Welcome to a special edition of BMA Local, looking at the
changes to NHS structures in England implemented under the
Health and Social Care Act 2012. Huge changes came into
effect in April 2013 and this BMA Local Extra gives information
about the new organisations in the North of England. It is
being sent to LNC members, regional branch of practice
committee chairs and secretaries, regional council executives,
and division officers.
Links have been provided to websites for NHS organisations.
In some cases these are still under construction and do not
yet provide full details of senior appointments. Updates will
be provided when these are available.
The national picture
SHAs and PCTs were abolished on 31 March 2013 and a range
of new organisations took up their responsibilities from 1 April,
though many had already been operating in shadow form.

NHS England
This was previously known as the NHS Commissioning Board.

NHS England is responsible for overseeing the clinical
commissioning groups and will also commission specialised
services, primary care, offender healthcare and some services
or members of the armed forces. It operates according to a
mandate set by the health secretary:

NHS England has a regional and local structure. This consists
of four regions corresponding to the old SHA clusters: North,
Midlands and East, London, and South. Originally these four
regions were to be further divided into 27 area teams (ATs,
previously called local area teams). However, the 27 ATs include
three in London and London is now functioning as one unit.
The ATs have taken on direct commissioning responsibilities for GP
services, dental services, pharmacy, and certain aspects of optical
services, while ten ATs will lead on specialised commissioning
across England. A smaller number of ATs will carry out the direct
commissioning of other services, such as military and prison health.
Clinical commissioning groups
All GP practices belong to a clinical commissioning group (CCG)
that will commission most services on behalf of patients, including
emergency care, community care, planned hospital care, and
mental health and learning disability services in their local areas.
There are 211 CCGs across England and they have to be
authorised by NHS England. Currently 106 CCGs are fully
authorised and the rest are authorised with conditions, which
in a few cases are underpinned by legal directions.
Commissioning support units
Commissioning support units (CSUs) support CCGs by offering a
range of services to enable them to deliver on their commissioning
responsibilities. For some support activities, CCGs may choose to
appoint their own internal staff or they could enter a contract with
a CSU or some other source of commissioning support. The sort
of services that CSUs may provide include market management,
healthcare procurement, contract negotiation and monitoring,
information analysis, risk stratification, and service redesign. There
are 19 CSUs across England, though one (Surrey and Sussex) has
recently concluded that it is not sustainable as an independent

CSU. The CSUs are currently hosted by NHS England but the
intention is that they must become freestanding organisations by
April 2016.
Public Health England
Public Health England (PHE) is responsible for leading and
managing an integrated public health service. It takes over the
responsibilities of the Health Protection Agency and public health
observatories. It operates as four regions, corresponding to the
NHS England regions, and 15 local centres.
Local authorities
Upper tier and unitary local authorities now have new
responsibilities for the improvement of the health of their
population. They have a ring-fenced grant and now employ a
specialist public health team including a director of public health.
Most team members were previously employed by PCTs.
Health and wellbeing boards
Local authorities are also required to establish a health and
wellbeing board. The role of these boards is to promote integrated
working across health and social care. With representatives from
local authorities, health and social care, public health and patient
groups, health and wellbeing boards will produce the joint
strategic needs assessment (JSNA) and joint health and wellbeing
strategy (JHWS), identifying local priorities for commissioners.
Health Education England
Health Education England (HEE) is responsible for the education
and training of all NHS staff and it operates through 13 local
education and training boards (LETBs) across England, each
covering a particular area.

Foundation trust pipeline
There are currently 100 NHS trusts and these are said to be in the
FT pipeline. This includes acute, mental health, community health
and ambulance trusts. The Health and Social Care Act contains
provisions for the abolition of NHS trusts and it is the governments
intention that all NHS trusts should become FTs. The original
deadline was April 2014 but the government relaxed this in its
response to the Francis Report on Mid Staffordshire. The NHS TDA
can now agree timetables for achieving FT status that go beyond
2014 on a case-by-case basis. The NHS TDA has to approve FT
applications before they can be submitted to Monitor for a final
decision. The NHS TDA Accountability Framework (link above) sets
out in detail the process for consideration of FT applications before
submission to Monitor.
Since all NHS trusts are expected to become FTs by some route,
the NHS TDA is a temporary body as Monitor is responsible for
overseeing FTs.
Healthwatch
This organisation describes itself as the independent consumer
champion for health and social care in England. It operates
through a network of 152 local Healthwatch. Full details are

Clinical senates and networks
We are waiting for further information from NHS England
regarding the creation of clinical senates and networks. Their role
will be to provide clinical advice and leadership to support local

NHS Trust Development Authority
Now that the SHAs have been abolished, the NHS Trust Development
Authority (NHS TDA) has been set up to oversee NHS trusts that have
not achieved foundation trust (FT) status. All NHS trusts were required
to submit an integrated plan for 2013/14 to the NHS TDA by 5 April
2013. The NHS TDA is responsible for performance managing the
NHS trusts and supporting them to achieve FT status. In April 2013
the NHS TDA published its Accountability Framework, setting out
how it will work with NHS trusts:

Clinical senates and networks
NHS England is responsible for establishing strategic clinical
networks and senates. In Yorkshire and the Humber this will be
led by the South Yorkshire and Bassetlaw Area team. They will
involve all stakeholders clinicians, patients, voluntary
organisations, CCGs, providers of NHS services, local authorities
and others in designing networks and a senate, and setting their
objectives and priorities.
NHS England has agreed that there will be one clinical senate for
Yorkshire and the Humber. They are also expected to have four
strategic clinical networks: cancer; cardio-vascular disease; maternity
and children; and mental health, dementia and neurological
conditions. There will also be some operational delivery networks,
for example for neonatal services and for critical care.
