What is legal counselling?


1. Legal counselling is a vital element of an effectual legal representation.
Research by Redmount supports that in the larger sense of the term, legal
counselling refers to the broad range of consultation lawyers can provide
clients. This may be in a number of contexts (law offices, community boards,
courtrooms) and may involve a variety of functions (planning, advice, legal
action). It calls for the lawyer to recommend truthful guidance based on the

In a constricted sense, legal counselling is that set of particular attitudes and
qualities that a lawyer employs mostly in his office to aid clients to meet their

2. As a Bedan lawyer (claiming it!), I will make sure that the legal counsel I
offer shall take into account the detrimental as well as the positive facts of the
circumstance. I shall honestly communicate the possible adverse
consequences and options as well as the affirmative ones. I shall practice a
degree of empathy because I firmly believe that if the lawyer is to be
sufficiently concerned for and probing about the client, then this will lead to a
better understanding of the full implications of the matter, not just in its
restricted legal aspects. Legal counselling without empathy frequently snubs
the human aspects of experience and is expected to be a technical drill
enough for the technical troubles but scarcely so for intricate and peril-bearing
human engrossments.
My Benedictine education taught me that it is my moral responsibility to do
more than examine the client as is and provide resolutions that are simply
legally affable and handy. My Benedictine view of legal counselling
contemplates that the lawyer will consider and support the client to evaluate
the numerous implications of a potential legal transaction or a legal incident.
This is in the character of concern for the client's total welfare as it connects
to legal intervention. I will properly base my services on moral, economic,
communal and political considerations as well as the law. The appeal of the
counselling relationship I will offer shall be upheld by loyalty, concern for other
human beings, and ethical sensitivity and honorable disposition.
