DEED OF LICENSE
This deed of license is made this the . Day of . 1. SRI MANIKLAL DUTTA son of Late Jadulal Dutta by faith Hindu by occupation Business, 2. SMT ANKANA Dutta wife of late Pradip Dutta, by faith Hindu, by occupation Housewife, both residing at 311, Second Street, Modern Park, Kolkata-700075, hereinafter after referred to as the LICENSOR ; (which term or expression shall always mean and include their legal heirs, executors, administrator, legal representatives, successors and assigns) of the FIRST PART. AND SRI SUMANTA ROY son of Late Jytish Kumar Roy, by faith Hindu, by occupation Business, residing at 3rd Road, Post- Santoshpur, Kolkata-700 075, hereinafter referred to as the LICENCE;(Which term or expression shall always mean and included his legal heirs, executors, administrators, legal representatives, successors and assigns) of the OTHER PART; WHEREAS the LICENSOR is the absolute owner of the Garage space (Open) on the Ground Floor of the Premises No. 311, Second Street, Modern Park, Kolkata-700 075, which is more fully and particularly mentioned and described in the schedule hereunder and hereinafter referred to as the SAID PROPERTY. WHEREAS the LICENCEE approached the LICENCOR for permission for using the SAID PROPERTY which is more fully and particularly mentioned and described in the schedule hereto for keep car only for a period of 11 (Eleven) months only with effect from 1 st September,2011, on the basis of LEAVE AND LICENSE only which ipso facto revoked on 31st July, 2012; NOW IT IS EXPRESSLY AGREED AND DECLARED BY AD BETWEEN THE PARTIES AS FOLLOWS: 1. This writing shall never be construed as any tenancy agreement or lease or otherwise creating any other right or interest in the property in favour of the LICENSEE which s not all the intention of the parties but on the contray merely a temporary agreement simply to allow the LICENSEE to use the occupy the portion
of the premises for his residential purpose under the control and supervision of the LICENSOR. 2. The LICENSEE shall in consideration of such accommodation as hereunder, provided pay to the LICENSOR a fixed sum of RS. 13200/- (Rupees: - Thirteen Thousand Two Hundred) only as charges for such temporary occupation for the period of 11 (Eleven) months which sum will be paid at the rate of Rs.1200/(Rupees: - One Thousand Two Hundred) only per month on the 5 th day of every English calendar month without delay or default. The licensee has paid a sum of Rs.1200/- (Rupees: - One Thousand Two Hundred) only which will be kept with the Licensor as interest free security deposit which will be refunded by the licensor to the licensee during the time of license period and shall hand over the vacate possession of the license property. 3. That the licensee shall use the aforesaid space absolutely and strictly for keeping car only.
4. That the licensee shall not get electricity. 5. That the licensee shall not damage the described premises and shall keep the described premises as good condition as it is at the time of in duration as LICENSEE;
6. Provided, however and notwithstanding anything hereinbefore contained it is hereby expressly agreed by and between the parties hereto that in default of any payment on the dates hereinbefore referred to above to the LICENSOR. The LICENSOR shall be entitled to and shall have always the power to revoke the LICENSEE hereunder granted at their absolute discretion and reoccupy the said portion of the property without subjecting himself to any liability in that account and notwithstanding intermediate negotiation or whatever of breach there of when and in such an event the LICENSEE shall surrender the occupied portion of the property as hereunder contemplated.
7. That if the LICENSEE wants to determine the LICENSE earlier to the stipulated period as aforesaid in such case he has to give one month prior notice to the LICENSOR in writing the security deposit in that situation be calculated and refunded to the LICENSEE by the LICENSOR.
SEHEDULE OF THE LICENSE PROPERTY ALL THAT piece and parcel of the Car parking space (open) on the Ground Floor of the premises No-311, Second Street, Modern Park, Kolkata-700075 for a period of 11 (Eleven) months only.
