NOTICE OF PERFECTION OF MECHANICS LIEN PURSUANT TO 11 U.S.C. 546(b)(2) EMJ Corporation (EMJ), hereby provides this Notice of Perfection of mechanics lien on real property located at the Mowry Center, 5655 Mowry Avenue in Newark, California (the Property). The mechanics lien secures indebtedness owed by the Debtor to EMJ in the amount of $642,121.20, plus accrued interest and attorneys fees, representing services rendered, materials, and labor to construct a Mervyns retail store at the Property, beginning on June 25, 2007. Filing of said lien is allowed under 11 U.S.C. 362(b)(3). The debt that is due to EMJ arises out of a result of labor, materials, and services rendered to the Debtor in Newark, California and arises as a lien pursuant to California law. A copy of the lien is attached hereto as Exhibit A. Pursuant to section 3019-3153 of California Civil Code, a Claim of Lien was timely made against the Property, including the improvements thereon. By virtue thereof, by the service and filing of this Notice, and pursuant to any applicable state law, EMJ files this Notice of Perfection to further prefect, to the extent necessary, its interest in and right to a lien to secure the payment of its pre-petition debt owed by the Debtor on -1ME1 7668773v.1 ME1 7682033v.1
