Texas Community DevelopmentBlock Grant Program (TxCDBG) for funding under the 200712008Community
Development Fund/CommunityDevelopment Supplemental Fundhas beendisqualified for the followingreason.
The city of Pelican Bay did not use the 200712008CommunityDevelopmentFund/ Community Development
rpplementalFund (CD/CDS)application guideand forms. Therewere significant changesin the 200712008 CD/CDS
cycle and the new proceduressupersededthosepublishedin all previousapplication
application guides(page 1 of the
200712008 CD/CDS ApplicationGuide). The new applicationcontainsnew sectionsand forms includingthe Project
lmpactInformation addressesthe scoringcriteriaand the Objectivesand Outcomessectionwhich is a
whichspecifically
new requirement from the U.S.Department of Housingand UrbanDevelopment.Withoutthis information, the application
is consideredsubstantiallyincomplete. ORCA will not consider applicationsthat are incomplete,received after the
deadline,or that lack informationneededby TxCDBG staff to make determinations concerningthe eligibilityof each
activity(page3 of the 200712008
application TxCDBGCD/CDSFundApplication Guide).
It is unfortunatethat the city and the city's applicationpreparerwere unawareof the applicationchanges. ORCA made
every effortto inform all partiesinvolvedin the TxCDBG programabout the changes. The noticeof the application
workshopswas sent to all TxCDBG eligibleapplicantsand the notice informedthe public about the new electronic
application format. Five application workshopswere held in June 2006 at variouslocationsthroughoutthe state. The

The City of PelicanBay respectfullyrequestsan appealregardingthe disqualification
of the city's applicationto the 200712008Community DevelopmentBlock Grant Program.
The City offers the following information in supportof this appeal.
The City will show that the Office of Rural Community Affairs' websiteprovided
inaccurateand misleadinginformation relativeto the applicationrequiredfor the 200712008
Community DevelopmentBlock Grant Programfunding cycle. The City will show that a
requestwas made for a current applicationto be mailed to the city's grant administrator.
Finally, the City will arguethat the applicationsof the previousand current funding cyclesare
not substantivelydifferent and, therefore,shouldbe allowed under thesespecific
circumstances.
The City of PelicanBay has contractedwith Lawrence& Associatesfor many yearsto
compile applicationsto the Texas Community DevelopmentProgramand when funded,to
administerthe grant funds associatedwith the projects. During this past funding cycle, the
City againrequestedthe assistanceof Ms. JessicaKaltenbachwith Lawrence& Associatesto
assistin the compilation of their 200712008application. Ms. Kaltenbachwas not able to
attend the workshop that was held closestto the DFW region due to a conflict with a
previously scheduled(and publicized) public hearing in another client city which was on the
opposite side of the Metroplex. However, when Ms. Kaltenbachrealized the conflict between
the two scheduledevents, she called an ORCA representativeto obtain advice on the matter.
The ORCA representative,Ms. Julie Hartley, statedthat workshops were recommendedsince
changeswere being made to the application; however, that the applications would be made
availableonline. Becausetheseworkshopsare not mandatoryand Ms. Kaltenbachhad a
previously publicized engagement,sherequesteda copy of the applicationin eitherpaper
copy or electronicformat to be sent. Ms. Hartley explainedthat they could not do that. Ms.
Hartley reiteratedthat the applicationswould be availableonline. Becausethe public hearing
had beenadvertisedand there was no one elseto attendin the absenceof Ms. Kaltenbach,Ms.
Kaltenbachdecidedto attendher prior engagementwhich precludedher attendanceat the
applicationworkshop.
Based on the information sharedduring the phone conversationbetween Ms.
Kaltenbachand Ms. Hartley, when Ms. Kaltenbachbeganto preparethe city's application,
shevisited the ORCA website online to be surethat shewas utilizing the correctapplication
form. The Office of Rural Community Affairs websitepage

as well as a link to connectto the applicationform itself. This link directly opensan
applicationform; however,the applicationform that is openedis the form that has beenused
in the previousfunding cycle. This erroneouslink was a principle reasonthat Ms.
Kaltenbachcompiled her applicationbasedupon the previously acceptedapplicationformat.
After careful review of the new (200712008)application,the City would contendthat
this application has changedprimarily in format rather than in required content. There is only
one section that was specifically addedto the current application which is not explicitly
required in the previous application. The Project Impact Scoring section requires information
pertainingto supportdocumentationfor the proposedproject including TCEQ notices,EPA
notices,etc. Arguably, the City of PelicanBay's proposedstreetimprovementsproject does
not and would noi have this type of information. Shouldthe departmentuphold the City's
appeal,the City would be happy to transfer the information currently provided in the
application submitted to ORCA to the new application format. No changesto the original
information would be made.

application. I would like to take a moment to explain what hashappenedand
why.
As part of eachbi-annualapplicationprocess,ORCA holds several
applicationworkshopsacrossthe state. This year was the first year that I
was not able to attendthe workshop that was held closestto the DFW region
due to a conflict with a previously scheduled(and publicized)public
hearingin a client city which was on the oppositeside of the Metroplex.
However, when I realizedthe conflict betweenthe two scheduledevents,I
called an ORCA representativeto obtain advice on the matter. The ORCA
representative, Ms. Julie Hartley, statedthat workshopswere recommended
sincechangeswere being madeto the application;however,that the
applicationswould be made availableonline. Becausetheseworkshopsare
not mandatoryand I had a previously publicizedengagement,I requesteda
copy of the applicationin either paper copy or electronicformat be sent.
Ms. Hartley explainedthat they could not do that. Ms. Hartley reiterated
that the applicationswould be availableonline. Becausethe public hearing
had beenadvertisedand there was no one elseto attendin my absence,I
decidedto attendthe public hearingwhich precludedmy attendanceat the
applicationworkshop.
Basedon the information sharedduring the phoneconversationbetweenMs.
Hartley and myself, when I beganto preparethe city's application,I
visited the ORCA websiteonline to be surethat I was utilizing the correct
applicationform. The Office of Rural Community Affairs websitepage

connectto the applicationform itself. This link directly opensan
applicationform; however,the applicationform that is openedis the form
that hasbeenusedin the previous funding cycle. This erroneouslink was
a principle reasonthat I compiled the applicationbasedupon the previously
acceptedapplicationformat.
After careful review of the new (2007/2008)application,I
believe that the application has changedprimarily in format rather than in
requiredcontent. There is only one sectionthat was specificallyaddedto
the currentapplicationwhich is not explicitly requiredin the previous
application. The ProjectImpact Scoring sectionrequiresinformation

submittedby the city of PelicanBay to the
Texas Community DevelopmentBlock Grant Program (TxCDBG)for funding under the 200712008Community
Development Fund/CommunityDevelopment Supplemental Fundhas beendisqualifiedfor the followingreason.
The city of Pelican Bay did not use the 200712008CommunityDevelopmentFund/ Community Development
jupplemental Fund (CD/CDS)applicationguide and forms. There were significantchanges in the 200712008CD/CDS
applicationcycle and the new proceduressupersededthosepublishedin all previousapplicationguides(page 1 of the
200712008CD/CDS ApplicationGuide). The new applicationcontainsnew sectionsand forms includingthe Project
lmpactInformation whichspecifically
addressesthe scoringcriteriaand the Objectivesand Outcomessectionwhich is a
new requirement from the U,S.Department of Housingand UrbanDevelopment.Withoutthis information, the application
is consideredsubstantially incomplete. ORCA will not considerapplications that are incomplete,receivedafter the
deadline,or that lack informationneededby TxCDBG staff to make determinations concerningthe eligibilityof each
activity(page3 of the 200712008
application TxCDBGCD/CDSFundApplication Guide).
It is unfortunatethat the city and the city'sapplication
preparerwere unawareof the application
changes. ORCA made
every effort to inform all partiesinvolvedin the TxCDBG programabout the changes. The noticeof the application
workshopswas sent to all TxCDBG eligibleapplicantsand the notice informedthe public about the new electronic
applicationformat. Five application workshopswere held in June 2006 at variouslocationsthroughoutthe state. The
changesin the 2007nA08 CDICDSapplication was also discussedat each of the 2OO72OA8 Or'ganizational
Regional
Review Committeemeetings. Additionally,two meetingswere held with interestedparties(eligibleentities,consultants,
engineers,COGs)in May 2006 to offera previewand get feedbackon the new application format.
As statedon page 1 and 3 of the 2007-2008CommunityDevelopmentFund/ CommunityDevelopmentSupplemental
Fund, applications that are not completeor do not meet programrequirements will be subjectto disqualification.ln
observanceof our publishedapplicantproceduresrequirements and in orderto providea fair granteeselectionprocess
for the applicantsthat have met all of the 200712008
TxCDBGapplication submissionrequirements, the city of Pelican
Bay must be disqualified.

The City offers the following information in supportof this appeal.
The City will show that the Office of Rural Community Affairs' website provided

Community Development Block Grant Program funding cycle. The City will show that a
requestwas made for a current application to be mailed to the city's grant administrator.
Finally, the City will argue that the applications of the previous and current funding cycles are
not substantivelydifferent and, therefore,shouldbe allowed under thesespecific
circumstances.
The City of Pelican Bay has contractedwith Lawrence& Associatesfor many yearsto
compile applications to the Texas Community Development Program and when funded, to
administer the grant funds associatedwith the projects. During this past funding cycle, the
City againrequestedthe assistanceof Ms. JessicaKaltenbachwith Lawrence& Associatesto
assistin the compilation of their 200712008application. Ms. Kaltenbachwas not ableto
