best leader he
could be. | saw him tenderly considering the sad circumstances that many brave, poverty-stricken Jacksonians were
striving so hard to overcome. He was affected in ways that, | believe, ultimately informed his effort to revitalize our
Capital City through Downtown Jackson Partners.
The very idea that he would be accused of doing anything illegal at all is completely contrary to the Ben Allen
have known for so many years. Some people just are not wired to scheme and commit a crime; | believe that Ben is
‘one of those people. I can't imagine his ever trying to figure out a way to obtain something that wasn't his.
While | recognize that he was indeed accused and is, n fact, convicted ofa crime, itis my humble request that

Ben Allen is someone I have admired greatly as a husband, father, son, businessman
and a public servant. He has been a good friend to my family and me and has lived
his life and conducted himself in the business world with the utmost integrity. His

I write this letter in support of Ben Allen as a fellow citizen, a lawyer for well over a
decade, and his oldest son. It is difficult to know precisely where to begin.
siate confidently at the outset that | believe him to have been an upstanding,
contributing member of society and in a very meaningful sense, and that our community has
been and is a better place for his having been in it, I'l further state confidently that I believe
his actual innocence, which further underscores what would be the true tragedy and incre
injustice of sentencing him to even a day in prison. I also believe that Miss. Code Ann. § 97-11
25 does not eves apply to him because Downtown Jackson Partners oversees private money, and
therefore, any sentencing of time to prison for an alleged violation of an inapplicable statute
would be unconstitutional. | say that respectfully, but that is what I believe to be the case.

My father, who I will simply refer to as Ben for purposes of this letter, has been the type
of loving, active, caring father that most children are not fortunate enough to have. I am very
grateful for the role he has played in my life. He had a very busy professional life as my younger
brother and [ grew up in Jackson, but somehow found the time to be aetive in our lives. He was a
Sunday School teacher, He was a soccer coach, He ran the press: box for my high school baseball
team, He was a Scoutmaster at Troop 8, First Baptist Chureh Jackson, where, with his guidance,
both my brother and | eventually obtained the rank of Eagle Scout,
In his capacity as Scoutmaster, he counseled countless youth from Jackson in helping
them become productive members of society. I cannot think offhand of any of those young men
who have not gone on to productive careers as doctors, lawyers, businessmen, and the like, and
they number in the hundreds, He led weekend campouts in Mississippi once a month; hiking,
trips at Philmont Ranch in New Mexico; scuba diving trips at Scout Sea Base in the Florida
Keys; and canoeing in Minnesota, Outside of Seouts, he, along with « handful of other fathers,
regularly took groups of our peers on outdoor trips for hunting, fishing, and hiking, always going
out of his way to make those whose fathers could not attend feel weleome and comfortable:

Ben stressed education for my brother and me. Clayton, my younger brother, attended
Ole Miss and briefly thought of a legal career and attended Columbia Law School for a year
before deciding to turn to medicine, Ben fully supported Clayton in that transition that was, at the
time, a difficult move. Clayton went on to graduate medical school from UMMC, did hi
residency in internal medicine at the University of Vinginia Medical Center, where he was the
Chie Resident for a year, and this summer finishes his fellowship in hematology/oncology at
Vanderbilt University’ Meclical Center. He has aeeepted a job in Mississippi, and will begin work
in Hattiesburg teating patients with eaneer beginning this summer. It is impossible to predict
how many countless lives in Mississippi Clayton will impact in his profession. Ben's fathering
made that possible, He was there for me, too, supporting and encouraging me through
Mississippi State University for undergraduate school, Millsaps College for a master of business
administration, and ‘The University of Texas School of Law for my law degree, 1am now a

nearby deer camp. On numerous occasions Ben invited Derick to Jackson to stay at our house.
He would take Derrick to our high school baseball games andl teach Derrick about how to run the
press box. Derrick was a good, smart kid from a very rough background, and Ben was making &
concerted effort ‘0 provide him some direction. That really stuck with me, He even attempted to
have Dertick enroll in The Piney Woods School, but never could convince Derrick’s mother.

Tam writing this letter in support of my father-in-law, Ben Allen. I have known Ben for six
‘years and have been lucky enough to be his daughter in law for almost four years, To be part of
the Allen family is to be truly blessed, From the moment I met Ben, he has welcomed me with
arms wide open. His warmth and kindness were apparent from the start and his happiness for his
son, Clayton, and me was truly heart warming. In the six years that I have known Ben, it has
become very obvious to me that this is a man who loves God, his family, and the state of
Mississippi-particularly Jackson.
Ben is an example of what it means to be a true Christian, He truly walks the walk, He is
generous with both his time and his money. He has helped both friends and family in times of
financial and emotional hardships, never looking for anything in return, Recently when my
family and I were visiting Jackson, I learned that Ben was spending countless hours with a friend
whose spouse was dying of cancer. He was late coming home from work and I assumed that he
‘was just staying late to get some work done but he was actually visiting his friend in the hospital
to offer support during a time of great need. He took time out of his week every week to do just
this, When my extended family has faced hard times, Ben always asks me how they are doing
and if he can do anything to help. Through Clayton and Clayton's friends, I have heard
numerous stories of Ben helping different people in the community. He does these things
because he is a good man who has a true servant’s heart, Ben always says the blessing for our
family before we eat a meal together, and I remember one time in particular him saying, “May
all that we do bring praise and glory to your name.” This had an impact on me at the time and
now I realize that this is exactly how Ben lives his life,
Ben's love for his family is immeasurable. All you need to do is walk in his home to see this. It
is filled with pictures of his children and grandchildren. His phone screen for as long as I can
remember has been a funny picture of my son with a “boo boo” on his nose. His love for Susie
and Matt and Clayton is beautiful to witness. He still refers to his wife of 41 years as “my bride”
and his face literally lights up when telling old stories of going on camping trips and to baseballgames with his sons, My husband has countless stories of fun things that he did with his dad and
his hope for doing those things with our son one day. Whenever I hear these stories, I can’t help
but think what a wonderful childhood and life Ben has provided for his children. Now, he has
extended that love to me and to my son, Joseph. I knew that he and Susie would love their
grandchild, but I could never have imagined just how much, Ben beams with pride when talking
about Joseph and he ean never say enough how much he has loved being a grandfather. He can’t
‘wait until my son is old enough to take him on fishing trips and Clayton and I can’t wait for them
to experience that together. Ben and Susie have helped Clayton and me more times than I can
remember at the drop of a hat, We truly know that we are never without help if needed as long
as they are in our ives. Most recently when I thanked Ben for his help he simply said, “This is
‘what you do for your kids.” That's just the kind of man he is. He desires to help others without
even thinking twice about it.
Thave often told Susie that I am so thankful to her and Ben for raising my husband to be such a
‘good man. A man that loves God and his family, a man that is kind and does the right thing, a
‘man that ean be depended upon and a man who wants to be remembered for being a good person
and for what he did for others. My husband is the man he is today in very large paut because of
Ben Allen who is an example of so much of what it means fo be a good man, I am so thankful to
have him in my life
Ben also has a deep love for the state of Mississippi, He fondly remembers growing up in
Vicksburg and his time at Mississippi State and he traly enjoys sharing his vast knowledge of the
history of the stale, He has put this love into action as he has devoted so much of his time to
making Jackson a better city. He frequently works long hours and receives cals late at night
‘when someone in the city needs help. I have never once heard him complain about this. Ben did
not need to work at Downtown Jackson Partners, he wanted to. He wanted to use his time and
his skills to make Jackson a better city for its residents. He desires to make things better for
those around him, whether itis his family or a stranger on the street. ‘There is no doubt in my
mind that Ben did not commit any crime while working as the President of DJP. Itis simply not

the charges brought against Ben to determine if there was any truth to the indictment. I am
thoroughly convinced Ben is innocent of all the charges.
Working with Ben for so many years, Ihave seen how cating Ben is. On numerous oecasions, he
has asked me how my wife and kids were doing. When I have boasted about my boys playing
soccer, Ben has told me a number of times that this is one of the best times in my life. He
recalled how he enjoyed watching his sons play little league baseball and ree soccer and seeing
them grow from little boys to men is something he will always treasure, Ben is also an extremely
thoughtful person, Tle made sure to know the names of all the regular guards in our building and
revealed to me that Centry who had worked in private security for over 20 years was retiving
earlier this year. Ben made it a point to focus on little things like that,
Normally, I would be explaining to you that Ben regrets his actions, but in this case, [ cannot, As
have said before, I believe Ben is innocent of all the charges he was indicted of. I believe the

L write today in support of my dad, Ben Allen. For as long as I can remember, he has been the
best man I have ever known, There is simply no way on earth that I can put into words what he
means to me and to all of us blessed enough to have him in our lives, but I will do my best.
‘To start, he is such a kind, honest, and generous man. He has always helped out those in need,
and when he does he never asks for anything in return nor does he ever publicize his generosity.
In fact, I only know about most of his acts of kindness because some of those he has helped have
Jet me know, I am certain there are many things he has done for others that I do not know about,
but even still I could fill up pages with stories about the people he has helped with his generosity.
I will give a few examples.
At our high school there were two foreign exchange students, David from Sweden and Renicr
from South Africa. They came to this country without any friends or family or really any money.
My dad saw their struggles and immediately helped them. He invited them to our house for
dinner, bought them clothes, bought them sporting equipment so they could play baseball, and
ceven invited them fo come on family trips with us, He helped them both find colleges to attend,
But even more than any of that, he gave them a sense of family away from home and a father
figure they could depend on, Even after high school, he remained in their lives. I know my dad
and David still keep in touch, and David is now in the ministry.
Another example is my aunt who has long battled financial trouble and trouble in her personal
life, She has never had to fight that battle alone as time and time again my father has done
whatever necessary to ensure she has the help she needs. There was also a woman named
Dorothy and her boy, Derrick, who we met where we used hunt in Lexington, MS. His family
\vas crippled by poverty, so my dad helped raise money to build them a new house at no cost to
them whatsoever.His generosity extends into his friendships. Recently I attended a cancer fundraiser where an old
friend from high school came up to me and asked if I could speak with her. Her mother was
slowly dying of brain cancer and was at home on hospice, her physical and mental abilities
‘fading, She told me how heartbreaking and earth shattering this was for her dad, then went on to
tell me that she thanked God for my dad because of the kindness he had shown to her father. 1
found out that day that my dad had reserved one night weekly to wipe everything off his
schedule and to go to their house and spend the evening with him, He would bring a couple of
steaks to cook and more than that, he would just spend time with someone in need oF friendship
and in need of someone to talk to, His kindness literally brought my friend to tears as she told
‘me. And he did all of this all of this while going through his own personal struggles with his,
indictment and impending trial.
I could continue on about his kindness and generosity, but I will not belabor the point,
His involvement in the community is well known. He gave up a large portion of a very
successful business to be on the city council because he desired to make Jackson a better place,
He has stayed involved for that same reason. As thousands of people have left the city to move to
mote affluent areas with less crime, he has declined. As thousands of people refuse to get
involved but instead find comfort in their cozy lifestyles, he has insisted on involvement. He
does this not because he needs to but because he loves Jackson and wants to make ita better
place for all of its citizens,
[ would also like to talk a moment about my dad as a husband of 41 years to my beautiful
mother, In an age of broken up families and failed commitments, their love for and commitment
to each other is rock solid. Their marriage is the foundation of this family, and after 41 years of
navigating through the ups and downs of life together, their love for each other is stronger today
than ever. They have lived honest and just lives, and they deserve to live the rest of their lives
with each other, raising grandkids, continuing to teach me and Matt how to grow as people, and
walking hand in hand until God calls them home. They deserve that. My dad deserves that, as all
innocent and good men do,
Allow me to finisk by telling you what he has done for me. He was always very involved in my
childhood. Despite being incredibly busy while starting his own business, he always found time
to spend with me and my brother Matt. He helped coach our soccer teams and was the
troopmaster of our boy scout troop for years (meaning he would spend one weekend « month on
‘campouts with over 50 youths teaching us valuable skills about life and the importance of living
with principles). And while 1 could write you a list of countless examples of his involvement, Ithink more important is what he means to me, because I think only that can truly give you a
sense of who he is asa person.

the verdict, and as we waited I broke down and cried like a have not eried in many years,
overwhelmed at what this world can do to a good and innocent man, and terrified. Tervfied of
life without him. Terrified my son would not get to really know my father, or that he would only
know him as a maa in prison. Terrified my son would never learn the lessons from my dad that I
have, And still today I have this fear, and the idea that this good man may go away and be taken

Ihave known Ben Allen for over 40 years and he is as passionate, caring and
supportive of his family, friends and business associates as he is of the city of Jackson
and the state of Mississippi.
Iirst met Ben at Mississippi State University. We were students and fraternity brothers
together and | was always amazed at how energetic and positive Ben was. He was and
ig a natural born leader. His feelings for those he was around and engaged with was
genuine. Although | doubt that he realized it, everyone he met became long term
fiends and relished the opportunity to be around him. He met the love of his life at
Mississippi State and their life together defines what family is all about. His children
embody the cheracteristics of Ben and Susie and what an unbelievable gift to them,
their families and their communities.
‘After school, Ben built a terrific business by doing what he does best - genuinely caring
about his clients. It was never about “sales, it was about creating friendships and
providing what his "friends" wanted most. Ben was the perfect person to enter into
‘community service and he did it with the same amount of gusto, honesty and passion
that he exhibited in his service to his family and his clients. This community and state
has benefited greatly from the skills and talent that Ben brings to the table - every day,
every hour and every minute. |, along with everyone in this community, should be
grateful that people like Ben exist.
‘Watching Ben in the public eye was inspiring and I never thought | would have the
opportunity to work hand and hand with my friend and hero. | worked with Mississippi
Main Street fora good part of my professional career. | was working with Main Street
when Ben joined Downtown Jackson Partners(DJP). Downtown Jackson Partners
focused on revitalizing their downtown district. Mississippi Main Street did the same
thing throughout the state as a program of the National Trust for Historic Preservation
and the Mississippi Development Authority, Main Street and DJP was in discussions
about locating to a common location so we could take advantage of resources: and
talents for the betterment of communities throughout our state when John Lawrence,
Ben's predecessor, resigned to pursue an opportunity in Memphis. When the DUP
Board offered that position to Ben, | truly thought it was divine intervention.
Main Street and DUP shared office space for over 10 years in downtown Jackson.
it was a joy to come to work each day. The city of Jackson along with the slate of
Mississippi benefited greatly from the sharing and relationships generated in that office.
My staff was very good and worked together so well. Once DJP joined that equation,my staff took ona new look and passion. | attribute that to Bon. Just his presence and
commitment to people brought our staff and achievements to the next level. Every day |
watched Ben deal with existing businesses in downtown Jackson, prospecting new
ones, sharing information and expertise with owners and developers and trying to work
with what seemed like a never ending dysfunctional city government. Although there
were many who failed to take advantage of Ben's talent and passion, the city of Jackson
and this state enjoyed his desire to do his best for his hometown and state everyday he
came to work. | leamed so much watching Ben go through his day, leading his staff and
dealing with the trials and tribulations of city government. | never finished my day
without a true admiration for how Ben conducted his work life and his home life and my
work life and home life benefited greatly from watching and working with Ben.
This whole situation driven by a disgruntled employee and a misguided city servant has
been a travesty. Not just for Ben and family, but for our entire community. It has to
stop. It is my desire to see more talented and driven public servants prevail and right
the wrong that has been committed against Ben, his family and the Board of Downtown
Jackson Partners. The fate of this city hangs in the decisions that will be made in your

‘The intent of this letter is to describe my experience and relationship with Ben Allen. I met Ben when
‘working on a research project to determine the cost savings associated with moving the Department of
Revenue into The Landmark building downtown. The first thing that stands out about Ben s his passion
for Jackson, which was so contagious | sought him out to learn more about what was goingon
‘downtown and how | could help, Ben introduced me to Team JXN, a program he spearheaded to provide
‘people interested in supporting Jackson an opportunity to get involved. He encouraged me to join a
committee at Team JXN. | did, and this was where | really got to know Ben.
One of the things ladmire about Ben is his willingness to lead the charge, to take a
others to work together to improve our State's Capital. It is an extremely dificult task which requires
strong leadership to build momentum and get things accomplished. In the face of challenges, Ben never
loses enthusiasm or optimism, which illustrates the size of his heart. From my experience working wit
Ben and watching him put so much of himself into bettering our community, a feeling that always comes

11am writing this letter to you in support of Ben Allen,
lam a certified public accountant that has been working with small businesses in
the Jackson area for over 35 years now. Ben has been a client of mine for about
twenty years. I have prepared his personal income tax returns, and my firm has
performed bookkeeping and accounting functions for his businesses as well
In my years working with hundreds of small businesses, | have noticed distinct
differences in attitude of clients regarding how | should go about my job of
preparing their income tax returns, Some are quite timid to the point that | have to
convince them to take perfectly legitimate deductions. Others want me to bend
every rule and do everything possible to lower thelr taxes short of actual fraud.
These two personalities are the extremes.
The vast majority of people, Including Ben Allen, fall into the category of wanting
me to prepare their returns as accurately as possible. They don’t want to take
aggressive positions, yet want every legal deduction taken on their returns, | bring
Up these personalities only to say that | believe people's attitude toward the IRS
reflects on how they deal with all other areas of their lives. If someone is willing to
cheat the IRS, | believe that same individual would be willing to cheat in general.
In the twenty years | have spent working with Ben, I have never, ever, gotten the
feeling that he wanted to be aggressive on his taxes, or on anything else, Over the
years, | have watched him handle himself and his businesses in a professional
forthright manner. | have never seen him do anything that might harm the fine

One thing that has always impressed me about Ben Is his positive attitude and genuine concern
for the City of Jackson, He lives in Jackson. As far as can remember, his businesses have
always been located in the City of Jackson. He served on the City Council of Jackson. With my
knowledge of his personal income, | can confidently say he didn’t serve on the City Council for
the extra money. He did it to serve the City. | also never saw any evidence that he had any
ulterior motives like so many of our politicians seem to today. Finally, | believe he took the job
with Downtown Jackson Partners out of a real concern for the future of Jackson. Even though
many people, including myself, moved their business from Jackson, Ben did not and | applaud
him for that. thriving and healthy Jackson is good for everybody.
As | stated above, Ihave extensive experience in working with small businesses. All small
companies face common problems and issues. One of these inherent problems is the lack of
resources to'spend on accounting, bookkeeping and recordkeeping. Large companies have the
luxury of having full ime accountants on staff along with various internal control procedures in
place, Small businesses Invariably have to rely on one or two people to run everything. They
are also forced to rely on their independent accountant to clean things up at the end of the
year.
‘Small companies are also plagued with having to account for expenses that inherently have
business and personal components to them. Cell phones and vehicles are prime examples. Cell
phone carriers give various incentives to having entire families’ cell phones on the same bill,
Many times one phone ts business while the others may be personal. Business people
commonly have to use their personal cars for business purposes. Company owned cars
Invariably have at least some personal use involved. In an ideal world, the business owner
would have two separate phone bills, even though that may very well be more expensive. In
theory, company owned cars should only be driven after the driver has already driven to work
in his or her own personal vehicle, Again, this is obviously more expensive to both the
employee and company as well: In the real world, people are forced to do things that the
accountants may not like, but are necessary to get things done.
‘At year end, the outside accountant for an organization will typically work on accounting for
these items, He scans the company’s books. He also makes inquirles as to personal expenses
paid out of the business as well as business expenses paid using personal funds. The
accountant primarily does this to make sure the company’s income tax returns are prepared
correctly. Many times, the small business client will have more than one owner. In that case,The Honorable Judge Winston Kidd

the accountant may also be responsible for ensuring that all the owners know what is going on
in the business regarding expenses that have personal as well as business aspects to them.
How these items are accounted for affects the tax returns. The accountant will insist that the
personal use items be either paid back to the company, or in some cases report the personal
use as additional income to the employee. The typical small business comes to rely on the
accountant to account for these relatively immaterial items because the company itself lacks
the resources and/or ability to account for these items o
own.
Cell phones and automobiles are just two common examples. There are other examples. Many
times an employee may need its employer's assistance in obtaining products and/cr services
‘that are personal ini nature with the understanding that they will reimburse the company.
Having a spouse and/or children on an employee's health insurance policy is a common item. It
‘would obviously be less paper work for the company if it just forced its employee to go get a
separate health insurance policy. Another example might be that an employee would like to
purchase something in the company’s name because it would allow the employee to get a
discount or other benefit not otherwise avallable,
1am aware that BKD, a national accounting firm with offices in Jackson established to attorney
Robert Bibbs and Board of Directors for Downtown Jackson Partners (DIP) that Ben Allen
reimbursed DIP for his wife’s phone charges, as was his habit and practice. As | stated earlier,
having a personal cell phone line on the same phone bill as the business line is not unusual,
| think under the circumstances, Ben acted appropriately. The Executive Committee for the
Board of Directors was aware of the personal amounts on the cell phone bill. Ben did not
appear to try to hide anything. | don’t see any intent to deceive or get way with something.
Ben acted as any overworked professional would in a small office setting. With little to no
bookkeeping resources to draw on, he did the best he could. Small business owners and
directors of non-profit and/or quasi-governmental agencles regularly fall into the habit of
relying on the outside accountant to remind them of the details‘The Honorable Judge Winston Kidd

Looking at it from the big picture, Ben made complete reimbursement payments for his wife's
cell phone. The accountants for DIP agreed that the bill was paid in full as of August 2014. The
whole affair seems to me like normal activities for a small office or business. A small expense
‘was run through the business with everyone’s knowledge and the expectation that it would be
ald back, The small monthly amount of the bill did not seem to necessitate a monthly
reimbursement schedule. The intent and actual practice followed was to settle up at some
point In the future. This Is not unusual and is not evidence of wrong doing.
Ben Allen is not a criminal, | have worked with him for many years and have never suspected
that Ben wanted to do anything other than what is right. | wish | could say that for all of my
clients. He may or not have been the best bookkeeper, but his actions were not consistent with
someone wanting to steal.
Over the years, | and my co-workers have caught various individuals actually stealing money. In
every case, active measures were taken in an attempt to hide or disguise their actions. Some
were cleverer than others, However, each time, there was obvious intent to do something
wrong, a conscious decision to do it, the actual theft, and a subsequent action consisting of
some attempt to conceal It.
| see none of thishere. There is definitely no obvious intent to embezzle; | don’t see a definite
decision to commit malfeasance, I don’t see an actual theft, the money was paid back. Finally,
| see no evidence whatsoever of an attempt to conceal anything. | just pray that the Court
recognizes the difference in actual theft versus someone at worst having to be reminded to do
something that he had done willingly of his own accord In the past.
| conclude this letter with my assurances as a friend of Ben Allen and a fellow businessman that
there is not a dishonest bone in the man’s body. As a certified public accountant, with
extensive experience with this type of client, | state as clearly as I can that | see no evidence of
wrongdoing. Furthermore, | would be happy to state as much under oath.

I was appointed to the Downtown Jackson Partners’ Board in the fall of
2010 by then Mayor Harvey Johnson; sometime thereafter I was voted
onto it’s executive committee. The executive committee met monthly in
between quarterly board meetings. I have watched in awe-Ben working
like a force of nature on behalf of DJP to lift and re-invigorate our City’s

Thope this letter finds you well. | am writing you today to speak on behalf of Ben Allen, and
to respectfully ask you to consider my remarks when you make your determination of his,

First, Ben is my neighbor and a colleague in community improvement work. My husband
and | live about a block away from Ben and his wife of 41 years, Susie Allen, Ben and Susie
are well liked and very respected in our neighborhood and in the larger community. As the
executive director of a community improvement organization for the last eight years, | have
had a number of occasions to attend community gatherings and meetings where Ben has
been called to contribute his opinion and to lend his leadership skills. As a former Jackson
City Council member and as someone who has served so many civic organizations, Ben
well known asa passionate community leader. Itis that zeal for improving our quality of life
the Jackson area that made Ben the ideal candidate for his role as the executive director
of Downtown jackson Partners.
Second, Ben and Susie are long-time members of the same church that my family belongs to,
where they been actively involved for many years. | know Ben to be a devoted husband,
father and grandfather. He is always excited to babysit his grandchildren and takes great
pride in his family, Part of the reason that Ben is so committed to improving the Jackson
area is so that it will be a desirable place for his sons and their families to call home.
Finally, [ would like to close by asking that you consider Ben's many contributions and
service to our community, as well as his long-standing reputation as a man of integrity and

1am writing this letter in support of Ben Allen. He has been a good friend for almost
35 years. Ben's son, Clayton, has been my best friend since 1984. Ben and his wife,
Susie, were good friends to my late parents for many years. For as long as | have
known him, he has been a servant who has given his time to causes - and to people ~
that he loves. When we were children in Jackson, he coached us in soccer and
baseball. Foryears, he served as my Scoutmaster in Troop 8 at First Baptist Church
in Jackson, He took us to more high school and college football games than I can
count. Now that | am a father, a husband, and a business owner, | know how rare
and how precious free time is in this season oflife. And now I look back at that time
in his life and realize that during some of the most difficult years of his life - as a
young man, when he was building a business to support his family and helping his
wife raise their two young sons - he gave most of his precious free time to others.
‘And he always did so with a great attitude and with all of his heart. When I look
back on my life, I realize that | was fortunate to have a number of strong role
models, And Ben Allen is among the finest of them, alongside my father and
grandfather,
Ben did not grow up in Jackson. He is from Vicksburg, But, as an adult, when it was
time for him to choose a place to plant roots and raise a family, he chose Jackson.
‘And from the very beginning, he loved and served Jackson and its residents. He
bought a house here. He raised his children here. He served on the City Council for
three terms, He started and grew a business here. He started a radio show to
promote all things Jackson, He gave thousands of hours of his free time to causes in
Jackson that made the city a better place for all of its residents. Not in Ridgeland, or
Madison, or Flowood, or Brandon, or Pearl. He did all of these things in Jackson.
Later, when his children were grown and out of his house, and he had solé his
business, he dedicated his life - and all of his free time - to revitalizing downtown
Jackson by growing Downtown Jackson Partners from the ground up. He studied
urban revitalization all over the country, and brought ideas and best practices from
these cities to the table to help Jackson prosper and grow. He started ‘Team Jackson,
a diverse collaboration of organizations and individuals from across the City of,
Jackson, joined together for information sharing and cooperative team building, to
assure our continued positive momentum. When so many in his generation left
Jackson for the suburbs, Ben stayed and doubled down on his commitment toJackson and his service to its citizens by literally devoting his career to promoting
and celebrating all of the great things about Jackson and by serving as its greatest
cheerleader.
Ona personal level, Ihave always known Ben to be kind, friendly, funny, passionate
and honest. He is driven by principle. He is a man of great conviction and integrity.
‘And he shows great empathy. I lost my mother to breast cancer when I was 29
years old. I was devastated, In the weeks and months after her death, I received
inundreds of letters from friends and family members who knew her and knew me.
Allof the letters were kind and supportive. And of all of the letters, the one that he
wrote to me stands out. It was the most honest and personal and empathetic letter
that I have ever received, in which he shared with me his own experience of losing
both of his parents at a young age. It blew me away, And it speaks to his character
that he took the time to write me such a long, heartfelt letter at a time when I really
needed it. Several years later, when I lost my father to cancer, Ben was there for me
again, and this time he made me realize what a special person my father was, which
‘was an awesome tribute to his life.
In summation, there are few people | have known in my 37 years in Jackson - and
everywhere else in the world that I have traveled - who have invested as much time
and energy in me, and who have made as much of an impact in my life as Ben has,
And I think this is true of everyone that has gotten to know him and every
organization that he has served. From the moment that these accusations were
‘made against him, I was confident that they were not true. The investigation by
Downtown Jackson Partners proved this, as I was sure it would. [hope that when
the sentencing hearing occurs, you will consider all that Ben has done for me and for
s0 many others, and for all that he has done for the city of Jackson. | love Jackson. It

Ben for many years, since his oldest son and my son were best friends in high school and college.
Thave known Ben through his coaching baseball, football, and basketball, and through his work
in the Boy Scouts. Ben has a good heart. He is an exemplary human being; there is no question
in my mind that he is an honest person with strong character and high morals. I know Ben
Allen's wife and children. Ben is a family man, who spends the majority of his free time with his,
family and grandchildren,
am appalled that anyone would claim or accuse Ben Allen of embezzlement. 1 believe
Ben's accusers have a vendetta against him. I am familiar with the charges that were brought
against Ben, and I believe they were frivolous charges, including the 18 charges of which he was
found innocent, and the one charge that the jury made against him,
Ben Allen has spent hundreds of hours working to better the City of Jackson and the
Downtown Partners Association, by his work on the City Council and as President of Downtown
Jackson Partners. Ben and I worked on the proposed Downtown Arena that was to be built in
downtown Jackson. Ben commissioned a group of Jackson citizens, who were dedicated to
planning, building, and funding the Downtown Jackson Arena. | firmly believe that had the
arena been left in Ben's capable hands, it would be a success story today. ‘The Downtown
Jackson Arena would have brought citizens from the metropolitan area to downtown Jackson for
events, which in tur would have brought much-needed money for downtown Jackson
businesses, restaurants, and hotels,

I offer this letter in support of my good friend Ben Allen
have known Ben for over 30 years in numerous capacities, including as his lawyer, as a
father of sons of approximately the same age who attended the same school, as his constituent
when he served on the City Counel, in connection with involvement in civic affairs, as members
of a“supper club” who have been meeting every other month for over 20 years, and most
importantly, as a friend, Ben’s life story has been that of a model citizen: a loyal and devoted
hhusband; the father of two outstanding children (one of whom is my law partner); a successful
businessman; a devoted church member; a Boy Scout leader; a public servant; a civic leader; and
the list could go on and on. In my observation over the 30+ years that I have known Ben, he is a
‘man of the highest ethical standards and impeccable character. I do not know what the Distriet
‘Attomey's motives were in the attack that he has made against Ben over the last year or so, but
based on what I know, I do not believe that it was the pursuit of justice.
I would like to give you one anecdote about Ben’s advocacy for downtown Jackson.
‘About ten years ago, our firm was making a decision whether to remain in downtown Jackson
and become an anchor tenant of The Pinnacle Building or whether to move to Ridgeland in the
Renaissance development, We were being courted by developers of both projects, and we had
attractive proposals from both locations, When Ben leamed that we had undertaken a process to
make this decision, he put together a strong presentation by leaders of the City of Jackson as well
as the City's business community in an effort to convince us that we should remain in downtown
Jackson, We ultimately signed a 15 year lease to be an anchor tenant in The Pinnacle Building,
witich enabled the Pinnacle to be constructed. Ben was then, and he remains, a tireless advocate
for downtown Jackson, Our firm is here in no small part due to Ben's efforts, and I am sure our
story is repeated in many of the other building projects that we have seen,

It is my understanding that a sentencing hearing is scheduled before Your Honor's Court
next week. I must admit that am not familiar with the procedures given the posture of the case,
‘but based on what I know I would hope that the Court would have the authority to render the
equivalent of a NOV and clear Ben's name, Based on the testimony of Judge Gibbs and no
evidence to the contrary, it is difficult for me (o understand how the jury could have convicted
Ben on the cell phone charge, If dismissal of that charge is not possible at this stage, then I
‘would urge you to sentence Ben (o probation and allow him to appeal, if he and his legal team
believe that to be appropriate, as a free man.
‘This process over the last year has taken an enormous toll on Ben and his family, and Ben
has suffered cnowgh for having done nothing wrong other than being willing to serve in the
public arena, I urge you, as I know you will, to consider Ben's life story and service to our
community as you determine an appropriate ending to the proceedings in your Court. In my
humble opinion, dismissal of the cell phone count is appropriate, but if that is not possible, then
would hope that a sentence of some type of probation would be in order.

As a member of the DJP Board of Directors, I have read the indictment against Ben Allen,
authorized an investigation into the allegations, been satisfied by the evidence, and stated my
belief in his innocence. I am grateful that the jury exonerated him on nine counts, yet mystified by
the guilty verdict on one count, knowing that there is full documentation of his reimbursements
for the phone charges in question.
Tam not an attorney and bow to the advice of Board Attorney Robert Gibbs on legal
‘matters for DIP. Tdid not attend Ben’s trial and am not privy to the reasons why various pieces of
evidence were or were not submitted. However, I did attend the closing remarks in the case on
February 7,2017, and was dismayed by unrelated allegations, made against Mr. Allen, as well as
Downtown Jackson Partners and its leadership, that strayed from the charges as I understood
them and seemed to be solely targeted at damaging him and the organization as a whole.
‘These proceedings have weighed heavily upon all of us and in particularly upon Ben and his
family. Even though there has been no wrong doing, we will all be working for a very long time
to restore public confidence clestroyed by these false accusations.
Please know that I am exceeding respectful of your authority and the jury's decision in
Ben Allen's case, yet ask your patience and thoughtfulness on the remaining count to consider

Never in my wildest dreams did | expect to find myself writing a letter to the courts on behalf of
Ben Allen, There are many kind words | could write about Ben addressing his role as a husband,
father, grandfather, friend. | could spend my time writing about his integrity. Also loyalty is
another subject to address on his behalf. But I’m sure many letters have been written on those
subjects.
What | want to address is Jackson and what Ben means to the city my husband has lived in all
his life, the city we raised our son in and now the hometown of our grandchildren. It’s
perplexing to me the way many residents of the metro area and the state feel about Jackson.
Some seem to want Jackson to fail. Others act as if the city is a place of lawlessness. I'm always
amazed how these Mississippians don’t realize the importance of our state capitol. However
Ben Allen does. All this is evident in what he has done for years. While on the city council,
although I didn’t always agree with everything, he conducted himself in way that it was obvious
he was willing to help make Jackson better. Then with the formation of the Downtown
Partnership he again stepped up to the plate, The term cheerleader seems a trite adjective to
tag him with, but a most appropriate one. | think he and his family could move to the suburbs,
but instead they live in Jackson and all his actions for years are indications that he is trying to
make the city a wonderful place for his grandchildren to continue to call home, | admire him for
this and can say I’m a fan of his. | respect him and disappointed he has been put in this position.
He is an asset to Jackson and Mississippi. It’s encouraging to know someone who is so
philanthropic with their time and actions,

from Dallas in the late 80's, Ben is one of the city leaders I met early on,
Julie Mabus contacted me to see if I would help start a workforce educational program that was
to be part of Jackson State's Continuing Edueation Division. The Learning Center was located
on Highway 80 in the Enterprise Building, Having grown up in Greenville, graduating from Ole
Miss in 1962, I realized that moving back to Mississippi I would help in any way possible to
facilitate educational opportunities for our citizens.
‘The Learning Center is still a GED program in the area. For 17 years until retirement, it was my
{job to solicit support with publicity, donations, grant writing, supplies, workbooks as well as
searching for interested students,
Ben was my Councilman and was nice enough to give me an appointment. We hit it off with our
ideas and eagerness to educate as many people as we could, Ben visited our facility, met the
staff, offered support from the city, let me speak before council meetings to inform the other
Council members of our progress and acknowledged our efforts over the years with a lovely
plaque which is still on the wall.
Thave known Ben in other situations over the years, and have always known him to be of highest
cthies, have a continuing desire to help Jackson be the best, be frugal with resources and is a
constant energetic spokesman for the city.
Ben and his lovely wife Suzie of 41 years sit behind me at Christ United Methodist and they
came to the 50th wedding anniversary for my husband and me given by our three adult children a

‘One of my best teachers of “all things Jackson” is Ben Allen. He has led several trips for many
of us to view several mid-sized cities that have utilized various innovations to better their
quality of life. | first met Ben as a City Councilman and found him enthusiastic and realistic
regarding Jackson’s challenges and their possible solutions. These city visits were just what |
needed to advocate for changes and to help me select where | could contribute.
Ihave known Ben through business and Rotary. It is a rare Monday that he is not at Rotary and
contributing to cur civic projects. In Rotary we make decisions by a four-way test, and | believe
him to utilize these principles. Ben has a winning smile and speaks with good humor to

Tam writing Your Honor regarding Mr. Ben Allen, I hope you will consider this leter as
you decide the sentence to be provided as a result of the jury verdict returned in Mr. Allen’s case.
Thave personally known Ben for 20 years, when he was elected to the Jackson City
Council, in 1997. During that same time, I found myself at City Hall as well, as the Co-Chairman
of the ‘Transition Committee for Mayor Harvey Johnson, Jr. During Mayor Johnson's first two
terms in office, Iwas hired by the City to handle litigation and bond transactions, which caused
‘me as an attorney to deal with the members of the City Council frequently and intimately, From
the beginning, I was impressed with Ben's quick mind and his seriousness as a public official,
particularly when it came to insuring that public dollars were spent efficiently. He was courteous
and attentive to the countless number of city employees, contractors, and citizens who came
before the City Council each week. He worked to build consensus and civility in the often rough
and tumble polities of City Hall. His leadership traits caused him to be elected by his colleagues
as Council President, Ben always struck me as someone who took his oath of office seriously
seeking to follow both the letter and spirit of the Mississippi Code and the City Ordinances, He
‘was not shy about secking the advice of the City Attorney or the opinion of the Mississippi
Attorney General to insure that the City was acting well within the boundaries of the law. As a
councilman, Ben quickly developed a reputation at City Hall for honesty and integrity. The
citizens of Jackson greatly benefitted fiom Ben’s service on the City Council
In 2009, Mayor Johnson recommended me to serve on the Board of Directors of
Downtown Jackson Partners, where I served through October 2016, During my entive tenure on
the Board, Ben served as President of the corporation, responsible for the day to day
Page 1 of 3administration of the Business Improvement District. Ben has worked to insure that assessment
funds for our organization were not spent wastefully but spent strategically to promote the
economic growth of our Capital City through a flourishing downtown, Ben always took seriously
the primary governance role of the board of directors, working closely with our Bosrd chairs and
the Board’s executive committee, while relying upon guidance and assistance from our
accounting firm and legal counsel. I am not aware of Ben making any decision, particularly
involving the expenditure of corporate funds, that was not authorized by the Board and its
officers. [ am not aware of any decision that he made as President that was not for the benefit of
the various stakeholders of downtown Jackson, During my time on the Board, I felt that Ben kept
me fully informed of the affairs of the corporation, and lhe earned my highest respect and
confidence many times over.
As President of Downtown Jackson Partners, Ben has been a passionate advocate for
Downtown Jackson. People often refer to him as a “cheerleader for Jackson,” which he should
‘wear as a badge of honor, Ben is greatly respected by our Congressional delegation and at the
State Capitol. Ben's leadership secured the funding from state and federal sources for the recent
improvements to Capitol Street. Although we as a team came up short up in our effort, Ben and
his boatd worked tirelessly to get the legislature to move the Mississippi Department of Revenue
to the Landmark Center in Downtown Jackson. Last year, Ben lead the successful eifort to cause
the legislature to provide more than $60 million in state historic credits for the renovation of
historic buildings. This infusion of state money was recently applied to the Capitol Loft project
across the street from the King Edward Hotel, ‘The developers for the old Deposit Guaranty Bank.
Building and the old Federal Courthouse are using state historic credits in their finance plans to
renovate these buildings for residential uses, The historic tax credit legislation would not have
happened, in my opinion, without Ben’s leadership. All in all, the various stakeholders of
downtown Jackson— the property owners, the various businesses, and the people who live and
work there — have greatly benefitted from Ben’s ten years of hands on and thoughtful leadership
as President of Downtown Jackson Partners.
During the past 36 months, I have worked closely with Ben in organizing “Team
Jackson,” a 501(0)(3) tax exempt organization, [Link]/, The organization
showeases the growth and positive momentum taking place in the Capital City. Ben largely came
‘up with the idea for Team Jackson, after sceing similar organizations at work in other Southern
cities that had experienced economic stressors similar to what has happened in Jackson. Ben took
the ball and ran with it and assembled the moving parts to make it work. In short order, the
organization is now funded with the membership dues of more than 200 organizations and
individuals, and operates through « hands on board, an executive director and a steering
committee divided into several task forces. Most of the committee members are under the age of
35. The organization holds quarterly luncheons featuring out of town speakers presenting ideas
for urban “placemaking” while showcasing the creative and entrepeneurial talents of persons

organization, There would have been no Team Jackson without Ben,

embezzlement from Downtown Jackson Partners,
Since Ben is my brether, I'll not address character and life issues because, understandably, my views are
considered inherently prejudiced,
‘What | do want to address is that which 1 am professionally and experientially qualified to do: the conviction,
Tam expressing my viows 2s a Certified Public Accountant, licensed by the State of Mississippi in 1980, that
practiced: as a partner with Eubank & Betts, PLLC during the period 1983-2008; on my own 2008-2013; and,
with Barlow, Walker & Company, P.A. since 2013. Over the course of this practice, I have served as an Expert
Witness in two Federal Court actions, a Fact Witness for the FBI in another Federal Court sction, and in three
State of Mississippi actions (all embezzlement, all on behalf of the plaintiff) I was contacted yesterday to assist
attorney Kate Fiat in another matter involving disputed accountings.
Using my expertise in evaluating evidence presented in court, I concluded that the prosecution provided no,
zero, evidence supporting the charge of embezzlement: no smoking gun, not even a corroborating statement
from an interested party. In fact, the prosecution's witness from an audit/accounting perspective openly stated
that he found no evidence of embezzlement.
Furthermore, I have personally examined the documentation establishing that the cellphone bills relating to
Susie Allen’s persone cellphone were fully repaid a full 18 months prior to the indictment; documentation
provided to, and ignored by, the office of the District Attorney. This documentation was testified to by defense
witness, Judge Robert Gibbs. There was no testimony that the bills were not paid, nor that a request for
repayment had been made, much less denied by the defendant. Period
Because of what I personally heard in court, and what { have physically examined, I strongly request that this
charge of embezzling money from Downtown Jackson Partners be dismissed as factually wrong.60.

sentencing hearing next week, In light of his charge of “embezzlement”, | feel compelled to
offer a few of my comments before his “sentencing hearing”.
have known Ben for more than twenty years. My position as the President/CEO of the Greater
Jackson Chamber/Economic Development entity brought us together on many
issues/opportunities while he was on the City Council and more recently leading Downtown
Partners. People rallied behind Ben and his leadership style. On numerous occasions, | was
Impressed by Ben’s energy and determination to make this a better community. His actions
‘were, and continue to be selfless and aimed at improving the quality of life for all Jacksonians,
His vision for a better Jackson is neither centered just on downtown, nor Northeast Jackson.
Other initiatives such as to help Jackson State connect to the business community and
additionally help find funding for a new JSU stadium are important to Ben,
In addition to our work relationship, Ben and I became very good friends. He and Susie also are
fellow members of Christ United Methodist Church where we have shared in serving over the
years. They have ralsed two wonderful sons. It is easy to see the positive influenceon these
fine young men they have become today. Admittedly, | have had more of an opportunity to
interface with his son Matt, and observe the close relationship he and his dad share. Matt, like
his father, is not afraid to be a leader even though we all know strong leadership sometimes.

regarding my good friend Ben Allen.
Just so you will know, I have known, and been friends with Ben since our days at
Mississippi State University in the mid-1960s. In the 50 years that I have known Ben, he has
been a man of principle, and integrity. T have observed him when he had his own business, when
he served as a councilman for the City of Jackson, and as he has served the citizens of Jackson
through his work with the Downtown Jackson Partners, In each of these Ben has thrown his entire
body, soul and energies into making each of them a success. In faet, I watched Ben work so hard
for the City of Jackson that it almost destroyed his health. ‘Through Ben’s love for the City of
Jackson, and its citizens he came back to work with the Downtown Jackson Partners to assist in
building up the City of Jackson in an effort to keep it a vibrant community, and to avoid what
appears to be its downward slide over the past 20 years.
Thave known Ben Allen as the Scout Master of Troop 8 at First Baptist Church where he
guided young men throughout their lives, helping them to become Eagle Scouts. In addition to
helping his two sons Matt and Clayton, he also helped my son Bryan also become an Eagle Scout,
Throughout my 50 plus years of knowing him I have found him to be a man of Christian
faith, high principles, supreme integrity, and having an acute love for his fellow man. Ben has
always simply wanted what was best for the Jackson community.
In my 44 years as a practicing attorney, and as a prosecutor intern on the Mississippi Gulf
Coast, | have handled a large number of criminal cases for both the prosecution and defense, IHonorable Winston Kidd

have never seen stich unwarranted, and uncalled for charges. It is obvious the jury reached a
“compromise” verdict possibly leading to Ben’s conviction of a “nothing charge” through the use

T would ask you, as the sentencing, judge, to take all of this into consideration, Ben has
committed no crime, Quite frankly, you cannot order restitution sinee Ben paid the cell phone
charges back to Downtown Jackson Partners as they occurred. I would ask you to require no

everything in his rower to make JPS better. He never flinched or held back his support for a strong
public school system and, as is typical for the Ben Allen most of us know and love, he was not afraid to
vote his support of our school system to audiences that might not usually be predisposed to listen.
Nevertheless, he continued to be a vocal supporter of our schools and to help fight the good fight.
As | transitioned my career from legal to real estate and community development, Ben was the "go to”
uy for helping me find my way. | soon realized that no matter who you were, if you had an idea to
make Jackson a better place, then Ben was going to be there for you, whenever you needed him. Ben
‘was instrumental in helping me with legislation and with gaining the needed support of City leaders that
made the successful redevelopment of the King Edward Hotel possible. It took seven hard years to
secure the historic tax credit legislation, the environmental remediation measures, and the approval by
‘not less than 16 governmental entities necessary to restore the King Edward. Ben was with me EVERY
step of the way, tirelessly make calls, having focus groups, meeting with bankers, legislators and other
governmental officials to support our efforts, To be candid, without Ben's constant support and
reassurance, | would have given up on the project. I realized that “but for Ben” is a commen expression
for many downtown Jackson warriors.
‘More recently, my experience with Ben has been through my work on the Downtown Jackson Partners
Board, including service on the Executive Committee and as past Chairman. Ben's energy, vitality and
passion has served this community well. Ben was, and is, “alin” for this great city we call lackson, He
has worked many long hours, made many personal sacrifices and bullt many bridges that have aided our
community through some very dfficut times. He was always looking at innovative and creative ways to
‘make our City better, and he has never stopped being our City’s biggest cheerleader.
Ben is not just a leader, but a man of great moral character and integrity. As Chairman of DIP, | always
hhad great confidence that Ben was fighting the good fight for our City, butting heads with naysayers andPages
legislators and others with prejudiced perceptions. Ben always took the high moral ground, however. I
never, ever once had any question about his integrity or honesty. He has always been disarmingly
candid, honest, and eager to serve, traits not found in many leaders of today.
The allegations that became the basis of this indictment surfaced when | was Chalrman ofthe OJP
Board. To protect the board, | personally conducted my own independent investigation and made sure
‘we had outside lawyers and auditors did the same, | can honestly say that | have absolutely no doubt
that Ben Allen is innocent, did not embezzle ANY money from DIP and is in fact, a victim.
There can be no question that this indictment arose out of complaints from former DIP employee, Linda
Brune, as retaliation against Ben for changing her employment to part time. The truth is that |, and
several other Executive Committee Members, encouraged Ben to terminate Ms. Brune, because of her
racist comments and attitudes, and her inappropriate and insensitive demeanor. Ben’s falure here was
‘one of the heart. When he met with Ms. Brune, rather than terminating her position, he listened to her
pleas for help and simply reduced the number of working hours. It was only later that we found out that.
she had embezzled some $40,000 of DJP funds. It is an ironic twist that Ben's good hearted and kind
gesture of sparing Ms. Brune her job, resulted in her bearing false witness and making false charges
against him.
Finally, | should acd that there is another side of Ben Allen that very few people have seen. Ben not only
cares deeply for this community, but deeply for the people init, all of them. Only a handful of people
know that Ben has time and again put himself at financial risk to help others in this community from
financial ruin, for no reason other than Christian kindness. He has co-signed notes, has loaned money to
thers, and has paid off tax liens for people and small businesses in this community, just to keep them
from going under. 1am reminded of appropriate scripture here. “But you, when you pray, enter into
your closet, and when you have shut your door, pray to your Father which Is i secret; and your Father
which sees in secret shall reward you openly.” (American King James Version, Matt. 6.6)
implore you to consider Ben's good deeds and acts, as the life of an exemplary Christian, when you
consider the motions and proceedings before you. | know in my heart that Ben is innocent of any
‘wrong-doing, | also know In my heart, that Ben Allen is a good man, a good husband, a good father and
a good friend, and deserves your merciful consideration.

year old native Jacksonian, I have known Mr, Allen the majority of my life. T grew up as best
firicnds with his youngest son Clayton. We lived around the comer from each other from the
time we were born until approximately 18 years of ago. ‘To say I spent a lot of days and nights at
the Allen household is an understatement,
On a personal level, onc of the greatest experience and achievements of my life is participating
in Boy Scouts of America and obtaining the rank of Eagle Scout, I can honestly say if it was not
for the guidance of Mr, Allen as Scout Master (Troop 8 First ‘Baptist Church of Jackson), this
accomplishment would not have been achieved. Mr. Allen committed countless hours of his
‘own personal time over 5 years serving and impacting the lives of 11-18 year old boys and
guiding thom to become men who would serve as leaders in thelr communities and country, Boy
Scouts of America has its own code of conduct as is defined through the Scout Oath and Scout
Law. The Scout Oath and Scout Law read as follows:
