Property to be seized:
In and between May 2011 and July 2015:
1, Any California Customer's identity and associated account
information pertaining to any accounts, credit cards, life insurance,
or other product or service that have been identified as being created
or issued for the Customer without the Customer’s Consent.
a. Any information as to fees, charges, or other cost charged
to the above identified accounts, credit cards, or service including
any calculation of a direct monetary loss suffered by the Customer.
b. Names and or identity of Wells Fargo employees that opened
or authorized the creation of the above identified accounts, credit
cards, or service
i, Including the identity of the above employees’
managers and address of the employees’ business/branch location
¢. Any and all communication, including email, referencing the
above listed accounts.
2. Any Customer’s identity, regardless of location, and associated
account information pertaining to any accounts, credit cards, life
insurance, or other product or service that have been identified as
being created or issued for the Customer without the Customer’s
Consent by a California based Wells Fargo employee.
a. Any information as to fees, charges, or other cost charged
to the above identified accounts, credit cards, or service including
any calculation of a direct monetary loss suffered by the Customer.
b. Names and or identity of Wells Fargo employees that opened
or authorized the creation of the above identified accounts, credit
cards, or service.
i. Including the identity of the above employees’
managers and address of the employees’ business/branch location.
©. Any and all communication, including email, referencing the
above listed accounts.
As required by California Penal Code § 1546.1 (d); any information
obtained through the execution of this search warrant that is
unrelated to the objective of the search warrant shall be sealed and
shall not be subject to further review, use, or disclosure absent an
order from the Court.Attachment 1 - Items to be Seized
Pursuant to Penal Code Section 1546.1(d) (3) and Evidence Code section
1560 (£) it is hereby ordered that the aforementioned company provide
a Certificate of Authenticity letter, that complies with the
vequirements set forth in Section 1561 of the Evidence Code, to verify
the authenticity of the records produced.
Instructions for Production of Electronically Stored Records:
1. ‘Text data relating to account transactions shall be produced
either in a delimited ASCII text data file, or within a software
application that can export it without loss of data to a non-
proprietary file format, or within a commonly readable file format set
by agreement.
a. Descriptions, layouts and indices for text data shall be
provided and may be set by agreement.
b. Field descriptions, including but not limited to account
number, transaction date, check number, amount, transaction
description, payee/pay or identification, and item image unique
identifier, shall be provided for text data.
2. Image data shall be produced in graphic data files in a non-
proprietary or commonly readable format.
a. Image data of items associated with specific account
transactions shall be:
i. produced in individual graphic data files; and
ii. linked to corresponding text data by a unique
identifier
3. Data may be transmitted in an encrypted container. Decryption
keys shall be produced separately at the time the data are produced.
Data authentication, such as hash coding, may be set by agreement.
